This decision is rendered upon an application for a special permit for a - planned unit development pursuant to Section VII-O of the Zoning Ordinance of the City of Salem (the "Ordinance"). The 'application was submitted on November 16, 1983, by The Fafard Companies, which include H. A. Fafard and Sons Construction, . Inc., Ledgemere Land Corporation and Fafard Real Estate (collectively, "Fafard") - together. with a.site plan entitled "Subdivision Plan Planned Unit Development", by P. Boghosian, November 15, 1983and and an' Environmental Impact Statement as required by Section VII-0 4 ofthe the Ordinance. The. Board, within seven days.after receipt of the application transmitted a copy of the application and the plan to the Inspector of Buildings, the. City Engineer, the Board of Health and the Conservation Commission. Notice of the filing of the application was alsogiven to the City Clerk, Fire Department, Police Department, Superintendent of Streets and the School Department. Notice of Public Hearing by the Board on this application was duly published in the Salem News on December 3, 1983, and December 7, 1983, and duly- ,mailed to all persons entitled thereto by law. A public hearing on the application was held in accordance with such notice at 7:30 p.m. on December 19, 1983, in the second floor hearing room at One Salem Green in Salem. The data so considered includes, but is not limited to, the items listed in Addendum A attached hereto, which items ,are specifically incorporated in and made a part of this decision and which 'need not be recorded as a part hereof. The Board is satisfied that such data is sufficient to meet the requirements of Section VII-O of the Ordinance. Accordingly, the Board has unanimously voted to grant a Special Permit for a Planned Unit Development pursuant to Fafard's Application upon and in accordance with the provisions, conditions and procedures set forth below: 1. Based upon the written material submitted to the Board as well as oral communications received at the Public Hearing and other public meetings of the Board, the Board makes the following findings- 2 A. The Planned Unit Development has been designed with various types of land uses which can be combined in a compatible relationship with each other as a totally - planned development. B. The designof the Planned Unit Development is compatible p with the existing or potential development of the surrounding neighborhoods in that Fafard proposes commercial uses for property adjacent to, an existing commercial zone. C. A plan for the total property has been submitted to the Board which clearly deails the manner in which the subject area is to be developed and the means that will be employed to protect the.abutting property and the health, safety, welfare and privacy enjoyed thereon in accordance with the requirements of Section VII-0 3.b of the Ordinance. D. Section VII-0 3.d of the Ordinance does not apply to the Planned Unit Development as it is not located adjacent to or across the street from existing residential developments. E. The Planned Unit Development is in harmony with the purpose and intent of the Ordinance and the Master Plan of the city of Salem and will promote the purposes of Section VII-0 of the Ordinance as set forth in Subsection 2 thereof. F. The mixture of uses in the Planned Development is sufficiently advantageous to render it appropriate to depart 3 r. from the normal requirements of the zoning district in which it is located. G. The Planned Unit Development will not result in a net negative environmental impact. H. The parcel containing the Planned Unit Development contains more. than sixty thousand (60,000) square feet. II. The special permit and the exercise of the rights granted .. hereunder shall be subject to the following conditions A. No building permit shall be issued for any building.in the Planned Unit Development until a performance bond, satisfactory to the Planning Board and the Director of Public;Works or City Engineer, shall be provided for the construction of a twenty-four foot wide paved vehicular way to be constructed in accordance with the requirements of the applicable Subdivision Rules and Regulations of the Board from the existing terminus of First Street to the existing paved area at the rear of Hawthorne Plaza, within the thirty foot easement area shown on a plan entitled_ nCompiled Plan of Land in Salem, MA" by Joseph W. Moore Co., Inc.; owned by Highland Realty Trust; September 19, 1983, and the use of such way by the public at large shall be secured, in such a manner as shall . be satisfactory to the Board. Construction of the road shall begin within ninety (90) days of the granting of the easement by the owner of the Hawthorne Square shopping area. The City Engineer shall determine the amount of the bond by applying the estimated surveyed quantities 4 multiplied by the unit prices, listed in the latest Building Construction Cost Data Manual used by the City Engineering Department, adding ten percent (10.00%) thereto andddin e a g ten percent (10.00%) each year for two (2) years. At the end of the two-year period from the date of the approval