Hacker and Feeherry, Associate Member Lusinski and Martineau. Notice of the hearing was . sent to abutters and others and notices of the hearing were properly published in the Salem Evening News in accordance with Massachusetts General Laws Chapter 40A. The Petitioner has requested a Special Permit to convert the existing three-family- dwelling at this property into three condominium units. This proposed condominium conversion is covered by the terms of the City of Salem's condominium conversion ordinance. The Special Permit that has been requested may therefore be granted only upon a finding by the Board of Appeals that (1) the grant of the Special Permit will not adversely impact upon the city's : existing stock of rental units for low and moderate income families and elderly pr,ple �on .fixed incomes, (2) that the grant of the Special Permit is not contrary ; tv"c .e.City's Master Plan, and (3) the grant of the Special Permit will not have an adverse effect on the neighborhood. The property is vacant. Thus, no hardship is caused by the proposed condominium conversion to any tenants. On the basis of the above findings of fact and on the evidence presented at the public hearing, the Board of Appeals by a 4 to 1 vote (Mr.-Lusinski opposed) concluded that the proposed condominium conversion is in harmony with the condominium conversion ordinance of the City of Salem. Wolfe 95 Bay View Avenue Salem, MA 01970 Dear Mr. Wolfe: I received your letter today; I sympathize with your situation and with the Bay View Avenue neighborhood. However, I do not have any easy answers to the questions which you have raised. Condominium conversions are absolutely the most difficult problems that the Board of Appeals confronts each month. Whatever decision we make we necessarily displease one group or another . Owners ar-e interested in the financial benefits that are availalbe to them in conversions . Many young people see condominiums as the only opportunity available to them currently to purchase a first home. In the face of Proposition 2-1/2 cities are interested in the additional tax revenues that are generated through condominium conversions. On the other hand, abutters are understandably troubled by changes in their neighborhood. There are no simple solutions to these problems . In deciding the case involving the condominium conversion at 102 Bay View Avenue, the Board tried to balance legitimate neighborhood concerns -- such as access to the ocean -- with the legitimate interests of the owner. With respect to your point on the construction and aesthetics of the property at 102 Bay View Avenue, unfortunately, the Board of Appeals has absolutely no control over the architectural details or construction practices involved in a condominium conversion. We can, of course, mandate that construction be in accordance with State Building Codes. However, I realize that this does not solve the problems that you have with the appearance of the property. Your question on parking is easily answered. If the developer of 102 Bay View Avenue uses the area in front of the condominiums for parking, this is a clear violation of the special permit which the Board granted. If this occurs, you should immediately contact Mr. McIntosh, the Building Inspector for the City of Salem and he will see that the terms of our decision are complied with. As to the problems with debris in the area, I can only suggest further communications with the Department of Public Health. A copy of this letter is being sent to Mr. McIntosh who will, I am sure, visit the site and report back to the Board on the situation at 102 Bay View Avenue.
