BUILDING CODE APPEALS BOARD DOCKET NO. 15-1568 ) John Spillane, ) Appellant ) ) V. ) City of Salem, ) Appellee ) DECISION Introduction This matter came before the State Building Code Appeals Board ("Board") on Appellant's appeal application filed pursuant to G.L. c. 143, §100 ("Application"). Appellant John Spillane sought relief from 780 CMR 1009.1, with respect to the installation of a chair lift device in a common stairway of a building located at 18-1 America Way, Salem, MA ("Appeal"). Procedural History On or about October 14, 2015, the Building Commissioner for the City of Salem denied issuing a building permit for the installation of a battery-operated stair lift at 18-1 America Way because the installation would reduce the required stairway width under 780 CMR 1009.1. As a result, the Appeal was filed on October 21, 2015. The Board held the hearing on November 5, 2015. All interested parties were allowed . opportunities to present evidence. The following individuals appeared at the hearing: (for Appellant: Paul Spillane); (for Appellee: Thomas St. Pierre,Building Commissioner) (for the Board: Richard Crowley, Jennifer Hoyt, and John Couture; Board Clerk: Patricia Barry). We also considered the following evidence: (1) State Building Code Appeals Board Appeal Application (filed October 21, 2015), including two-page brochure by Stannah Stairlifts Inc. Findings and Discussion The issue arose because Appellant would like to install a stair lift to serve his condominium unit in a common stairway, given his mobility limitations (from, for example, 1 having two knee replacements and a hip replacement). As a result of the installation,the clear width would be 29 inches, while the required width is 36 inches in these circumstances. See 780 CMR 1009.1, Exception 1. The building has three stories. Appellant's unit is located below grade and is described as a garden-type unit. Thus, the stair lift would be installed to assist Appellant from his unit to grade via what he described as the primary means of egress. The stairway area in which the device would be installed contains 16 to 17 steps. Another garden- type unit shares the same stairway with Appellant. Both of these garden-type units have second means of egress through back doors leading to back yards. But Appellant noted that exiting to the back yard,to reach Appellant's parking space, was difficult (if not impossible) during parts of last winter with snow build-up in the yard. Appellant represented that his condominium association had been notified about the proposed stair lift installation and there are no objections from fellow unit owners. The City represented that the installation of the stair lift would not impair safety operations via the stairway. The City also noted that the rear yard egress must be maintained, and that, if snow clearance became difficult, Appellant should notify the City for assistance to maintain egress to the back yard. Conclusion Accordingly, based on the specific on the specific facts of the Appeal, we considered a motion to allow a variance from 780 CMR 1009.1, on condition that the second means of egress, for each of the garden-type units that share the stairway in which the stair lift will be installed, must be maintained and kept clear to the back yard throughout the year ("Motion"). The Motion was approved by unanimous vote, and the Appeal is ALLOWED with condition.
