If at any time prior to payment the said city or town notifies the insurer by certified mail of its intent to initiate proceedings designed to perfect a lien pursuant to section three A, or to section nine of chapter one hundred and forty-three, or section one hundred and twenty-seven B of chapter one hundred and eleven, the said payment shall not be made while the said proceedings are pending;provided, however, that said proceedings are initiated within thirty days of receipt of such notification. For your information I have reviewed with my client the status of the rental of the 3rd floor apartment at 2 Andover Street, Salem. Mrs. Durkee purchased the property in 1982 and the apartment in question has been rented ever since that time. On several occasions actual written rental agreements have been entered into and I am enclosing the following: 1. A rental agreement from a Dorothy Cooper and Henry Clukey dated October 7, 1987. It is Mrs. Durkee's recollection that these people remained until approximately the summer of 1993. 2. A rental agreement was executed on June 27, 1993, by K. Horikawa who remained at the apartment until March of 1996. 3. On March 7, 1996, a rental agreement was executed with John Whiting and Kristen Grant who occupied the apartment until November of 1997. 4. Thereafter the apartment has been occupied and rent has been paid by Daniel Ruggles, who, as you know, is Mrs. Durkee's husband. Also, none of the enclosures referred to in Mr. Segal's letter were included in the copy I received, and thus I cannot comment on them specifically until I see them, which (by copy of this letter) I am herewith requesting of Mr. Segal. Let me point out my following immediate and initial observations, however. Do the purported rental agreements described in Mr. Segal's letter specify a term, and if so, is that term limited to a single year? If the latter, has there been any evidence submitted for the five-year-eight-month period between, say, the expiration of one year from the purported Cooper/Clukey rental agreement dated October 7, 1987, and the June 27, 1993 purported rental agreement with K. Horikawa. I trust you agree that Ms. Durkee's self-serving "recollection" with respect to how long she alleges Cooper and Clukey occupied the third floor is hardly adequate under the circumstances. I simply point this out because (1) all that is required is a cessation of two years or more to terminate the prior grandfathered, non-conforming use; (2) the Annual City Listing published by the City of Salem contains contradictory information; and (3) the burden of proof is on the person claiming he or she is entitled to a use or structure not otherwise permitted by the zoning ordinance, and not on those claiming otherwise. Also, in addition to the factual issues that we continue to have, there are at least two separate and distinct legal issues, one for the period commencing with the date of Mr. Blenkhorn's inspection of the property that gave rise to his August 15, 1989 letter, later reaffirmed by Mr. Harris in his December 4, 1989 letter, and the second commencing when Mr. Ruggles moved into the property more or less contemporaneously with his marriage to Ms. Durkee in April of 1998. Our information is that Mr. Blenkhorn's August 1989 inspection was a routine municipal inspection triggered by the fact that the third floor had recently become vacant. (If so, this alone would dispute the factual allegations contained in paragraph 1 of Mr. Segal's letter.) Thus, as we see it, one legal issue is whether a party who has been notified by the City that "the third floor cannot be occupied until the above violation is corrected" can go ahead and illegally relet the apartment, and then attempt to use that alleged occupancy in flagrant violation of the law as a basis for maintaining the nonconforming use. We are determined to test this (and other) propositions in Court if necessary. We would feel the same way even if the third floor had been occupied at the time of the August 1989 inspection, but we believe our argument is even stronger if it wasn't. Clearly, flaunting the requirement of a valid second means of egress to and from an apartment on the third floor of a wooden building that is over 275 years old could hardly be construed to be a technical, esoteric, or insignificant violation of the City's health, safety and building codes. The amazing thing is that even now, more than 13 years after both enforcement letters, the problem with respect to the second means of egress has still not been corrected. The recent tragedy in West Warwick, Rhode Island vividly demonstrates what can happen when such codes are not rigorously enforced. Can you imagine how your Department would have looked, not to say anything of the liability that would have resulted, if there had been a fire in the interim, and an injury sustained by a "tenant" who might have escaped that injury if there had been a valid second means of egress? Indeed, the inescapable effect of Ms. Durkee's argument is that she expects to be rewarded for having flaunted the law. Even apart from the factual issues we continue to have, and which we respectfully submit have not been satisfactorily addressed by Mr. 2 Segal's March 6, 2003 letter, we think this raises a serious question of law that we intend to fully litigate, among others, if we have to. A second legal issue had to do with the period from and after Mr. Ruggles' marriage to Ms. Durkee in April of 1998. Note that no purported rental agreement of any kind has been submitted by Mr. Segal for Mr. Ruggles, unlike for any of the other alleged tenants. Note also that there is no factual dispute that for the period 1998 to the present there have been only two families residing at 2 Andover Street, the family consisting of Patricia Durkee and her husband, Daniel B. Ruggles, III, who occupied "Unit 1" according to the Annual Listing published each year by the City of Salem for the five year period 1998 to 2002 inclusive, and the single-person family consisting of Millagros Emmart, since deceased, who occupied"Unit 2". So