of the bond by the City Engineer, if the roadway has not been completed, the City shall have the right to determine the bond to be due and that the amount of said bond shall at that time be immediately paid to the City of Salem. B. No building in the Planned Unit Development shall exceed two stories in height or thirty (30) feet in height. C. Each building in the Planned Unit Development shall satisfy the parking and loading requirements of the Ordinance in effect at the time a building permit is sought for such building. D. The Gross Floor Area of the buildings located in that portion of the Planned Unit Development north of First Street shall at no time exceed three hundred ninety-five thousand square (395,000) feet with no more than one hundred eighty-five thousand square (185,000) feet thereof occupied by any of the following uses: 1. Retail department stores, supermarkets, food stores, restaurants and other eating places in which alcoholic beverages may be served on the premises, places of commercial recreation and entertainment, physical fitness facilities and health clubs, but excluding movie theatres and amusement arcades_ 5 2.. (k) Warehousing and distribution (1) General office buildings and other similar and related uses (m) Off-street parking and loading facilities and other accessory uses and buildings, provided that such uses are clearly incidental to the principal use ("Retail Uses") with the balance to be used for the following non-retail related uses: 1. Light industry uses: (a) Steam laundry or dry cleaning plant; 6 (b) Food and beverage manufacturing, bottling or processing or commissary; (c) Assembly or packaging of articles not exceeding two hundred (200) pounds in weight, provided no manufacturing or processing is carried out,, . (d) Printing, binding, publishing and related arts and trades, I (e) Manufacturing, assembly, reconditioning and processingplant of the following type industries provided that such operations. Landscaping in accordance with the approved -landscaping theme. c. Parking spaces and layout in accordance with the applicable Ordinance. d. Site plans submitted for approval shall designate an easement area of no less than ten (10) feet in width which would be suitable for potential trails and_accesses to open space areas shown on Salem Conservation Commission Area Map dated October, 1983: Such easement when approved shall be granted to the Conservation Commission of the City of Salem. _ 9 The Board shall have thirty (30) days following the meeting at which the site plan is submitted to review the submitted plan and shall approve such plan or indicate to the applicant those specific instances where the submitted plan does not conform to the requirements as set forth bove. We submit the following trash disposal plan with the following assumptions: i. The private homeowners, through their Condominium Association, will pay for the private collection and disposal of their trash; 11. It is in these homeowners' self-interest to ensure timely, sanitary, and adequate trash removal ; iii. Less trash per unit is expected to be generated since these two-bedroom residences will contain fewer residents (especjally children) per unit than the typical single family Salem residence. Trash Disposal Plan: A. Homeowners will carry their trash to designated pickup sites located conveniently throughout the development (see Plan Sheet 10 of 14) . B. Trash will be packaged in Board of Health-approved containers (eg. heavy duty plastic garbage bags) . C. Designated sites will be chain-link fence-enclosed areas, screened by five-to-seven-foot high arborvitae. Dimensions will be 10' x 10' x 5' high. D. Trash will be delivered by the homeowners to these collection areas from 7-9 a.m. the morning of the designated weekly pickup. The land is located off Traders' Way about half way to Greenledge Street (see attached site map). The drill foreman reported to Ron that he was encountering a void within the ledge being drilled, which had within it a quantity of water and what appeared to be a petroleum product. I visited the site and drew a small sample from one of the drill holes. The substance appears to be a petroleum-like material, and smelled like waste oil. I requested that a small sample of the material be withdrawn from one of the holes, so that an identification of the substance could be made. Ron indicated that he worked for a firm which could provide an analysis as well. May 22, 1985 On Wednesday, May 22nd, I called D.E. G. E. and explained the problem to them. I spoke with Mr. Kingsley Ndi and he indicated that a supervisor would be in contact with me, and that activity in the affected area is to be curtailed. Later in the morning, Bob Blenkhorn called. He was called by D.E. G. E. relative to this problem. He visited the site and met with Paul Nardini, John Chabot, and Ron Tiberi. Parcel #1 contains 28 two-bedroom units , in five buildings, with garbage disposal in the kitchen. The water is connected from an existing 12" concrete lined ductile iron line in First Street, through a 6" C.L.D. I. line into the site, and distri- buted to each building via a 2" line. The