Notice of the hearing was sent to abutters and others and notices of the hearing were published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. Petitioner is requesting an Administrative Appeal of the Building Inspectors refusal to issue a Building Permit to rebuild fire damaged apartment. If denied,Petitioner is seeking Variances from lot area,lot area per dwelling,lot width,minimum side yard,rear yard and number of parking spaces for the property located at 33 R Beaver Street located in an R-2 zone. The Board of Appeal, after careful consideration of the evidence and after reviewing the plans at the hearing, makes the following findings of fact: 1. The Petitioner was represented by Attorney Rosalyn Stults of 221 Essex Street in Salem. 2. The Building Inspector refused to issue a building permit because he could not find a card showing a permit for the original building. The Building Inspector felt that the building may have been constructed illegally. 3. Council for the Petitioner said the present owners were not responsible for the building being constructed. 4. Many neighbors spoke against the tenants saying that the building smelled, contained rodents and was not being cleaned up. Abutters also spoke about fences being tom down and people cutting through there yards. 5. The property at 33 Beaver Street was purchased by the present tenants on December 3, 2002. They are asking for a third unit to be added above an existing garage. 6. Linda Greenwood of 35 Beaver Street said she could still smell smoke from the fire. She also stated that the property was not being maintained. Ruth Simpson of 33 Beaver Street said a fence had been tom down and that people used that as a cut through. 7. The City was aware of the building since at least 1975 based on the 1975 assessor's records. Prior to demolition of property, a licensed plumber shall ascertain where all water and sewer lines are located on said property. The plumber shall make a determination of use of such water and sewer lines,not limited to, domestic use, irrigation, fire suppression, or septic systems. After all water and sewer lines have been located,the plumber shall make a written report with diagrams of utility locations found to the Director of Public Services. A request to the Department of Public Services shall be made to terminate water services at the street after such notice of locations have been made but not before item#2 is completed. 2. Prior to demolition a licensed drain-layer, licensed by the City of Salem, shall cut and cap the water and sewer lines at the city main. In the event that water or sewer will immediately be used after demolition for construction purposes, a set of certified plans and drawings by a registered professional engineer must be provided to the Dir. Of Public Services/City Engineer reviewed and approved prior to the obtaining a demolition permit. 3. A demolition permit shall not be issued until items 1 &2 have been completed and the Department of Public Services has conducted an inspection and signed off on the water and sewer portion of the Building Department prerequisite Utility Disconnections Required form.