we have a situation that basically boils down to this: Ms. Durkee has actual knowledge from the official letters from Mr. Blenkhorn and Mr. Harris, dated August 19, 1989 and December 4, 1989 respectively, that the third floor at 2 Andover Street cannot be legally occupied as a separate apartment, but she presently takes the position that her husband (not a third party stranger) did and does in fact occupy the space, not as her part of the marital domicile, or as her husband, but as her tenant. Does this mean that he didn't have free access to the "unit" occupied by Ms. Durkee, being the first and second floors on the westerly half of the building, or conversely, that she didn't have free access to the third floor. Under this line of reasoning what would prevent Ms. Durkee, in the absence of a husband or a third party tenant, from declaring herself to be the tenant, and offering as proof copies of purported rental checks from herself payable to herself. Our position is clear and is factually undisputed: that there have been only two families who have occupied the property at 2 Andover Street for the five year period from 1998 to the present, and thus, there has been more than a two year cessation of the prior grandfathered nonconforming use sufficient to terminate same. We assume that Ms. Durkee can produce copies of checks from Mr. Ruggles to her. But whether such payments constitute "rent" as that term is legally defined, particularly given all of the issues surrounding this controversy, or whether they are part of a self-serving sham intended to circumvent the Zoning Code for maximum profit upon the sale of the property, or whether such payments are simply the result of how two married persons at a certain stage of life have chosen to order their financial affairs, especially since each has 3 been married before, and Ms. Durkee has children from a prior marriage, are all separate factual and legal questions. Simply producing copies of cancelled checks payable to one's spouse and then claiming that such checks automatically constitute `rent" for an "apartment" in a marital domicile that could not even be legally occupied as a separate apartment is not a credible way of Ms. Durkee meeting her burden. Clearly, if litigation does become necessary, we will have to conduct extensive discovery on these and other issues through depositions of Ms. Durkee and Mr. Ruggles, and a lengthy production of documents by each of them, but again, the burden proof is on them not us, and I would simply challenge them, apart from all other factual and legal issues, to present you with evidence that there have been more than two families residing at the property during each of the last five years. I welcome Jake Segal's representation of Ms. Durkee in this matter, and I appreciate his copying me on his letters to you, although again, I would ask that he send me copies of the enclosures referenced in his March 6, 2003 letter as well. I disagree with him, however, when he says "I know that those situations involving neighbor disputes are always difficult for someone in a public position." We don't agree with the relevance of that statement at all. It may be difficult on a personal level for the neighbor involved, but as the City's zoning enforcement officer, that consideration should not effect you in your "public position" in the slightest. Instead, your job should be to enforce that ordinance, however difficult (or not) that may be. Let me say one other thing in this regard. When I attempted to speak with you on February 24, 2003 on this matter,you told me you were too busy to talk, even though you clearly were (and had been) socializing at the time. And when I asked you when you would be available to talk, you made it quite clear that you didn't want to listen to our side of the story, saying that you were too busy, and that in any event, you had already made up your mind that the property was a legal three family, and that indeed, a letter to that effect would be going out that afternoon or the following morning. For someone who is a public servant charged with the responsibility of enforcing the City's zoning ordinance,this was strange and upsetting behavior on your part to say the least. I subsequently relayed this to John Keenan, who agreed with me that as a matter of fundamental due process you have a duh++to listen to both sides of an issue before making 4 a determination, and I assume he relayed this to you as well. I also assume that he confirmed my statement of the relevant law in my February 24, 2003 letter. I infer from Mr. Segal's March 6, 2003 letter that it was you who requested this information. If so, I also infer that it means that you have come to the conclusion, unlike the one you articulated during our initial February 24, 2003 conversation, that at the very least, the factual and legal issues in favor of Ms. Durkee's claim are not so clear as you originally thought. I would like to think that my February 24, 2003 letter to you played a role, however much you then clearly didn't want to deal with me, my neighbors, or the issues raised in that letter. We are writing to you because we understand that the property located at 2 Andover Street, Salem, MA (hereinafter "2 Andover Street") has just been listed for sale as a three family dwelling by Hunneman-Coldwell Banker, notwithstanding the fact that the building is located in an R-2 zone. We also understand the basis for this listing is the owner's contention that the building has a grandfathered third floor apartment. For the reasons outlined in this letter we respectfully submit that the property is not a legal 3 family. At all material times we believe that 2 Andover Street has been owned by Patricia C. Durkee. As we assume you are aware, section 6 of Chapter 40A of the Massachusetts General Laws provides in relevant part the following: A zoning ordinance or bylaw may define and regulate nonconforming uses and structures abandoned or not used for a period of two years or more. [Emphasis added] The foregoing highlighted language was the result of a 1975 amendment