Dear Mr, Blenkhorn:
The following responses are based on the November 5, 1986 Health
Department "Recommended Comments" on our Ledgemere Country II Phase II
site plan, which I received from you at last night's Board of Health
Meeting. As I said last night, we plan to continue following the Board's
requirements, prepared under our Phase I review and described in my letter
to you dated'March 17, 1986, throughout all four phases.
1. Approvals from the City Engineering Department and City Plumbing
Inspector will be obtained for all utility tie-in designs;
1A. The drinking water system is a closed loop system designed to prevent
any negative pressure situations.
2. Water services will be tested for pressure, and bacterial testing
will be done through a certified laboratory as requested, with copies
of these reports forwarded to the Planning and Health Departments;
3. All building construction spoils are to be gathered in on-site
dumpsters and hauled away to an authorized landfill, as has been done
to date with our associated Salem projects. Suitable vegetative
debris will be mixed in with loam, allowed to decompose on site for
two years, and then screened for loam, which will be used in project
landscaping.
The composting pile(s) will be stored at a distance from the
residential units to discourage residential dumping on these pile
sites. Lime will be added to the compost piles to increase pH and
help decrease the decomposition period. The Condominium
Association's property management company will maintain and conduct a
surveillance program of these sites. A pest control program under a
licensed firm will be instituted for these sites if necessary;
4. Dust control and street cleaning will be handled with the on-site
5000 gallon water tanker and with a sweeper that is contracted as
needed;
5. Northeast Exterminators of Essex, Massachusetts continues to handle
our pest control program for all our Salem project sites. The bait
station location plans (156 stations) and November 17, 1986 statement
of work performed from March 1986 to present was given to you at last
night's Board meeting.
6. Final grading continues to be done so as to prevent stagnant matter,
water, or growth which would create offensive conditions and/or
odors.
7. All backfilling follows good engineering practices to prevent future
underground utility damage;
8. We submit the following trash storage and disposal plan (approved for
Phase I) with the following conditions:
A. The private homeowners, through their Condominium Association,
will pay for the collection and disposal of their trash by a
private contractor;
B. It is in these homeowners' self-interest to ensure timely,
sanitary, and adequate trash removal from their dwellings at a
pre-scheduled time;
C. It is expected that less trash per unit will be generated by
these two-bedroom residences than by typical single family
residences;
D. The containers or bundles of household trash and garden and lawn
waste will be placed at the outer edge of the sidewalk
appurtenant to the premises of the owner no earlier than 6:00
p.m. the day preceding collection and no later than 7:00 a.m. the
day of collection and will be removed from the residential
development on the designated day of collection. The Condominium
Association and its private trash removal contractor will be
responsible for the proper removal and disposal of said trash to
an approved off-site location.
E. Should conditions warrant, the Condominium Association would
increase the number of pickups per week.
9. The maintenance and cleaning of catchbasins associated with private
ways will be the responsibility of the Condominium Association. It
will hire a maintenance firm to keep up all the common areas,
including the catchbains. The Fafard Companies will be responsible
for the Whaler's Lane catchbasins until the road is accepted as a
city street.
10. The site is and will be maintained by construction workers and by
maintenance personnel hired by the Condominium Association in a
manner to prevent undue air or noise 'pollution.

toilets at your project on Highland Avenue in Salem are not being
maintained in a clean and sanitary manner.
In accordance with Chapter I1 of the State Sanitary Code, 105 CMR
410.152, you are hereby ordered to take immediate corrective
measures to correct this situation and maintain said units in a
clean and sanitary manner at all times.
We request that the firm that supplies these units submits to this
department, in writing, their policy for cleaning and sanitizing
these units,-removal and replacement and notify us of the length
of time the units will be on site.

have had up to and including today. This letter meets all of your Board's require-
ments, as we have discussed.

