The paragraph that was not completed yet is filing an appropriate Building Permits by the plumbing tradesmen and arranging inspectors to see the work. As it has been stated above no one is currently occupying or will occupy the site until the required actions will be taken.The reason that a permit was not yet filed is that the plumber that searched the site has to see removed construction finishes on all floors. Mr.Jaymes Allan, the contractor that has built the attic bedroom and who knows all the vent connections behind the walls is currently out of State and expected to come back by the 3d week of June. As soon as he is back I will be able to make all necessary openings to show to the inspector. With fool responsibility I will make sure that permit will be filed not later than June 23d. Otherwise I will have to remove all tenants with Leases from the property. I ask your permission to postpone the due date of the reporting to the building department required in the Notice. On or about July 112015,the following unfair or deceptive act occurred: The residency I have rented from you has suffered from various code violations including: • Hole in the roof. • Ceiling falling in. • Broken Windows. • No lights in the foyer or on the stairs inside the the building in the front and the back. • Missing and ripped screens. • Breaches in the foundation. • Mice. • Mold in the bathroom. • Non water proof surfaces in or around the shower. • Fuse boxes without doors with wires running from one box to the other. • Hot water and heat on two separate gas bills incurring the minimum charge twice. • Fire alarms and carbon dioxide alarms not hung properly with dead batteries. • Wires hanging freely or exposed on the sheetrock(Not running between the studs) • Contractor waste littering the driveway. • No interior fine extinguishers. • No proper closet in bedroom. • Doors not hung correctly and not weathertight. • No proper locks to interior units. • No access to the kitchen or bath without going through first floor unit. • No lights in the fust floor unit. • Pathways through first floor unit not kept clear. 1 • Outlets hanging from the walls. • Banisters falling out of the walls. • Stairs to steep. • Permits not displayed or construction without a permit on the first floor unit. Grass and yard not maintained. • Broken disposal in sink leading to poor drainage. • Burners on the stove do not work and the ones that do flair up every time you use them. • Breach in Quiet Enjoyment of the premises. This unfair or deceptive act or practice is, in my opinion, declared unlawful by Section 2 of Chapter 93A,(you may want to give regulation number,if applicable)which reads as follows: This is a list of State Sanitary Code Violations the unit you rented to me has breached: • A kitchen must contain a kitchen sink, space and proper facilities for the installation of a refrigerator and,unless otherwise stated in the lease,a stove and oven in good repair. These facilities must be free from defects which make them difficult to clean, or which create an accident hazard. [410.100] • No or inadequate electrical outlets or lighting in common areas. [410.250(B),251(A),253,254 ] • No or inadequate locks for entry doors for either the apartment or building. [410.480(D)] • Accumulation of garbage or filth that may provide food or shelter for rodents, insects, or other pests; or that may contribute to accidents or disease. [410.600, 601, 602] • Roof, foundation, or other structural defects that may expose you to fire,burns, shock, accident, or other danger. [410.500] • No smoke detector or carbon monoxide alarm in good working order. [410.482] • No or unsafe handrails or protective railings on porches,roofs, stairways,or other similar places. [410.503(A)and(B)] • Any defect in electrical,plumbing,or heating system that violates "generally accepted standards"but does not create an immediate hazard. [410.750(0)(3)] • Cockroach, insect,or rodent infestation in buildings with two or more units. [410.550] • Sink must be large enough to wash dishes, get hot and cold water,and have proper drainage. [410.100(A)(1),410.350(A)] • Landlord must provide a stove and oven in good working condition(unless written agreement requires tenant to provide these).[410.100(A)(2)] • All sinks, landlord-installed refrigerators and stoves,and gas-and oil-burning equipment must be in good working condition. [410.351] • Walls must be nonabsorbent,waterproof, and easily cleanable material up to 4 feet. Walls above bathtubs with showers or shower stalls must have nonabsorbent,waterproof covering up to at least 6 feet. [410.504(B)and(C)] • A water heater that vents to a chimney or vent that leads outdoors. If the heater is electric, it does not need a vent. Old-fashioned, open-flame water heaters are illegal. [410.202] • The temperature must not be more than 78 degrees Fahrenheit at any time during the heating season.