Dear Mr. Lundregan:
This will acknowledge receipt of your letter regarding the
issuance of a building permit for property located at 98 Bay View
Avenue, Salem.
As I have advised you in our recent conversations it is my .
opinion that the permits have been properly issued and that the
construction currently underway does not constitute an expansion
of a nonconforming use. I have discussed the issue with our City
Solicitor, Michael E. O'Brien and he concurs with my opinion.
If it is your intention to appeal this decision I would urge
you to follow the procedure provided in Section 15 of Massachusetts
General Laws, Chapter 40A.
With regard to your request regarding the issuance of a cease
and desist order, I can only re-affirm my opinion that the construction
is being performed under a legal permit and until the Board of Appeal
rules otherwise, construction will be allowed to continue.
If I can be of further assistance in this matter please contact
me.

Dear Mr. Munroe:
Please be advised that I represent Catherine L. Begley, 96 Bay View
Avenue, Salam, Massachusetts.
In accordance with our conversation of yesterday, it is my understanding
that you have issued a building permit to Kathline M. Bevins, 98 Bay
View Avenue, for extension of a non-conforming use.
Pursuant to Massachusetts General Laws, Chapter 40 A Section 8 & 15,
I hereby appeal your decision to grant that building permit to the Board
of Appeals and I would appreciate it if you would schedule this matter
for a hearing at the earliest possible occasion.
I would also request that pending, this matter being heard by the Board
of Appeal, that pursuant to the above statue that the Bevins' be ordered
to cease and desist any construction until the decision has been rendered
by the Board of Appeals.
I would also appreciate it if you would forward me a copy of your cease
and desist order for my file.
If you have any questions with reference to this matter, please do not
hesitate to call me.