We have been contracted by Fafard, Inc. to provide a
perimeter rodent control safety barrier for their Highland
Avenue , Swampscott Road project. By surrounding this
construction site with bait stations we will prevent the
influx of any rodents displaced by construction, blasting,
etc. The rodenticide used by us is a 2nd generation anti-
coagulent TALON - G - EPA # 10182-41. See attached map
for station locations.
Unfortuantely, we are experiencing a massive rodent
population explosion in the Northeast. This is mainly due
to the rodents build-up of an immunity to lst generation
anti-coagulents containing Coumarin-Warfarin. Long-time
standbys such as Decon, etc. are just a food-source now and
not a control measure. The populations in the Massachusetts
area have increased 10 times in the last year and Salem
with its marine environment is a prime example of this
explosion. Please contact the Massachusetts Pesticide Board,
Department of Agriculture, Saltonstall Building, Boston,
Massachusetts for confirmation.
Please feel free to call us with any questions regarding
our work for Fafard, Inc. and please keep in mind that rats
are an urban creature, not a woodland inhabitant. They are
active in populated areas and supported by poor sanitation
and disposal practices.

At the Board of Health Meeting on March 11, 1986 discussion took place concerning
the letter sent to the Planning Department pertaining to Phase I of Ledgemere
Country II (see enclosed) . The Board of Health at this time would like to make
several clarifications.
- The letter from this department is incorrectly dated February 6, 1986. The
correct date is March 6, 1986.
- The letter from this department is in response to the March 4, 1986 letter
from Ronald Killian of Fafard (see enclosed) .
- Concerning Item 2 the Board of Health would like to add that the bacteria
testing be done by a certified laboratory.
- Concerning Item 7 of the March 4, 1986 Fafard letter the Board of Health requests
that the opening statement be changed to read: "We submit the following trash
storage and disposal plan with the following conditions:".
- Item 7 ii - the Board of Health requests the following be added to the end of the
statement: ". . . from their dwellings at a pre-scheduled time for collection and
disposal by the private contractor. ".
- In lieu of Item 7 A,B,C,D of the Trash Disposal Plan the Board of Health requests
the following: "The containers or bundles of trash be placed at the outer edge
of the sidewalk appurtenant to the premises of the owner not later than 7:00 AM
on the day of collection and not before 6:00 PM on the day preceding collection
and shall be removed from the sidewalk on the same day as emptied".
"It is the responsibility of the private firm to pick-up the residents trash at
each dwelling and incur all responsibility for proper removal and disposal off-
site at an approved location".

Dear Mr. Blenkhorn:
Our following responses refer to the comments in your February 18,
1986 letter to Dale Yale, Salem Planning Department.
1 . Approvals from the City Engineering Department and City Plumbing
Inspector will be obtained for all utility tie-in designs.
2. We will test the water services for pressure and bacteria as
required.
3. All building construction spoils are to be gathered in on-site
dumpsters and hauled away to an authorized landfill , as has been
done to date with our associated Salem projects. Suitable
vegetative debris will be mixed in with loam, allowed to
decompose on site for two years, and then screened for loam,
which will be used in project landscaping.
4 . Dust control and street cleaning will be handled with the on-site
5000 gallon water tanker and with a sweeper that is contracted as
needed.
5. The maintenance and cleaning of catchbasins associated with
private ways will be the responsibility of the Condominium
Association. It will hire a maintenance firm to keep up all the
common areas, including the catchbasins. The Fafard Companies
will be repsonsible for the Whaler's Lane catchbasins until the
road is accepted as a city street.
6. Northeast Exterminators of Essex is handling our pest control
program. Enclosed is Russell Henderson's report, which addresses
the Health Department's concerns.
The Animal Rescue League of Boston wildlife report of February
28, 1986 also is enclosed.
7. We submit the following trash disposal plan with the following
assumptions:
i . The private homeowners, through their Condominium
Association, will pay for the private collection and
disposal of their trash;
ii . It is in these homeowners' self-interest to ensure timely,
sanitary, and adequate trash removal ;
iii . Less trash per unit is expected to be generated since these
two-bedroom residences will contain fewer residents
. (especially children) per unit than the typical single
family Salem residence.
Trash Disposal Plan:
A. Homeowners will carry their trash to designated pickup sites
located conveniently throughout the development (see Plan
Sheet 10 of 14) .
B. Trash will be packaged in Board of Health-approved
containers (eg. heavy duty plastic garbage bags) .
C. Designated sites will be chain-link fence-enclosed areas ,
screened by five-to-seven-foot high arborvitae. Dimensions
will be, 10' x 10' x 5' high.
D. Trash will be delivered by the homeowners to these
collection areas from 7-9 a.m. the morning of the designated
weekly pickup. The private contractor will begin pickup at
9:00 a.m. that morning and transport the collected trash
directly to the city transfer station.
E. Should conditions warrant, the Condominium Association would
increase the number of pickups per week.

