DECISION OF THE PETITION OF BRIAN AND CHERYL GI_DEON REQUESTING A
VARIANCE FOR THE PROPERTY LOCATED AT-22 BAY VIEW-CIRCL (R-1)
A hearing on this petition was held April 15, 1998 with the following Board
members present: Gary Barrett, Chairman, Nina Cohen, Richard Dionne, Paul
Valaskagis and Michael Ward. Notice of the hearing was sent to abutters
and others and notices of the hearing were properly published in the Salem
Evening News in accordance with Massachusetts General Laws Chapter 40A.
Petitioner requests a Variances from side setback to allow a garage to be
constructed for the property located at 22 Bay View Circle.
The Variance which has been requested may be granted upon a finding of this
Board that :
1 . Special conditions and circumstances exist which especially affect the
land, building or structure involved and which are not generally affecting
other land, buildings, or structures in the same district.
2 . Literal enforcement of the provisions of the Zoning Ordinance would
involve substantial hardship, financial or otherwise, to the petitioner.
3 . Desirable relief may be granted without substantial detriment to the
public good and without nullifying or substantially derogation from the
intent of the district or the purpose of the Ordinance.
-he Board of Appeal , after careful considerations the evidence presented at
the hearing, makes the following findings of fact:
1 . The petitioner, Mr. Brian Gideon, represented himself.
2 . A plan showing the proposed garage was presented to the board.
1 . There was no opposition to the petition.
On the basis of the above findings of fact, and on the evidence presented
at the hearings , the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property
and not the district in general.
2 . Literal enforcement of the provisions of the Zoning Ordinance would
involve substation hardship to the petitioner.
3 . Desirable relief can be granted without substantial detriment to
public good and without nullifying and substantially derogating from
the intent of the district or purpose of the Ordinance.
On the basis of the above findings of fact, and on the evidence presented
at the hearing, the Zoning Board of Appeal voted unanimously, 4-0 to grant
the variance requested, subject to the following conditions :
1 . Petitioner shall comply with all city and state statures, ordinances ,
codes and regulations .

existing structure.

Therefore, the hereby finds that the following conditions
are necessary, in accordance with the Performance standards set forth .in the
regulations, to protect those interests checked above. The
orders that all work shall be performed in accordance with ear cu R=no and
with the Notice of intent referenced above. To the extent that the following
conditions modify or differ from the plans, specifications or other proposals
submitted with the Notice of intent, the conditions shall control.
General Conditions
1. Failure to comply with all conditions stated herein, and with all related
statutes and other regulatory measures, shall be deemed cause to revoke
or modify this order.
2. The order does not grant any property rights or any exclusive privileges;
it does not authorize any injury to private property or invasion of
private rights.
3. This order does not relieve the permittee or any other person of the
necessity of complying
with all other applicable federal, state or local
statutes, ordinances,-by-laws or regulations.
6. The work authorized hereunder shall be completed within three years from
the date of this order unless either of the following apply:
(a) the work is a maintenance dredging project as provided for in the
Act; or
(b) the time for completion has been extended to a specified date more
than three years, but less than five years, from the date of issuance
and both that date and the special circumstances warranting the
extended time period are set forth in this order.
5. This order may be extended by the issuing authority for one or more
periods of up to three years each upon application to the issuing
authority at least 30 days prior to the expiration date of the order.
6. Any fill used in connection with this project shall be clean fill,
containing no trash, refuse, rubbish or debris, including but not limited
to lumber, bricks, plaster, wire, lath, paper, cardboard, pipe, tires,
ashes, refrigerators, motor vehicles or parts of any of the foregoing.
7. No work shall be undertaken until all administrative appeal periods from
this order have elapsed or, if such an appeal has been filed, until all
proceedings before the Department have been completed.
8. No work shall be undertaken until the Final order has been recorded
in the Registry of Deeds or the Land court for the district in which
the land is located, within the chain of title of the affected
property. in the case of recorded land, the Final order shall also
be noted in the Registry's Grantor Index under the name of the owner
of the land upon which the proposed work is to. be done. In the case
of registered land, the Final order shall also be noted on the Land
Court Certificate of Title of the owner of the land upon which the
proposed work is to be done. The recording

undersized and had been held in common ownership with the abutting

My opinion in connection with this matter has changed based
upon a new deed supplied to me by Steve Lovely. The land in
question was not held in common ownership, but held in the name of
a corporation which obviously makes this lot a buildable lot
inasmuch as it is in excess of 5,000 square feet.

