The parcel as delineated on the accompanying Site Plan, consists of approximately 2.86 acres within the R-3 zone. The site has approximately 419 feet on First Street. It is our intent within this Planned Unit Development, to insure compliance with the Master Plan and good zoning practices. The ~ residential Planned Unit Development will contain only currently permitted R-3 zone uses. As indicated i'n Section 3 of P.U.D. , regulations R-3, Multi-family Residential use is allowed. The boundaries of the P.U.D. are compatible with the existing or potential development of the surrounding neighborhoods. Height limitation parking and ofsets shall be in accordance with the- R-3 'zone. Also, attached is a copy of Final Environmental Impact Report and the DEQE Order of Conditions under the Wetlands Protection Act, covering this entire area. Conditions (Complete those sections indicated (x) by the Building Inspector) In the Wetlands and Flood Hazard Districts no structure or building, including pipes and wells, shall be erected, constructed, substantially improved, enlarged, or otherwise created or moved; no area shall be paved; no earth or other material shall be stored, dumped, used as fill, excavated, or transferred; and no sediment shall be caused to be discharged from or onto a wetland, unless all the following condi- tions are found to exist as part of the granting of a Special Permit by the Planning Board (Use additional pages if necessary) : A. The cumulative effect of the proposed development or use, when combined with all other existing and anticipated development and uses will not obstruct or divert flood flow; substantially reduce natural flood-water storage capacity in the local drainage area; destroy valuable habitat for wildlife including fisheries or shellfisheries; adversely affect groundwater resources or increase storm water run-off velocity so that water levels on other land are substantially raised or the danger from flooding increased. Procedure The Planning Board shall, within 7 days after the filing of this application, transmit one copy of said application, plans and all other submitted information to the Inspector of Buildings, City Engineer, Board of Health and Conservation Commission who may, at their discretion, investigate the application and report in writing their recommendation to the Planning Board. The Planning Board shall not take final action on such application until it has received a report thereon from the Inspector of Buildings, City Engineer, Board of Health and Conservation Commission or until thirty-five (35) days have elapsed after dis- tribution of such application without a submission of a report. The Planning Board Shall hold a Public Hearing on said application as soon as possible after receiving the above reports, in accordance with Chapter 40A of the Massachusetts General Laws. The Planning Board shall notify the applicant in writing of its decision on the special permit. The decision shall document the proposed development or use and the grounds for granting or refusing the special permit. The topics discussed were the Fafard proposal for disposal of solid waste and the employment of a licensed pesticide firm for site evaluation and service. The board of Health feels that the Fafard proposal for disposal of solid waste from residents of Whaler's Lane (see enclosed) is inadequate and therefore unacceptable. This proposal is contrary to the regulations stated in Chapter II of the State Sanitary Code whereby the receptacles for the storage of garbage and rubbish prior to pick-up must be conveniently located. Also, the Board of Health feels that with a development of this size and nature removal of the garbage and rubbish would need to be accomplished by a daily pick-up. Finally, the Board of Health feels that the proposed holding sites would present a problem with the harborage and infestation of rodents and vermin and unsanitary conditions. Concerning the employment of a licensed pesticide firm the Board of Health feels that the submitted report of inspection by Fafard (see enclosed) is insufficient in addressing the size of this previously undeveloped area and obvious number of wildlife, insects, rodents, and other vectors of disease. Each of our proposals has involved the use of the City's normal solid waste pick-up and disposal service presently being utilized in other residential areas. We have attempted to justify this method on the basis of the fact that these condominium owners are single family homeowners and, as such, taxpayers}who should be provided the same municipal services as all other single family homeowner/taxpayers in Salem. Additionally, the tax revenue from Ledgemere Country II will be greatly in excess of the anticipated cost of all municipal services including solid waste disposal. Your letter of September 3, 1985, rejected our proposal as being "inadequate and therefore unacceptable." We are presently working with the Planning Board to finalize all conditions so as to allow their necessary approvals in the next few weeks. To this end, we propose that the solid waste disposal be handled in the same fashion as it was for our Parcels I and 2 on First Street (44 units). Specifically, we propose that the following conditions be included in the P.U.D. approval by the Planning Board: (a) "Removal of rubbish and other refuse generated within the Planned Unit Development shall be the responsibility of the governing association of the development. Such responsibility shall be recorded with the deeds of the property owners and shall run with the land." I The Board of Health November 11, 1985 Page 2 (b) "Upon the request of Fafard, and after public hearing held in accordance with the requirements of Section VII-0 of the Ordinance, any provision of this Special Permit may be waived or amended by a majority vote of the Board." At our sole discretion and responsibility, we will catch, release, relocate or euthanize the animals . This program will begin the week of October 21 , 1985 , and continue for one month, or until either party discontinues this agreement . It is my understanding that the Fafard Company agrees to reimburse the League for six box traps of various sizes and pay $7 . 