OF THE CITY OF SALEM
DECISION
This decision is rendered upon an application for a special permit for a
planned unit development pursuant to Section VII-O of the Zoning Ordinance of the
City of Salem (the "Ordinance"). The application was submitted on April 23, 1985,
by The Fafard Companies, which include Howard A. Fafard, Ledgemere
Condominium Corporation, and Ledgemere Land Corporation,(collectively,
"Fafard") together with a site plan entitled "Ledgemere Country II-Planned Unit
Development", by William McDonough, P.E., February 1, 1985, Revised 6-2445, 7-
18-85, 10-1-85, December, 1985 and an Environmental Impact Statement as
required by Section VII-O 4 of Ordinance.
The Board, within seven days after receipt of the application transmitted a
copy of the application and the plan to the Inspector of Buildings, the City
Engineer, the Board of Health and the Conservation Commission. Notice of the
filing of the application was also given to the City Clerk, Fire Department, Police
Department, Superintendent of Streets and the.School Department.
Notice of Public Hearing by the Board on-this application was duly published
in the Salem News on May 1, 1985 and May 8, 1985 and duly mailed to all persons
entitled thereto by law.
A public hearing on the application was held in accordance with such notice
at 7:30 p.m. on May 16, 1985, in the second floor hearing room at One Salem Green
in Salem. The following members of the Board were present at the hearing:

Officers on the dates set forth below:

The Board has made a thorough study of and has given full consideration to,
all documents, plans and other materials submitted by Fafard; the reports, written
or otherwise, of the Inspector Buildings; the City Engineer; the Board of Health and
the Conservation Commission and all statements made and other materials
submitted at the Public Hearing and at other public meetings of the Board at which
the Application was discussed. The Board is satisfied that such data is sufficient to
meet the requirements of Section VII-O of the Ordinance.
Accordingly, the Board has unanimously voted to grant a Special Permit for a
Planned Unit Development for construction and use of no more than 520 residential
condominium units pursuant to Fafard's Application upon and in accordance with
the provisions, conditions and procedures set forth below:
I. Based upon the written materials submitted to the Board as well as oral
communications received at the Public Hearing and other public
meetings of the Board, the Board makes the following findings:
A. h
T e Planned Unit Development has been designed with various types of i
land uses which can be combined in a compatible relationship with each
other as a totally planned development.
B. The design of the Planned Unit Development is compatible with the
existing or potential development of the surrounding neighborhoods.
C. A plan for the total property has been submitted to the Board which
clearly details the manner in which the subject area is to be developed
and the means that will be employed to protect the abutting property
and the health, safety, welfare and privacy enjoyed thereon in
accordance with the requirements of Section VII-O 3.b of the
Ordinance.
D. Section VII-O 3.d of the Ordinance does not apply to the Planned Unit
Development as it is not located adjacent to or across the street from
existing residential developments.
E. The Planned Unit Development is in harmony with the purpose and
intent of the Ordinance and the Master Plan of the City of Salem and
will promote the purposes of Section VII-O of the Ordinance as set forth
in Subsection 2 thereof.
F. The Planned Unit Development will not result in a net negative
environmental impact.
H. The parcel containing the Planned Unit Development contains more
than sixty thousand (60,000) square feet.
Il. The Special Permit and the exercise of the rights granted hereunder shall be subject
to the following conditions:
A. Traffic
1. Following the comprehensive traffic study to be undertaken by the
City to determine the traffic needs of Swampscott Road, an
easement, to be defined by the Planning Board, shall be granted for
the widening of Swampsscott Road along the southerly side of the
developer's property to allow for an increase in roadway capacity.
Such easement shall be provided by the developer in a form
satisfactory to the City Planner and the City Solicitor. In addition,
the developer shall bring to grade the area of said easement to .
Permit the widening, and shall construct an adequate sub-base.
2. The developer shall work cooperatively with the City in planning
appropriate improvements for the intersection of Swampscott Road
and Highland Avenue and the developer shall contribute toward such
improvements, as mutually agreed to by the Board and developer
prior to approval of the second phase of the development.
B. Visual Impacts/Site Design
1. No building permit shall be issued for any dwelling unit or other
structure in the Planned Unit Development unless and until a Site Plan
including such dwelling unit or other structure shall have been submitted to
and approved by the Planning Board pursuant to the provisions of Section
VII-R of the Zoning Ordinance and the Planning Board Rules and Regulations
and subject to the further review criteria set forth herein:

