A hearing on this petition was held October 26, 1988 with the following Board
Members present: James Fleming, Chairman; Messrs. , Bencal, Nutting, Luzinski
and Associate Member LaBrecque. Notice of the hearing was sent to abutters and
others and notices of the hearing were properly published in the Salem Evening
News in accordance with Massachusetts General Laws Chapter 40A.
The petitioner, owner of the property, is seeking a Variance from setback
requirements to allow for the construction of a garage 31 feet from the southerly
boundary line of the property. The property is located in an R-1 district.
The Variance which has been requested may be granted upon a finding of the
Board that:
a. special conditions and circumstances exist which especially affect the land,
building or structure involved and which are not generally affecting other
lands, buildings and structures in the same district;
b. literal enforcement of the provisions of the Zoning Ordinance would involve
substantial hardship, financial or otherwise, to the petitioner;
c. desirable relief may be granted without substantial detriment to the public
good and without nullifying or substantially derogating from the intent of
the district of the purpose of the Ordinance.
The Board of Appeal, after careful consideration of the evidence presented and
after viewing the plans, amkes the following findings of fact:
1 . There was no opposition.
2. Several neighbors and Councillor O'Leary spoke in favor of the petitioner.
On the basis of the above findings of fact, and on the evidence presented at the
hearing, the Board of Appeal concludes as follows:
1 . Special conditions exist which especially affect the subject property
but not the district generally;
2. Literal enforcement of the provisions of the ordinance would work a
substantial hardship on the petitioner;
3. The relief requested can be granted without subtantial detriment to the
public good and without nullifying or substantially derogating from the intent
of the district or the purposes of the Ordinance.

Building Inspector;
3. The garage be built as per the plans and dimensions submitted to
the Board of appeal;

Preliminary subdivision plans have been received from Carter 6
Towers Engineering Corp . , on March 21 , 1983 , for our review. These
plans• are dated Sept . 27 , 1982 .
As a result of my review of said plans the following items shall be
noted :
I . It shall be noted that hydrant locations as shown on the plan ,
dated Sept . 27 , 1982 ; have not been approved by the Salem
Fire Department .
2 . This plan was apparently drawn without any prior consultation
with this office . Hydrant locations are to be placed on the
plan as per the following listed locations . Ref : Mass . State
Bldg . Code Section 1200 . 1 . 1 ('1 ) b (2) .
3 . It shall also be noted that hydrants located at ends of water
mains , on cul -de-sacs ; while ideal for use as blow offs , are
not considered of value for fire fighting purposes. These
hydrants , while useable , are beyond the structures to be protected ,
and are not considered for normal use under normal firefighting
tactics . This does not preclude the use of hydrants at these
locations for compliance with the engineering requirements for
blow off purposes .
4 . Approval of hydrants will require installation at locations
as follows :
a . Barcelona Ave . at Lot lines of lots #27 and #28 . (This location
has been used because of the long distance from the last
existing hydrant on Barcelona Ave .
b . On Barcelona Ave . at B Street , on curb line of Lot #38 and
no more than ten feet from the corner point .
c . On Barcelona Ave . at C Street , on curb line of Lot #44 ,
and no more than ten feet from corner po'int .
d . Hydrant at Barcelona Ave . and A Street , at curb line of
of Lot # 63 , is satisfactory .

street names be eleminated . These designations are usually unacceptri
able to residents and a request for a name changeils usually
presented by the residents shortly after purchase of real estate .
These names should be presented for approval now , as prior
street designations have been submitted which were duplicates ,
and this creates havoc for the public safety forces .
7 . Two locations should be determined for City connected street
fire alarm boxes . These locations shall be stipulated and shown
on the plan prior to our approval . Locations for these fire
alarm boxes , shall be obtained from the Salem City Electrician
Mr . John Condon .

FIRE DEPARTMENT CERTFICATE OF APPROVAL FOR BUILDING PERMIT
In compliance with provisions of Section 113.5 of the Mass. State
Building Code; and under guidelines agreed upon by the Salem Bldg.
Inspector and the Salem Fire Chief; the applicant for a building
permit, shall obtain the Certificate of Approval (see reverse side)
and stamped plan approval from the Salem Fire Prevention Bureau.
Said application and approval is required before a building permit
may be issued. The Mass. State Building Code requires compliance
approval of the Salem Fire Department, with reference to provisions
of Article #4 and Article #12 of the Building Code, the Salem Fire
Code, Mass. General Laws and Mass. Fire Prevention Regulations.
The applicant shall submit this application with three (3 ) sets of
plans, drawn in sufficient clarity and detail, to obtain stamped
approval of the Salem Fire Department. This applies for all new
construction; substantial alterations; change of use and/or occupancy;
j and any other approvals required by the Mass. General Laws and the
Fire Codes.
Exception: Plans will not be required for structural work, when the
proposed work to be performed under the building permit,
will not; in the opinion of the Building Inspector, require
a plan to show the nature and character of the work to
be performed.
NOTICE: Plans are normally required for fire supression systems; fire
alarm systems; tank installations; and fire code requirements.
NOTICE: Under provisions of Article #22, of the Mass. State Bldg. Code;
certain proposed projects may not require submission of plans,
nor complete compliance with new construction requirements. In
these cases, provisions of Article #22, Appendix T, and Tables
applicable shall apply. This section shall not however, super-
sede the provisions outlined in Salem Fire Prevention Bureau
Regulations; Chapter 148, M.G.L. ; or the Mass. Fire Prevention
Regulations. i.e. all permits for fire code use and/or occupancy
shall apply for the entire structure; fire alarm and/or smoke
detector installation, shall apply to the entire structure, based

existing structure may comply with regulations applicable for
existing structures.
C1 NOTICE: Sub-contractors may also be required to file individual appli-
cations for a fire department certificate of approval, covering
their area of work. Said sub-contractors shall file for Fire