00 per hour for time spent by the League personnel . We will keep a log book of time spent on this project. Our Salem Branch Animal Shelter manager, Mary Brasier , will supervise this trapping program for the League . The topics discussed were the Fafard proposal for disposal of solid waste and the employment of a licensed pesticide firm for site evaluation and service. The board of Health feels that the Fafard proposal for disposal of solid waste from residents of Whaler's Lane (see enclosed) is inadequate and therefore unacceptable. This proposal is contrary to the regulations stated in Chapter 11 of the State Sanitary Code whereby the receptacles for the storage of garbage and rubbish prior to pick-up must be conveniently located. Also, the Board of Health feels that with a development of this size and nature removal of the garbage and rubbish would need to be accomplished by a daily pick-up. Finally, the Board of Health feels that the proposed holding sites would present a problem with the harborage and infestation of rodents and vermin and unsanitary conditions. Concerning the employment of a licensed pesticide firm the Board of Health feels that the submitted report of inspection by Fafard (see enclosed) is insufficient in addressing the size of this previously undeveloped area and obvious number of wildlife, insects, rodents, and other vectors of disease. Dear Mr. Horn: This letter represents written notification confirming our phone conversation of October 7, 1985. After speaking to you, I consulted the Deputy Director for the Division of Fisheries and Wildlife, Mr. Lewis C. Schlotterbeck. He confirmed the Division's long standing policy to not allow the relocation of nuisance animals. The policy reads that the nuisance animal must be destroyed by legal means within 12 hours of capture. This activity may only be carried out by a Nuisance Animal Control Permittee authorized by means of a'Nuisance Animal Control Permit issued through the Division of Fisheries and Wildlife. This policy is based on recommendations by Wildlife Biologists and is endorsed by the M.S.P.C.A, and Mass. Audubon. The basis of the policy is as follows: (1) disease can be transmitted from one animal population to another through translocation and introduction; (2) in most cases the nuisance animal becomes a nuisance animal in the new location; and (3) Massachusett's populations of animals that would be translocated are already up to capacity and any introduction of new animals would disrupt the stability of those populations. A mention should also be made here of the species of mammal that could be controlled should one become a nuisance. Woodchuck, gray squirrel, raccoon, skunk, opossum, rabbit and chipmunk are the only species authorized under Nuisance Animal Control Permits. These animals must be a nuisance in the sense that they are damaging a landowner's property. Taking the above information into consideration, the Division of Fisheries and Wildlife would recommend that no control measures be taken at the site of the development . The animals should only be controlled by a Nuisance Animal Control Permittee if they indeed become a nuisance to individual landowner's in your town. The town of Salem should realize that it is impossible to have such large tracts of development and still salvage resident animal populations. This fact is a tragedy, but one that is unescapable. Yet, the mass trapping of the animal populations disturbed by constructionis not a feasible solution. The gravity sewer shown from station 16+00 to 26+00 should be. eliminated until plans for the pumping station on Swampscott Road are completed. 4. The area shown as wetlands on sheet SP 1 does not agree with the topogrophy shown on the plan. Additional survey work is most likely necessary to better define the wetlands and the proposed compensating area. An elevation of the wetlands should be provided to insure the elevation of the proposed ditch will not drain the existing wetlands. If the Planning Board wishes to approve the proposed subdivision at tonight's meeting, I request that they include the resolution of the above items in their order of conditions. All replacement areas to be constructed shall be lined on their surface with topsoil excavated from the wetlands to be filled as a result of the project. Arrangements shall be made for storage and protection of the topsoil after removal and before replacement. 5. At least 75% of the surface of the replacement areas shall be re—established with indigenous wetlands plant species within two growing seasons. Prior to vegetative re—establishment, any exposed soil in the replacement area shall be temporarily stabilized in accordance with "Erosion and Sedimentation Control Guidelines", Publication ##13, 529-39—lobo-2-84—C.R. , dated August, 1983. 5-6 6. Any compensatory wetland area which does not revegetate with characteristic bordering vegetated wetland species over 75% of its surface area within two growing seasons shall be re-planted with characteristic species. A planting plan for such purposes shall be presented to and approved by the Salem Conservation Commission prior to its implementation. 7. Prior to any construction within one hundred feet of the wetlands as shown on the above referenced plans, an erosion control and sedimentation barrier shall be installed between the construction site and any down gradient bordering vegetated wetlands. The erosion controls and sedimentation barriers shall be established in accordance with "Erosion and Sedimentation Control Guidelines", Publication #13,529-39-1000-2- 84-C.R. , dated August, 1983, and approved by the Salem Conservation Commission or its designated agent. 