We have forwarded photos to the Legal Department that clearly show the conditions of 61 Appleton street and 63 Appleton street. Your first complaint of the structure being too close to the property line, the home has existed in it,s current layout prior to 1965 and is a Grandfathered ,legal, non-conforming structure. The second complaint regarding debris on 61 Appleton Street is completely unfounded. The third complaint regarding the fence does not constitute any violation of Salem City Ordinance or the Salem Zoning Ordinance. There is no language dictating which side of a fence goes which way in the City,s regulations. If you wish to challenge my Zoning interpretation or a lack of Zoning enforcement, your appeal is to the Zoning Board of Appeals. My name is Jennifer Keough and I am the Code Enforcement Officer for the City of Salem Health Department. 2. On December 10, 2009, the Assistant Building Inspector, Thomas McGrath, asked me to accompany him to the property located at 63-65 Appleton Street, Salem, MA, owned by the Defendants, in order to tag items in the yard per the December 3, 2009 order of the Court. 3. Mr. McGrath and myself arrived around loam at the property and proceeded to knock on the front door. 4. Mr. Collins answered the door and asked us what we were doing there and if we had better things to do. 5. Mr. McGrath informed Mr. Collins we were there to tag and document the items in the yard which the Building and Health Departments considered to be trash and/or city code violations per the suggestion of the Judge at our most recent court date. 6. Mr. McGrath and myself then proceeded to tag items with small numbered stickers. 7. Mr. Collins came out of his house and began dragging away items we had tagged stating that these items were not trash or violations. He also dragged a large rolled up carpet onto the sidewalk. I informed him this was considered construction material and would not be picked up by the city trash collectors. Mr. Collins informed me that I was wrong and that it would be picked up. 8. Mr. McGrath and I continued through the yard and, as we tagged items, Mr. Collins would argue and drag the items to other parts of the yard. 9. At one point Mr. Collins asked Mr. McGrath and myself if we were "retarded" and on several occasions asked us if we had better things to do. 10. Mr. McGrath attempted to look under numerous traps located on the property. Mr. Collins began to become hostile and asked Mr. McGrath not to touch those items since they were not trash or violations. 11. It became apparent that Mr. McGrath and myself were not going to be able to complete the task this Court suggested and we left soon thereafter. This inspection was to take place before December 29, 2009. On December 29, 2009,the parties again appeared before the Court and the city notified the Court that it was unable to perform the ordered inspection due to inclement weather and a staffing shortage associated with the same. Therefore, it is now ordered that said on site inspection and tagging shall take place before January.29, 2010. The parties shall next appear on that date and the city shall report back to the Court what progress has been made regarding identifying personal property on the premises that allegedly violates the city ordinance and state sanitary code and what steps have been agreed to by the city and the defendants to correct these matters. I arrived at the property shortly after 10 AM today accompanied by Ms. Jennifer Keough from our Health Department and began to tag and itemize the contents of Mr. Collins' yard. As we would tag an item Mr. Collins removed it to another location on his property. He would not allow me to lift up the plastic tarps covering many of the items so that I could identify the contents. He also flatly stated that none of the material we were looking at was junk and that he did not intend to remove any of it. We left the premises around 10:20AM. At that point, Ms Keough and I left the premises. Given the copious documentation that already exists (copies enclosed) and his position as to what needs to be removed and his unwillingness to allow me to view tarped over items, I am unable to carry out your order. In the hopes that you will have the time to review this material before the Hearing on December 17, I am enclosing a report documenting our efforts to get Mr. Collins to comply with our local ordinances as well as copies of all correspondence sent to him by this department.