1. Architecture
The Planning Board reserves the right to further waive the requirements of
this Permit under the Site Plan Review process.
2. No site plan showing less than 80 condominium dwelling units shall be
submitted to or approved by the Board except for the final site plan
to be submitted for the construction of all remaining units permitted
hereunder.
3. The site plans submitted to the Board shall provide for the
development of the Planned Unit Development in phases of no more
than 130 dwelling units.
3a. Each site plan and phase shall provide for"an adequate physical
separation from each other phase, with such mechanism of separation
to be reviewed and approved by the Planning Board.
4.There shall be no eight unit buildings within the Planned Unit
Development unless specifically permitted by the Planning Board. No
structures shall contain more than four (4) dwelling units, unless
specifically permitted by the Planning Board.

5. A plan for a passive recreation trail linked with the ancient trail
referenced in the Environmental Impact Report prepared by HMM
Associates shall be submitted to the Planning Department for review
and approval prior to approval of any site plan and provided that each
site plan shall provide for such passive recreation trail.
6. Foundations and utilities shall be constructed and inspected prior to
issuance of a building permit.
7. A plan entitled "Typical Plateau Grading", dated January 3, 1986, as
previously presented to the Planning Board, shall be reviewed and
approved by the City Planner and Planning Board, and amendents
shall be required as necessary, and all grading shall be constructed
according to such plan as amended.
8. All landscaping and screening within the development shall be
subject to the review and approval of the Planning Board.
a. Mature trees shall be a minimum caliper established by the
Planning Board. Shrub diameters shall also be a minimum
established by the Planning Board
b. Maintenance of vegetation shall be the responsibility of the
developer or his successors in interest.
C. Following the definition of an adequate per dwelling unit
landscaping budget as determined by the City Planner, the
developer shall comply with such budget.
9. Sloped granite curbing shall be installed as required through the Site
Plan Review Process. Final approval of location and type of curbing
shall be made by the Planning Board.
10.Building colors shall be reviewed and approved by the Planning
Board. The Planning Board will require earth tone colors or colors

which are compatible with the surrounding environment.
11. Exterior building designs shall be reviewed and approved by the
Planning Board. Such approval shall require that each design be of a
residential nature, and include the use of clapbo ard, shingles,
texture 111, or other wood products.
12. There shall be no curb cuts along First Street. In addition, any
residential.units located along First Street shall be adequately set
back and a dense tree screen shall be placed to visually screen units
from First Street. Such screening shall be reviewed and approved by
the Planning Board in the same fashion that all other landscaping
and screening shall be so reviewed and approved.
,.. 13. Each site plan shall provide for a common area for each phase of the
development of a size and location which the Board determines is
necessary or appropriate to provide for recreational use by the
dwellings in such phases.
14. The Developer and the City shall pursue the possibility of creating
water or ponding on the site.
C. Waste Water Services
1. Adequacy of wastewater pipes shall be approved by the Engineering
Department.
2. A minimum of 10' horizontal separation shall be maintenaned
between water snd sewer pipes.
3. Minimum cover, slopes, and vertical separation distances shall be
maintained.
4. Easements for access to cross-country sewer lines shall be provided
and approved by the Director of Public Services and City Planner.

D. Fater Services
1. Distance to fire hydrants from units shall be shown on the plan and shall

comply with the.Rules and Regulations of the Planning Board and Fire i
Department.
2. Method of metering water connections and water hook-ups to individual
units shall be approved by Engineering Department.
E. Site Drainage
1. The updated drainage study currently being prepared by the developer shall
be reviewed and approved by the City Planner and Director of.Public
Services prior to commencement of re-grading and construction.
2. Discharge at the low point of catchment S-4 at the intersection of
Swampscott Road and First Street, in the southwest corner of the first
PUD approval, will not be increased beyond its present level of 110 cu. ft.
per second. Such increases shall be minimized through construction of
detention areas as recommended by drainage studies performed by HMM
Associates and the updated drainage study now being completed.
3. Details of erosion control measures at drainage outlets in each phase shall
be reviewed and approved by the City Planner and Director of Public
Services prior to issuance of building permits for that phase.
4. Outlets for discharges from building underdrains shall be shown on plans.
Both outlets and drainage structures shall be approved by the Planning
Department and Engneering Department.
5. Natural storage capacity of existing wetlands shall be fully maximized .
The Director of Public Services and the City Planner shall confirm that
such natural capacity has been maximized through analysis of the updated
drainage study.