8. The Fafard Companies, Inc. , and its successors and assigns, shall be responsible for maintenance of all drainage inlets and outlets and for ensuring that said maintenance becomes a condition of all leasing or ownership of those properties for sale or lease within the Business Development Park. Copies of all such maintenance agreements shall be forwarded to the Salem Conservation Commission and the DEQE. 9. The City of Salem and The Fafard Companies, Inc. and its successors and assigns shall enter into an agreement which guarantees maintenance of the proposed control structures and forward such agreement to the Salem Conservation Commission and DEQE. 10. Any work requiring Conservation Commission review and/or approval shall be completed to the satisfaction of the Salem Conservation Commission prior to commencement of work in a subsequent phase unless prior consent from the Salem Conservation Commission is obtained. This consent shall not be unreasonably withheld. 11 . The Fafard Companies, Inc. , and the City of Salem shall enter into an agreement for an independent Clerk of The Works who can act as the designated agent of the Salem Conservation Commission. 12. Any changes made or intended to be made in the plans shall require the applicant to inquire of the Conservation Commission in writing whether the changes require Salem Conservation Commission comments or approval. 13. Future phases within the "Business Park Development" site shall be reviewed and acted upon by the Salem Conservation Commission, both independently and as they impact the total development. 5-7 14. The Fafard Companies, Inc. , and its successors and assigns shall be required to submit all plans for above and below ground chemical storage to the Conservation Commission and DEQE for their approval prior to their construction. Should the Fafard Companies, Inc. , and its successors and assigns require a change in the use, or addition to said storage tanks, the Conservation Commission shall be notified in writing two (2) weeks prior to any change. 15. The adequacy of the 36" and 24" culverts on Swampscott Road immediately downstream of the "Business Park development" shall be analyzed b the developer in conjunction with the City Engineering Y Y P Department An engineering report detailing the findings shall be submitted to the Engineering Department and Conservation Commission for its approval. If deemed necessary by the Engineering Department and Conservation Commission, upgrading of the culvert(s) shall be undertake by the developer and at the cost of the developer. A plan detailing the upgrade procedure shall be submitted to the Conservation Commission for its approval prior to construction. •• 16. Notwithstanding the approval of plans, calculations and supporting documents referenced as part of this Order of Conditions, the respective discharge flow=_ from the stream paralleling the south eastern border of the "Business Development Park" and the stream paralleling Swampscott Road shall not be increased beyond their present levels. 17 . The Fafard Companies, Inc. will immediately submit their engineer' s findings regarding waste material within the "Business Park Development" to the DEQE. If DEQE determines the stockpiled material to be non—hazardous, The Fafard Companies, Inc. will remove the material from the Business Park Development to another location owned by the Fafard Companies and disposed of in a manner approved by the Conservation Commission. Fill material which DEQE determines to be hazardous shall be removed from the site within four weeks from the date of the positive finding. The hazardous material shall be removed to an approved facility and copies of delivery slips shall be supplied to the Conservation Commission. Until such material is removed, the stockpiled material shall be covered and surrounded by hay- bales. The Fafard Co. shall promptly provide the Conservation Commission with copies of all correspondence to and from DEQE. — 18. Banks bordering vegetated wetlands shall be disturbed as little as possible. Those bank areas requiring alteration will be regraded at a maximum slope of 1k: 1, loamed and re—established with indigenous vegetation. At the top of said slope, a 6' level pervious landscaped zone shall be maintained. In locations where the Fafard Companies, Inc. are unable to maintain the banks as defined above, detailed plans for those specific conditions will be submitted for Conservation Commission approval prior to construction. 5-8 19. The Fafard Companies, Inc. , and its successors and assigns shall be responsible for ensuring that salt as a deicing agent shall not be used on the roadways. This prohibition of salt as a deicing agent shall become a condition of all leasing or ownership of those properties for sale or lease within the "Business Park Development". 20. Application Dear Mr. Power: 1 In accordance with Section VII-0, The Fafard Companies hereby petition for a Planned Unit Development under this section. Theparcels as delineated on the accompanying Site Plans consists of approximately 69 Acres within the R-3 zone. The site has approximately 2,045 feet on Swampscott Road, 1,326 feet on First Street and includes the proposed Whalers Lane, 4,500+ Lineal feet. It is our intent within this Planned Unit Development to insure compliance with the Master Plan and good zoning practices. The residential Planned Unit Development will contain only currently permitted R-3 zone uses. As indicated in Section VII-0-3 of the regulation, Multi-Family Residential use is allowed. The boundaries of the P.U.D. are compatible with the existing or potential development of the surrounding neighborhoods. Height limitation parking and offsets shall be in accordance with the R-3 zone. Prior to this time,. materials have been supplied to the Salem Planning Board covering the entire project that has been completely approved by the Secretary of Environmental Affairs. The Environmental Impact Report was based on 700-750 proposed residential units. At present, the Salem Panning Board has approved Parcel #1 P.U.D. and Parcel #2 P.U.D. with 28 and 16 units respectively. Our Planned Unit Development proposes 552 units for this parcel. Total Lot 69.72 Acres Whalers Lane 5.15 Acres ' Residential Area 64.57 Acres Density 552 = 8,55 Units/Acre 64.57 Under R-3 zoning regulations, 12.44 units per acre or a total of 803 units are allowed.