to section 6 of Chapter 40A, which greatly simplified the test by which a grandfathered use could lose its protected status. Unlike the prior concept of abandonment, which could raise complicated issues of fact and/or law, the thrust of the 1975 amendment to Section 6 of Chapter 40A was to provide that a simple cessation for two years or more of a prior grandfathered non-conforming use would be sufficient to terminate its grandfathered status. On May 5, 1977 Article VIII, Sec. 8-5 (6) of the Salem City Zoning Ordinance was amended (in keeping with the 1975 amendment to Chapter 40A) to provide the following in relevant part: Any nonconforming use of land or structure and any nonconforming structure shall lose whatever rights might otherwise exist to continuation under the section if said use or structure shall be abandoned or not used for a period of two (2)years or more. [Emphasis added] A review of the records in your Department today indicates the following: By letter dated August 15, 1989 Robert E. Blenkhorn of the Salem Health Department wrote Ms. Durkee following an inspection of the 2 Andover Street property on August 8, 1989. Among the violations noted in the letter is the following: Noted second means of egress is a trap door in floor leading to a stairway. This is not a least egress according to the Building Inspectors. Contact Building Department for further information. [Emphasis added] Nearly four months later, on December 4, 1989, Assistant Building Inspector David J. Harris of your Department wrote Ms. Durkee the following letter in it entirety: Due to complaints from the Salem Health Department, an inspection was made at the above referenced property with the following findings: The third floor apartment has a 2 second means of egress, which is a trap door in the floor leading to a stairway. This stairway passes through the habitable area of the second floor apartment. This is in Violation of Mass State Building Code, Article 6, section 609.2 "number of exit ways." Please be advised that the third floor apartment cannot be occupied until the above violation is corrected. If you need further assistance please contact me at this office. [Emphasis added] As examination of the records at your Department today did not reveal gny indication that the violation cited by Mr. Harris was ever rectified. A further examination of the Annual Listing published by the City of Salem reveals that for the six-year period 1990-1995 inclusive the third floor apartment at 2 Andover Street was listed as"unoccupied" or there was no third floor apartment listed altogether. On information and belief, Ms. Durkee married Daniel B. Ruggles, III in April of 1998. A further examination of the Annual Listing published by the City of Salem for the five-year period 1998-2002 reveals only two units at the building, the occupants of which were listed as Patricia Durkee and Daniel B. Ruggles, III for "Unit 1," and Milagros Emmart as the sole occupant of"Unit 2." It would appear therefore that there are multiple independent reasons for concluding that any purported grandfathered third floor apartment at 2 Andover Street has long-since lost its protected status. For the 6-year period 1990-1996 the Annual Listing lists no third floor tenants of any kind, when all that is required is a cessation of two years to terminate the grandfathered status. Further, pursuant to Mr. Harris' December 4, 1989 letter, the third floor apartment was not a legal apartment because it violated Article 6, section 609.2 of the Massachusetts State Building Code and the owner was advised "that the third floor apartment cannot be occupied until the above violation is corrected." Thus, even if Ms. Durkee did in fact continuously rent the third floor apartment during the period 1990-1995, such occupancy would definitely have been a flagrant violation of Mr. Harris' December 4, 1989 letter and we question whether such 3 occupancy could as a matter of law be the basis for extending a purported grandfathered nonconforming use. But again, the facts as we know them, citing the Annual Listing in particular, are that there has been a cessation of the third floor apartment for well in excess of the required two years during the period 1990-1995 alone. But there is a separate basis for challenging the validity of any purported grandfathered third floor apartment at 2 Andover Street, and that relates to the five-year period 1998-2002 inclusive. For each of these five years the Annual Listing published by the City of Salem reveals only two apartments at 2 Andover Street, namely "Unit 1," occupied by Patricia Durkee and her husband, Daniel B. Ruggles, III, and "Unit 2," occupied by Milagros Emmart. Since pursuant to Mr. Harris' December 4, 1989 letter the third floor could not be legally occupied as a separate apartment unless the lack of a second means of egress was rectified, and since there was nothing in the file today which would indicate that this was in fact ever rectified, we assume that as a matter of law the third floor became part of the owner's unit, which would agree with the designation in the Annual City Listing for each of the five years between 1998 and 2002 inclusive. To contend that Mr. Ruggles while married to Ms. Durkee occupied a third floor apartment that the City had previously ruled could not be occupied as a separate apartment, and attempt to use this as the basis for arguing no 2 year cessation of the nonconforming third apartment use, is a"stretch" on so many levels as to not deserve serious discussion. Finally, we assume you are aware that as a matter of Massachusetts law the burden of proof is on the party asserting that he or she is entitled to a grandfathered nonconforming use, and not on those seeking to have the zoning ordinance enforced. *�' I regret that you were not able to take the time this morning from socializing with former building inspector Peter Strout to discuss this matter more filly, but at least I had an opportunity to briefly apprise you of the foregoing prior to your sending out any opinion letter one way of the other.
