Gentlemen:
I have reviewed the preliminary subdivision plans submitted by JohnIngeini and
offer the following comments:
1. No profiles have been provided for the sewer and drain lines.
These must be submitted for review.
2. No details on the proposed sewage lift station have been provided.
A complete set of construction drawings as well as design computations
must be submitted for review.
3. Drainage computations must be submitted for review.
4. The 10% slopes proposed for the roadways are excessive. The maximum
desirable slope should not exceed 6%.
5. Although the main entrance is off of Highland Avenue, there will be
considerable additional traffic on Barnes Road.' Barnes Road is in all
likelyhood unable to handle this increase in traffic.

Dear Mr. O 'Brien :
Reference is made to your inquiry concern-
ing Lots 268,269 , and 270 on Barnes Road in Salem as
shown on Plan No. 7159-B (Sheet 2) of the Land Court
records as to this registered land. I am informed that
the present owners , James A. and Gladys E. Lindsey,
have owned the three lots since 1949 and that a house
and garage are located on Lot 268. The present owners
desire to sell Lot 269 to a new owner, and a house
would then be constructed on Lot 269 if it is proper
to do so within the requirements of the Salem zoning
ordinance .
Lot #269 has a frontage of 50 feet on Barnes
Road and is 100 feet deep for a total square footage
of 5000 square feet . The property is in an R-1 zonin
district . Table 1 of Section VI (Density Regulations
of the zoning ordinance fixes a minimum lot area (sq.ft . )
in an R-1 zone at 7000 square feet with a minimum lot
width of 60 feet . Lot #269. therefore , does not comply
with the zoning ordinance . It is a non-conforming lot .
This particular lot is the middle lot of three lots
having a continuous frontage on Barnes Road, all of
which lots are held under common ownership. This situa-
tion is explicitly covered by Section VIII (Non Conform-
ing Lot) as follows :
" If two or more lots , or combinations of lots
and portions of lots , with continuous frontage in
single ownership are of record for more than five
(5) years at the time of adoption of this ordinance ,
and if all or part of the lots do not meet the
requirements for lot width and area as estab-
lished by this ordinance , the lands involved
shall be considered to be an undivided parcel
for the purpose of this ordinance , and no por-
tion of said parcel shall be used or sold
which does not meet lot width and area require-
ments established by this ordinance , nor shall
any division of the parcel be made which leaves
remaining any lot width or area below the
requirements stated in this ordinance.
The foregoing portion of the ordinance is controll-
ing, and is prohibitive of the use of Lot #269 for
building purposes.