RULES AND GUIDELINES FOR INSTALLATION OF AUTOMATIC FIRE WARNING DEVICES, FOR USE IN
RESIDENTIAL STRUCTURES: APPLICABLE FOR NEW CONSTRUCTION, FOR SUBSTANTIALLY ALTERED
STRUCTURES, ( INCLUDING CREATION OF ADDITIONAL LIVING UNITS) , AND CONDOMINIUM
CONVERSIONS.
Under authority granted by the General Laws of the Commonwealth of Massachusetts,
Chapter 148, Section 28, and the Mass. State Building Code, the following rules and
guidelines are established for the installation of automatic fire warning devices,
acceptable to the Head of the Salem Fire Department, which shall be enforced by the
Salem Fire Prevention Bureau.
1 . Definitions:
A. Use Groups R-1 , R-2, R-3 and R-4: As defined in Mass . State Bldg. Code Sec.209.0
B. Approved Smoke Detector: An approved automatic device which detects visible or
invisible products of combustion. Approved smoke detectors must be activated
.by a permanently wired source of alternating current electric power, or by a
direct current source of electric power from an approved panel .
C. Heat Detector: An approved device which detects abnormally high temperatures or
increased rate of temperature rise or a combination of both.
D. Common Hallway: A common corridor or space separately enclosed, which provides
common access to the required exitways of the structure.
E. Separate Sleeping Area: Shall mean the area or areas of a dwelling unit, in which
the bedrooms or sleeping rooms are located. Bedrooms or sleeping rooms, separated
by other use areas, such as kitchens, or living rooms, but not bathrooms; shall
be considered as separate sleeping areas.
F. Other Common Space: Any area which contains over one hundred square feet in area,
and because of its character and use, would require fire detection devices to
to adequately provide an early warning of fire, within said area.
G. Occupancy Classification:
T. Classification #1 : All occupancies which contain one or two dwelling units.
2. Classification #2: All occupancies which contain three to six dwelling units.
3. Classification #3: All occupancies which contain seven to twelve dwelling units.
4. Classification #4: All occupancies which contain thirteen to twenty-four
dwelling units.
5• Classification #5: All occupancies which contain twenty-five or more dwelling units
2. Intent of Rules and Guidelines:
A. It is the intent of this rule to provide basic protection from products of combustion
or excessive heat build-up, in redidential occupancies, which may occur at any time _
and would become a probable threat to life safety.
B. It is the intent of these rules to provide guidelines , under provisions of
Article #12 of the Mass . State Building Code, for installation of approved auto-
matic fire alarm devices and/or related equipment, consistant with recognized
good practice, for the safeguarding, to a reasonable degree, of life and
property from the hazards of fire, in the early stages.

3. Levels of Protection and Location of Devices:
A. Classification #1 : One and Two Family Dwelling Units and Condominium Units.
1 . Refer to Mass. State Building Code, Sections 1216.3.2.2 and 1216.3.2.3(3).
B. Classification #2. Three to Six Dwelling Units.
1 . Refer to Mass. State Building Code, Table 1216, Sections]216.3.2. 1 ; 1216.3.2.1 .3(2)
1216.3.2.8 and 1217.0
C . Classification #3= Seven to Twelve Dwelling Units.
1 . Refer to Mass. State Building Code, Table 1216, Sections 1216.3.2.1 ;
1216.3.2.3(2) ; 1216.3.2.4; 1216.3.2.5; 1216.3.2.8 and 1217.0
D. Classification #4: Thirteen to Twenty-four Units .
1 . Refer to Mass. State Building Code, Table 1216; Sections 1216.3.2.1 ;
1216.3.2.3(1) ; 1216.3.2.4; 1216.3.2.5; 1216.3.2.7; 1216.3.2.8; and 1217.0
E. Classification #5: Twenty-five or more Dwelling Units.

