Furthermore because of the fragile health and ecological conditions existing on Bakers Island in general and this lot in particular it is imperative that no variance or relaxation the CMR' s be granted. Accordingly we request that you provide the undersigned abutters with sufficient notice as the date and times the Health Department may wish to conduct site examinations, percolation tests, and or any other work on lot 108 that pertains to the applications for leaching field approval in order that they may attend such tests . Finally, in reviewing Mr. McCarthy's application for a building permit we note that his application states that he wishes to build a garage or shed. " In other words we insist on an either "fish or fowl" classification for this building. The reason for our concern regarding this matter is that the proposed elevations for this "garage" (see attached) suggest that living quarters could be incorporated within this building. The use of Andersen sliders and dormer windows in our view, suggests a very elaborate "garage" for a simple island with no roads and no automobiles . In order to avoid future expense, inconvenience and litigation for Mr. McCarthy we suggest that the building inspector advise him of the specific nature of any building permit to build a garage, shed or storage area. It would indeed be unfortunate if Mr. McCarthy' s fertile imagination leads him to believe that he can construct a bogus "garage" to camouflage living quarters which he subsequently occupies with only a wink and a nod from his duped building inspector and abutters . We trust that the building inspector will advise him that his only option to achieve building occupancy remains through compliance with the Title Five Sanitary Code. Because of Mr. McCarthy's flagrant inconsistency in that he has advised us he intends to build a dwelling and the building inspector that he intends to build a "garage" we believe it is the building inspector's responsibility to determine exactly what he plans to build and advise us accordingly. Should you have any problem with any aspect of this letter we trust that you will communicate same to us immediately otherwise we shall assume that our requests as abutters are in compliance with the requirements of the Title Five Sanitary Code.
