Bilodeau 10 Ames Street Salem, MA 01970 RE:' 11 Ames Street Dear Sir, In response to your letter dated May 28, 1986 concerning the activity of the property at 11 Ames Street the following is determined. It is the opinion of this office after consultation with the City Solicitor that storage and repair of lobster traps does not constitute a business. Sale of said traps or their product would constitute a business and would warrent further action by this department. Furthermore the person in question is licensed to have unlimited traps and has permits for the ramp and float in question. No further action by this department is warrented in our opinion at this time. Should you have any questions pertaining to our discussidn, ;feel free to contact us. Please be advised that you may appeal our decision to the Board of Appeals. • Respect , g r aquin, Maurice M. Martineau Asst. Building Inspectors c.c. : file, City Clerk, Councillor Harvey, City Solicitor Otv of : . Puarb of ApPa1 '81 JAN -2 A9 :20 CITY CLERK',-) ICE SAI FM ' S DECISION ON THE PETITION OF STEPHEN G & MADELEINE BILODEAU REQUESTING A VARIANCE FOR 10 AMES STREET A hearing on this Petition was held on December 17, 1980, with the following Board Members present:. Douglas Hopper, Chairman; Messrs, Piemonte, LaBrecque, Feeherry and Hacker. Notices of the hearing were sent to abutters and others and a notice of the hearing was published in the Salem Evening News on December 3, and December 10, 1980 in accordance with Massachusetts General Laws, Chapter 40A. The Petitioners are requesting a variance for the property at 10 Ames Street to permit construction of a two-car garage with a three-room apartment on the second level and an 8 foot addition to the rear of the existing single family dwelling at the site. A variance is required because the proposed construction . would violate density regulations in an R-2 district, as well as front, rear and side yard restrictions. The Board of Appeals, after consideration of the evidence presented at the public hearing and after viewing the property makes the following findings of fact: 1. . The property is in an R-2 district where the proposed use(i.e.two family dwelling) is allowed. 2. The proposed use is unopposed by abutters. 3. The property in question is unique because of its peculiar shape and size. On the basis of the above findings of fact, and the evidence presented at the public hearing, the Board of Appeals concludes as follows: 1. The property in question is unique because of its size and shape. 2. The conditions described above especially affect the property in question but do not generally affect the zoning district in which the building is located. 3. The conditions described above which affect the land in question, but not the zoning district generally cause the following special hardship: Unless the requested variance is given, the property cannot be used in a manner consistent with R-2 zoning. 4. The desired variance may be granted without substantial detriment to the public good. The Board grants a variance to the petitioners on the following terms and conditions: 1. A variance is given from density requirements and front, rear and side yard restrictions. 2. A certified plot plan and a set of drawings acceptable to the Building Inspector shall be provided to the Building Inspector before any construction commences. GRANTED - WITH CONDITIONS Anthony M.
