Dear Mr. Tinti:
A question has arisen regarding the interpretation
of the language in the City of Salem Zoning Ordinance, .
Section 8, Paragraph B "non-conforming lot". It is apparently
significant whether or not the definition of common owner
(contiguous lots) means identical ownership.
A specific example relates to property on Arthur St.
One lot of approximately 5,000 sq. ft. which is individually
owned, the adjacent lot upon which a structure has been erected,
is held in common ownership by four individuals, one of whom
owns the 5,000 sq. ft. lot already mentioned.
Would you please provide me with an opinion as to whether
or not these two parcels are held in common ownership as
adjoining lots under the Zoning Ordinance.

In re: Arthur Street
Dear Mr . Powers:
I have received your request for an opinion dated May 21, 1979
with regard to Arthur Street.
Massachusetts General Law Chapter 40A, Section 7 and Section 8
paragraph (b) of the Zoning Ordinance of the City of Salem provide
that non-conforming lots may be built upon for one and two family
residencies provided they have been established in separate owner-
ship prior to the date that the requirements that the Zoning Ordinance
were first established and have remained in separate ownership
down to the present time.
Where an individual owns one lot in his own name and has a
partial interest in an adjacent lot, it would be my opinion that
such ownership would constitute separate ownership and not common
ownership.