SPECIAL CONDITIONS
22 BAYVIEW CIRCLE
1. All work shall conform to the above-referenced Notice of
Intent (NOI) , site plan and supporting documents and those
final specifications which shall be filed with the
sCommission prior to construction. Any change to the
A approved plans shall require the applicant to inquire of the
Commission in writing whether the change is substantial
G\ enough to require the filing of a new NOI.
2 . Members and agents of the Commission shall have the right to
enter and inspect the premises at all reasonable times to
evaluate compliance with the conditions in this Order. The
Commission may require the applicant to submit additional
V data or information necessary for the Commission to conduct
that evaluation.
3 . Upon completion of the project, the applicant shall submit,
with the request for a Certification of Compliance, an
affidavit, prepared by a professional engineer or land
/ surveyor registered in the Commonwealth of Massachusetts,
stating that the site has been developed, in accordance with
the requirements of this Order of Conditions, the referenced
site plan and supporting documents.
4 . This Order shall apply to every successor in control or
successor in interest of the property described in the
Notice of Intent and accompanying plans or part thereof. In
the event this land or any part thereof changes ownership
before or during construction, the current owner shall
notify the new owner, by registered mail, of this Order
prior to the transfer of ownership and shall forward proof
of this notification to the Commission.
5. Notice shall be given this Commission no more than 2 weeks
nor less than 2 days prior to the commencement of
construction activities. Said notice shall include, in
writing, the name(s) , address(es) , and business and home
telephone numbers of the project supervisor(s) responsible
171 for insuring that operations are conducted in compliance
with this Order.
6. A copy of the plan, and the Order of Conditions with any
Special Conditions will be retained on site throughout the
project.
7 . A haybale barrier will be constructed such that the arc
sweeps in the east from the end of the driveway curbing on
lot 29 north along the lot line to the proposed 18 foot
elevation. The haybale configuration will then turn west
following the 18 foot contour line and end at the paved
portion of Louis Street as reflected on the revised plan
dated February 10, 1994.
8 . Additional erosion and sedimentation control measures deemed
/ necessary by the Commission shall be instituted by the
Japplicant. Any siltation caused onto any resource area
shall be promptly reported to the Commission and shall be
restored to the satisfaction of the Commission.
9. No excavated material shall be placed on the northern side
of the foundation footprint between the foundation and the
r haybale barrier reflected on the revised plan dated February
10, 1994 . Any stockpile material shall be placed outside
the Buffer Zone.
10. Prior to commencement of any pre-construction activity, the
applicant will contact the Salem Clerk of the Works who will
�1/view the constructed haybale barrier to ensure that its
placement and construction are consistent with good erosion
and sedimentation control practice. No preconstruction
activity will commence until any alterations recommended by
the Clerk of the Works have been completed and the Clerk of
the Works has confirmed, by an on site view, that the
structure is acceptable.
11. A copy of the revised plan dated February 10, 1994 , the
Order of Conditions, and Special Conditions will be retained

Please be advised that this office represents Marie DeCotis of 21 Bay View Circle,
Salem, Massachusetts.
Pursuant to the provisions of General Laws Chapter 40A and the provisions of the
Salem Zoning Ordinance, I hereby request on behalf of my said client that you revoke the
above referenced permit to build (#78-94) issued on March 24, 1994 on the grounds that the
subject lot does not constitute a building lot within the meaning of the same under the Salem
Zoning Ordinance and no special permit or variance from the application of the provisions of
the Salem Zoning Ordinance has been granted by the Salem Board of Appeals.
The subject lot is not a so-called"grandfathered"lot under the provisions of§8-2(1)nor
under the provisions of§8-2(2) as the subject lot has been held in common ownership with
premises known as #20 and #18 Bay View Circle for longer than the statutory exception.

In order to understand the nature of the common ownership, it is important to
understand the actual usage of the premises located at 18-20 Bay View Circle.
For many years there has been a dwelling located at #20 Bay View Circle. That
dwelling has been in existence not only on the lot represented by#20 Bay View Circle, but has
also extended to the parcel known as 18 Bay View Circle. The subject lots are more particularly
described and shown on a plan entitled"Land of Ernest R.Belleau and Arthur L.Chase,Larch
Ave., Salem, Mass., Scale 1" = 40' October 1959" Edwin T. Brudzynski, Registered Land
Surveyor which plan is recorded in Plan Book 93,Plan 18 at the Essex South District Registry
of Deeds. The subject lot for which your recent building permit was issued is shown as Lot 28.
The premises comprising 18-20 Bay View Circle is comprised of Lots 29 and 30 as shown on
the aforesaid plan. A copy of that plan is enclosed.
Legal title to the three(3)parcels has been broken up in a checkerboard system between
individuals and a corporation of which the individuals were the principals so that Lots 28 and
30 were held for substantial periods of time by the same individuals and Lot 29 was held by a
separate entity. Notwithstanding the separate legal title, the use of Lots 29 and 30 has been as
a single lot for purposes of zoning in that the single family structure on the premises on 18-20
Bay View Circle and its accessory structures overlap the purported boundary between Lots 29
and 30. In light of the fact that Lots 29 and 30 have been used as a single parcel for zoning
purposes, it is unreasonable to interpret the ownership of Lot 28 as not being in common
ownership with the contiguous parcel. Further, as recently as June 5, 1968, a decision on an
appeal of Mary Christine Sowinski to install a swimming pool at 20 Bay View Circle was
issued. The swimming pool that was authorized by that decision is situated on Lot 30. There
is no question that Lots 29 and 30 have been used as a single lot for zoning purposes. The
existing structures on Lots 29 and 30 are wholly integrated in that the dwelling which is
principally located on Lot 29 encroaches several feet onto Lot 30 where it is directly connected
to a wood and concrete deck surrounding an inground swimming pool.
Title to Lots 28 and 30 stood in the name of Richbar Realty Corporation from
November 18, 1966 (see deed recorded in Book 5408, Page 559-562, copy enclosed) until the
premises was conveyed by said corporation to Richard Sowinski, et al in 1988 (see deed
recorded in Book 9838,Page 592,copy enclosed). Title to Lot 29 has been held by Stephen T.
and Mary C. Sowinski since April 22, 1963 (see deed recorded in Book 5053, Page 209, copy
enclosed).

Itis also clear that the subject lot does not satisfy the present requirements for a building
lot under the Article VI of the Zoning Ordinance.
Accordingly, on behalf of my said client, I hereby request that you enforce the Zoning
Ordinance and revoke the said building permit.
