Sec. 26-160. Permit required.
No person shall move a building in a public street or way
unless he has been granted a permit from the inspector of

buildings which shall be subject to approval of the city
council. Such permission shall be granted upon such terms
as the inspector of buildings and the city council may
require in the interest of public safety and in accordance
with the Code. (Code 1952, Ch. 28, § 49; Ord. of 9-11-80, § 5)
Sec. 26-161. Permit application; information to be
shown.
All applications for the permit required by this article
shall be made to the inspector of buildings, and shall state
the location from and that to which the building is to be
moved, its length, width, and height, and the principal
material of which it is constructed, and shall definitely
describe the route over which it is to be moved,the length of
time required to move it, and whether any shade trees or
branches thereof will have to be removed, and, if any, the
location of such trees or branches. (Code 1952, Ch. 28, § 50;
Ord. of 9-11-80, § 6)
Sec. 26-162. Plot plan and consents to accompany
application.
All applications referred to in section 26-161 shall be
accompanied by a plot plan bearing the stamp of a
registered land surveyor showing the placement of the
building in the new location and attesting that said location
is in conformance with the applicable sections of the zoning
ordinance and shall also be accompanied by the written
consent of the director of public services approving the
described route and such consent of utilities as may be _.
required by the inspector of buildings. (Ord. of 9-11-$0, § 7)

Sec. 26-164. Bond required; amount; condition, eta
No person shall move a building in a public street or way
until he has given a bond to the city, in the sum of twenty-

five thousand dollars ($25,000.00), with two (2) or more
sureties, one (1) of whom shall be the owner of the building,
and a twenty-five thousand dollar ($25,000.00) public prop-
erty damage insurance for each accident, conditioned to save
harmless and indemnify the city from all damages which may
occur by such moving. Such bond shall be approved by the
superintendent of streets and be filed with the city clerk be-
fore the permit is issued. (1968 Supp., Ch. 28, § 53)

Whenever it appears that the moving of a building, under
the provisions of this article, will encumber the tracks of any
railroad corporation, a public hearing shall be given by the
city cuuncil upon the subject, before a permit is granted.

All moving contemplated by this article shall be done under
the direction of the superintendent of streets. (Code 1952,
Ch. 28, § 55)
Sec. 26-167. Removal, cutting of shade trees, electrical wires.
No person moving a building regulated by this article shall
cut, trim or remove any shade tree in a street, except by writ-
ten permission of the superintendent of shade trees, and in
the case of removal until after a public hearing as provided
by law, nor cut, or interfere with any wire running in, through
or over any street, except by permission of the city electrician.

Chamber on Thursday, October 9 , 1997, the Council voted to grant
you permission to move a Wood Frame house located at 42 Crowdis
Street to 26 Barnes Circle.
A Bond in the amount of $25,000 with two sureties 1 . Owner
of the Building, and 2 . Public Property Damage, must be filed
with the City Clerk.
Also a permit fee of $100 . 00 must be paid at the City Clerk's

A hearing on this petition was held August 16, 1989 with the following Board
Members present: James Fleming, Chairman; Messrs. , Febonio, Luzinski, .Jutting
and Labrecque. Notice of the hearing was sent to abutters and others and notices
of the hearing were properly published in the Salem Evening News in accordance
with Massachusetts General Laws Chapter 40A.
The petitioner, represented by Attorney Robert Ledoux, is seeking variances for
three of four lots on a proposed subdivision which do not meet the required area
and for one lot which does not meet frontage requirements. The lots are also
identified on Assessors Map 3 as lots 81 , 82, 85 and 86. The locus of the
property is in an R-1 district.
The variances which have been requested may be granted upon a fineing of the
Board that:
a. special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings and structures in the same district;
It. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
C. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent 01'
the district or the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented. .ind
.after viewing the plans, makes the following findings of fact:
t . Several abutters, as well as other residents of the immediate area, spoke in
opposition to the petition, citing the addition of traffic to heavily
traveled adjacent streets, blasing problems, and changes in the drainage
patterns in the area.
2. The locus could be developed by the petition if the lots were joined.
On the basis of the above findings of fact, and on the evidence presented, -he
Board of Appeal concludes as follows:
1 . Special conditions do not exist which especially affect the subject property
and not the district generally;
Literal enforcement of the provisions of the Zoning Ordinance would not
involve substantial hardship to the petitioner;
3. The relief requested cannot be granted without substantial detriment to the
public good or without nullifying and substantially derogating from the intent
of the district or the purpose of the Ordinance.

Therefore, after a motion to grant the requested variances, with conditions,
was made and duly seconded, the Zoning Board of Appeal vote 0-5 against granting
the requested variances. The petitioner failed to receive four (4) affirmative
votes and, therefore, the variances are denied.