4. Requirements:
A. Refer to Mass. State Building Code, Sections 1216.9; 1216.9.1; 1216.9.2; and
1216.9.3
B. All fire alarm systems and devices shall require an electrical permitkto be
obtained from the Salem City Elctrical Dept, and a Fire Department Permit to Install .
C. The type of wiring and all connections shall be approved by the City Electrician.
D. A Master Fire Alarm Box where required, shall be installed on the exterior
of the structure or as directed by the Salem City Electrician. A blank door
may be specified for use in most occupancies, and shall be determined before
writing specifications. The coded box designation will be provided by the
Salem City Electrician and should be obtained when filing plans.
E. A Square D #9001KSIIK3 silence alarm switch shall be required and shall be
located at the remote annunciator, which shall be located in the front entry
at a location approved by the fire official . A trouble buzzer shall be located
at the annunciator in the front entry, which shall sound when the silence alarm
switch is activated.
F. No Battery- type detection units are permitted in new construction, substantially
altered structures, condominium conversions, and/or change of use group occupancies.
5. Application and Permit:
A. An application shall be made by the licensed electrician or installer, on
Fire Department Form #81F, prior .to starting any work on fire alarm systems or
fire protection devices.
B. A fee of $10.00 shall be submitted with each application.
C. Sufficient sets of plans, preferably three sets, shall be submitted for review
of the Fire Official , in such clarity and detail so as to enable the fire official
to properly analize the intended installation.
D. The Fire Official shall have up to ten (10) working days to review any plans,
which are submitted for approval , per Section 113.5 of the Mass. State Bldg. Code.
E. When plans are stamped approved, the applicant shall arrange to. pick up two sets,
with a permit to install the devices as approved. In the event the plans are not
approved, a letter will be sent to the applicant, explaining any deficiencies.
6. Zoning:
A. All zoning shall be customized by floor of protection, based also on additional
zones being provided for distinct building separations, over two-hundred feet
of travel on any floor, -sprinkler and standpipe layouts and *any use of other
fire alarm devices, such as manual local fire alarm pull stations. :All Zones
must be approved prior to installation and plan approval .
,B. The Zone plates on the annunciator shall be attached with rivits or one way screws-,
to prevent tampering with same.

7. Final Approval and Inspection:
A. Upon completion of the installation, the licensed electrician/installer, shall
request a final inspection and test.
B. The Salem City Electrician shall be notified also to inspect all electrical
portions of the system.
C . The installer shall have tested the entire installation, prior to requesting
the final test for approval and acceptance.
D. The installation shall have been installed according to the stamped approved plans.
E. The final inspection will be done by appointment only. Make all appointments
at least 72 hours in advance. The licensed electrician/installer must be
present for the test and inspection. The installer is also responsible for
providing any other needed employees, for re-seting of systems and testing of
devices. All appointments are subject to cancellation due to a fire emergency.
F. Upon completion of a satisfactory testing of the fire alarm devices and systems,
the installer shall sign a Certificate of Completion (Form #82) provided by
the Salem Fire Official . The Fire Official will then issue the Certificate of
Compliance and will sign the Certificate of Occupancy, if all other required
work meets with his approval .
8. Maintenance:
A. A maintenance program shall be established by the owner of record.
B. A written maintenance report shall be filed with the Salem City Electrician,
on a form provided by that office, for assurance that the system is in sound
operating condition. Said report shall be filed at least annually.
C . Failure to provide the reports of condition of a fire alarm system as required,
shall constitute a violation of the fire code and such furthur action as the
law permits, shall be taken.
9. The owner of record is required under provisions of the Mass . State Building Code
to obtain a Certificate of Occupancy, prior to Use and Occupancy of any part of
any structure. The Certificate of Occupancy shall be obtained from the Salem
Building Inspector.

You have requested City Solicitor Michael E. O'Brien for an
opinion relating to the validity of a variance granted on June 6 ,
1979.:: by the Salem Board of Appeal for the above referenced lot.
City Solicitor Michael E . O'Brien has asked me to respond to your
request.
The variance granted provided for the combining of three under-
sized lots into two undersized buildable lots. It is my understand-
ing that a house has been erected already on one lot and this opinion
is directed to the remaining lot.
It is further my understanding within a year of the granting of
the variance , the original petitioners petitioned the Planning Board
for an endorsement of a plan of the two (2) lots as not constituting
a subdivision within the meaning of the Subdivision Control Law. The
plan was so endorsed and the lot in question was conveyed out by the
original petitioners all within one year of the granting of the ori-
ginal variance. Said deed out was subsequently registered by the Trial
Court of the Commonwealth of Massachusetts, Land Court Department (Case
No. 11802), as evidenced by Certificate of Title 49105 of the Essex County
Registry of Deeds.

A hearing; on this petition was held on Tuesday, June 6, 1975, with the following
members of the Board present: Jane Lundregan, Donald Eames, Douglas Hopper and James
Boulger. Notices were sent to abutters and others in accordance with Mass. General
Laws, Chapter SOS. The notice of hearing was duly published in the Salem Evening News
advising the public of said hearing.
The Petitioner represented himself before the Board. They presently own three
lots each with a 50 ft. frontage and they wish to combine the three lots into two
lots; each having a 75 ft. frontage. -
The lots were purchased a number of years ago and at that time the lots were con-
sidered buildable lots. They are not now buildable lots and therefore it is desired
to combine the three lots into two lots making them larger than they previously were.
The Board voted unanimously to grant the petition requested. The Board found
that by combining the three lots into two lots would be within the intent of the Salem
Zoning ordinance. Most of the lots in that area are undersized and it would be a hard-
ship to the . Petitioner to deny the use of the two lots.
