Dear Sir:
Complaints have been received by this Department relative to racoons being
observed around and on the roof of your building.
An on site inspection was conducted by Sanitarian for the Health Department
Virginia E. Moustakis on Wednesday June 17, 1992. At the time of inspection,
the soffit area was rotted and in structural disrepair, leaving large open
areas around the building. These areas are creating potential harborage
for insects, squirrels, birds and racoons, as well as creating nuisance
conditions.
You are hereby ordered to take immediate corrective action within fifteen (15)
working days of receipt of this Order to repair the soffit area which is
in violation of State Sanitary Code, Chapter II 105 CMR 410.602.
Failure on your part to comply within the specified time will result in a
complaint being sought against you in Salem District Court.
Should you be aggrieved by this Order, you have the right to request a
hearing before the Board of Health. A request for said hearing must be
received in writing in the office of the Board of Health within seven (7)
days of receipt of this Order. At said hearing, you will be an opportunity
to be heard and to present witness and documentary evidence as to why this
Order should be modified or withdrawn. You may be represented by an attorney.
Please also be informed that you have the right to inspect and obtain copies
of all relevant inspection or investigation reports, orders and other
documentary information in the possession of this Board, and that any adverse
party has the right to be present at this hearing.
Your anticipated cooperation in this matter is appreciated.