[410.201] • Landlord failed to provide and place electric light fixtures and switches that allow safe and 4• reasonable use in hallways,stairways, foyer, community corridor, cellar, Outside stairways and passageways, [410.253(A)] and Interior passageways [410.254(A)]. • Temporary wiring may not be used. But you can use extension cords for portable appliances or fixtures. [410.256] • In a property with more than one unit,the landlord must keep all shared exits free from obstruction. [410.451] • The landlord must install and maintain fire extinguishers as required by the local fire chief. [527 C.M.R §10.02] • The landlord failed to make sure that all exterior windows that open and all entry doors have working locks. [410.480(D)and(E)] • The landlord failed to maintain all structural elements in good repair. They must be weathertight, free from chronic dampness, insect-proof, and rodent-proof. They must be free of holes, cracks, loose plaster and other defects. Violations include foundation, windows, roof, handrails on stairs, and ceiling. [410.500] • The landlord failed to keep common areas clean and sanitary. [410.602(D)] • Failure to provide screens to windows [410.551 410.553] and doors [410.552 410.5531. • The landlord must install correctly and keep free of leaks,blocks,and other defects,the following: stoves and oven, garbage disposal, smoke detectors,carbon monoxide detectors, and electrical wiring. [410.351(A)+(B)] • No rats,roaches,mice, bedbugs, or other insects are allowed in the apartment or building. The landlord must exterminate them when they are found in common areas or in any individual apartment in buildings with two or more units. [410.550] Also according to General Laws: CHAPTER 239, Section 8A I as the tenant can withhold rent and pay such amounts to the clerk of the courts to be held until repairs are made with possible reductions in monies paid according to what the judge declares the fair value of the rent. Also any retaliation actions or attempts at eviction can lead to treble damages received by the tenant General Laws Chapter 186. (Section 18 and Chapter 239 Section 2A). As a result of this unfair or deceptive act or practice,I suffered injury or loss of money as follows: 1 have not received fair value for my rental payments of $2800. Therefore,I hereby demand the following relief: • In recompense I am looking for a refund of all or a fair partial amount of rent paid previously. • Building violations to be fixed. • I am also withholding rent till such violations have been remedied. Chapter 93A gives you the opportunity to make a good-faith response to this letter within thirty (30) days. Several of these violations also call for the Landlord to make repairs in 5 days. Your failure to do so-could subject you to triple damages, attorney's fees and costs if I decide to institute legal action. Rent Withholding(Massachusetts General Laws, Chapter 239, section 8A): If Code violations Are Not Being Corrected you may be entitled to hold back your rent payments. You can do this without being evicted if. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger or materially impair your health of safety and that your landlord knew about the violations before you were behind in your rent. You did not cause the violations and they can be repaired while you continue to live in the building. You are prepared to pay any portion of the rent into court if a judge orders you to pay it. ( For this. it is best to put the rent money aside in a safe place) 2. Repair and Deduct(Massachusetts General Laws,Chapter III,section 127L): The law sometimes allows you to use your rent money to make the repairs yourself. If your local code enforcement agency certifies that there are code violations which may endanger or materially impair your health, safety,or well-being, and your landlord has received written notice of the violations,you may be able to use this remedy. If the owner fails to begin necessary repairs(or to enter into a written contract to have them made)within five days after the notice or to complete repairs within 14 days after notice, you can use up to four months rent in any year to make repairs. 3. _Retaliatory Rent Increases or Evictions Prohibited (Massachusetts General Laws,Chapter 186, section 18, and Chapter 239, Section 2A): The owner may not increase your rent or evict you in retaliation for making a complaint to your local code enforcement agency about code violations. If the owner raises your rent to try to evict within six months after you have made the complaint, he or she will have to show a good reason for the increase or eviction which is unrelated to your complaint. You may be able to sue the landlord for damages or if he or she tries this. 4. Rent Receivership (Massachusetts General Laws Chapter II, section 127 C-H): The occupants and/or the Board of Health may petition the District or Superior Court to allow rent to be paid into court rather than to the owner. The court may then appoint a"receiver" who may spend as much of the rent money as is needed to correct the violation. The receiver is not subject to a spending limitation of four months'rent. 5. Breach of Warranty of Habitability: You may be entitled to sue your landlord to have all or some of your rent returned if your dwelling unit does not meet minimum standards of habitability. 6. Unfair& Deceptive Practices (Massachusetts General Laws, Chapter 93A) : Renting an apartment with code violations is a violation of the consumer protection act and regulations, for which you may sue an owner. You have also failed to arrange for an inspection from the Salem Health Department. Additionally, the City has no record of Building occupancy permits or inspections from the renovations done a few years ago.