F. Wetlands
1. Salt as a de-icing agent is prohibited.
2. All proposed fill areas shall have sedimentation control barriers
installed in areas within 50 feet of wetlands before any fill is
placed.
3. Any inadvertent infringement on wetlands shall be compensated'for
in a manner as set forth in compensation procedures stated in DEQE
Order of Condition 4164-92.
4. The DEQE Order of Conditions (4/64-92) shall be strictly adhered to.
5. Copies,of all wetland replication plans submitted to DEQE shall be
sent to the Planning Board and shall be reviewed and approved by
the Conservation Commission.
G. Emergency Access
1. Each unit within the Planned Unit Development shall have adequate
means, as approved by the Planning Board, to facilitate the location
of units quickly in an emergency situation.
2. Fire alarm cables and alarm boxes shall be installed in accordance
with specifications of the Fire Chief and City Electrician.
3. Driveways to units less than 500' from Whalers Lane, along travelled
roadways, shall be widened to 201.
4. Driveways to units greater than 500' from Whalers Lane along
travelled roadways shall be widened to a minimum of 24'.
5. Provisions shall be made for U-turns at dead-end drives. Such
provisions shall be reviewed and approved by the Fire Department
and Department of Public Services.
6. An informational signage plan shall be submitted to the City
Planning Board prior•to issuance of Certificates of Occupancy. Such

plan shall designate street names and unit numbers and their reasons
for such. Unit numbers shall be clearly designated on each unit for
ease in location by emergency vehicles.
H. Health
1. All units shall be equipped with trash compactors.
2. A licensed pest control firm shall be employed to perform a site
evaluation prior to commencement of construction. Any further
necessary-rodent control procedures specified by the Board of Heath
shall be carried out by the developer.
3. All concerns relating to public helath shall be reviewed and
approved by the Board of Health.
I. Electrical
1. All electrical wiring shall be placed in rigid conduit unless otherwise
permitted by the City Electrician.
2. Location and installation of street lighting shall be the
responsilibility of the developer subject to approval of the City
Electrician.
3. All electrical utilities within Whalers Lane shall be constructed as
required by Massachusetts Electrical Standards specifications.
J. General
1. Each phase of development will have a separate condominium
association, or such other differentiation of governance as the
Planning Board shall approve.
2. There shall be no further subdivision of the land except to permit
the phasing of condominiums to be constructed on the land.
3. The subdivision road shown as Whalers Lane shall be completed prior
to the issuance of a building permit for the 260th residential
dwelling unit.

4. A certificate of compliance or approval signed by a majority of the
members of the Board shall constitute conclusive evidence of the
I
completion of matters set forth therein if and when recorded with
the Essex County Registry of Deeds.
5. The special permit granted hereunder shall lapse within two years if
a substantial use thereof has not sooner commenced except for good
cause, or if construction has not begun by such date except for good
cause. If construction does not proceed in a consistent and timely
manner as defined by the Planning Board, such Special Permit shall
be revoked upon such determination by the Planning Board.
6. If Fafard or its successors or assigns shall make any use of the
Planned Unit Development other than as set forth herein, the Board,
after notice to Fafard and the holding of a public hearing, may
revoke this permit for all buildings for which a Certifcate of
Occupancy has not been issued and all land within the Planned Unit
Development which has not yet been built upon.
7. Upon request of Fafard, any provision of this Special Permit may be
waived or amended by a majority vote without the need for further
public hearing of the Planning Board.
8. This Special Permit shall expire seven years from date noted herein
with respect to those units for which building permits have not been
issued. Time may be extended subject to approval of the Planning
Board.
Appeal from this decision, if any, shall be made pursuant to the
Massachusetts General Laws, and-shall be filed within 20 days after the date of
filing of this decision in the office of the City Clerk. Pursuant to Massachusetts
General Laws, the Special Permit shall not take effect until a copy of the decision,
bearing the certification of the City Clerk that 20 days have elapsed and no appeal
has been filed, or that, if such appeal has been filed, that it has been dismissed or
denied, is recorded in the Essex County Registry of Deeds and is indexed under the
name of the owner of record or is recorded and noted on the owner's certificate of
title.