sewage system will be a combination gravity and forced main system. The gravity portion of the system will consist of a r 6" PVC pipe which will connect each building to the ejector station. The station will consist of monolithic steel rein- forced concrete, a 2 horsepower (100 GPM, 17 foot total dynamic head) submersible pump with a 4" orifice and 4" C.L.D. I . force main. The force main will connect to a manhole with an 8" PVC line connecting to the existing 18" reinforced concrete sewer line in First Street. The total design flow from Parcel #1, based on Massachusetts State Codes , is 6160 gallons per day. The sewer permit has been approved by the City Engineer and is currently being reviewed by the State. The drainage for Parcel #1 consists of a 24" R.C. pipe de- signed for the 100 year storm with a water shed area of ap- proximately 9 . 6 acres extending to the opposite side of Highland Avenue. The site drainage design is in accordance with the Massachusetts Department of Environmental Quality Engineering Wetlands Order of Conditions , File #64-92. The only abutter with commercial use is Vincent Potato Chips, which has its building approximately 1,000 feet from our tract. Parcel #2 contains 16 two-bedroom units , in four buildings . Water service for buildings #1, 2, and 3 will extend from the existing 12" C.L.D. I. line in First Street to the site via a 4" C.L.D. I. line and then to the buildings through a 2" line. Building #4 will connect to the 12" C.L.D. I. line in First Street via a 2" line directly. The sewer service will be a gravity system. Buildings #1, 2, and 3 will feed to an 8" PVC line, via a 6" PVC line. The 8" PVC line will connect to the existing 15" R.C.P. sewer line currently existing in First Street. Building #4 will connect directly to the 15" R.C.P. sewer line in First Street via a 6" PVC line. The total design flow from Parcel #2, based on Massachusetts State Codes is 3520 gallons per day. The Sewer Permit has been approved by Salem' s City Engineer and is cur- rently being reviewed by the State. The water service for Buildings #1, 2, and 3 will be connected to the 12" C.L.D. I . line in First Street via a 4" C.L.D. I. line on site. Each building will connect to the 4" feeder via a 2" line. Building #4 will connect directly to the 12" C.L.D.I. line in First Street by means of a 2" line. The drainage for Parcel #2 consists of catch basins and 12" R.C.P. out fall pipes draining the paved areas . This plan is in accordance with Massachusetts Department of Environmental Quality Engineering ' s Wetlands Order of Conditions File #64-92. The abutters, Pequoit Association, Salem Conservation Commission, Salem Housing Authority and Highland Realty Trust will not be adversely affected by the proposed development. Currently, the only existing buildings in this area are the Pequoit Asso- ciation and the Vincent ' s building. I:H 'xF�'T On Thursday, October 18, 1984, the Planning Board of the City of Salem held a public hearing regarding the application of the Fafard Companies, 290 Eliot Street, Ashland, MA. for a Special Permit under Section P, Wetlands and Flood Hazard Districts, of the Salem Zoning Ordinance, with respect to the construction of five multi—family buildings on one parcel on First Street and four multi—family buildings on a second parcel ; both lie within a wetlands area. At a regularly scheduled meeting of the Planning Board on December 6, 1984, the Board voted, by a vote of six in favor, none opposed, to approve the application as complying with the requirements for the issuance of the permit with the following conditions: 1. The safety of utilities from flood damage shall be approved by the Director of Public Services. 2. All roadways/driveways shall be constructed with sloped granite curbing and a crown for ease in drainage. The location of the curbing shall be subject to the approval of the Planning Department. 3. The landscaping plan for both parcels shall be subject to the approval of the Planning Department. 4. Plans showing 2 ' contours for proposed grades shall be submitted to the Planning Board and review and approval of the entire drainage system shall be made by the Director of Public Services and the City Planner. 5. Construction measures shall be undertaken to make certain that basement floor levels are adequately protected from leakage and seepage of water Such measures shall be subject to the approval of the Director of Public Works. . 6. All exterior lighting of the proposed development shall be constructed on a separate circuit such that the ability of individual residents to control the availability of lighting during night-time hours does not exist. 7. Work shall conform to a plan entitled "Site Plan of Land on Parcel 1 in Salem, MA. dated September, 1984, with revisions, and "Site Plan of Land on Parcel 2 in Salem, MA. , dated September 1984, with revisions. Both plans stamped by William T. McDonough, Registered Professional Engineer, #31739. 8. This order does not grant any property rights or any exclusive privileges; it does not authorize any injury to private/public property or any invasion of public/private rights.
