Dear Mr. Greenbaum:
As discussed, schedule conflicts will not permit us to participate during the re-scheduled public hearing
date of September 15,2009. Therefore, on behalf of Northside Carting and the City of Salem,we request
that the public hearing be postponed until such time as we have had the opportunity to address all of the
questions raised by the Board and their Technical and Legal Review Consultants. At this time, we are
aware that the Board's Technical Consultant, David Murphy of Tighe &Bond,has requested information
regarding the following items:
• Basis for the determination that a"Minor Permit Modification"of the original Site Assignment is
the appropriate compliance pathway under the MADEP's Site Assignment Regulations;
• The calculation for the technical review fee under 310 CMR 16.30;
• The "Record of Documents" submitted in support of the application for the minor permit
modification; and
• The cost estimates related to closure of the landfill and construction of the new transfer station.
We are currently compiling the requested information and expect to have formal responses to the requests
later this week. Once the Board and their Consultants have had an opportunity to discuss the responses
(no new information), we respectfully request the opportunity to meet with representatives from the City
Solicitor's Office,the Conservation Commission,the Board of Health and their Consultants in advance of
the public hearing to more fully address any questions or concerns they may have. Please call me with

#2) Delete reference to federal holidays.
#3) Basis for 110,400? The original NSC proposal, as discussed during negotiations with the City,
was for an average of 400 TPD for six days per week, or 126,400 tons. The negotiated number
should be inclusive of MSW, CSW and C&D..........MSW is not defined, as stated, under DEP
definitions. The actual number of trips also needs to be negotiated.....It was stated at the meeting
that the number of resident vehicles, presumably including residents dropping off recyclables)was
not to be included in this number.
#7) NSC agreed to sweping to First Street, not to Robinson.
#9) Clarification: The site is to be closed under the SW regs....Any reference to the MCP is for new
releases(i.e. hydraulic oil >10 galons, etc.) Change "remedial'to"response"
#15) Exempt residential drop off of regulated materials. We also discussed temorary storage of
C&D outside(covered).
#20) Delete last sentence. NSC cannot be held responsible for enforcement, but agrees to respond
to complaints from BOH about trucks.

As discussed, BETA is compiling a Memorandum to outline the regulatory compliance process and proposed
permitting time line for dealing with the following items under the DEP's Solid Waste regulations:
• Site Assignment, and
• Application for an increase in tonnage for the new Salem Transfer Station.
The Permitting Memorandum will be provided to you the middle of next week(August 8th+/-). In the meantime,
we will try to set up a brief meeting with John Carrigan of the DEP to confirm the process and time line with him.
Ideally, that meeting will occur prior to the next BOH Meeting on August 14th.
Also, we discussed the possibility of a site visit with available BOH members prior to the BOH Meeting on the
14th. I would be available to participate in that meeting at the convenience of the BOH members, on one of the
following days: Wednesday, August 8th (anytime), Thursday, August 9th (conclude prior to 4:00 PM) and
Monday, August 11th (anytime).

On behalf of Northside Carting and the City of Salem, I would like to discuss our proposed permitting plan for the
proposed Salem Transfer Station to be located at the existing Incinerator/Transfer Station site on Swampscott
Road. The permitting discussion involves both the current site assignment(minor modification has been
suggested)and the proposed increase in tonnage from 100 TPD to 400 TPD (public meeting). I have been
discussing the permitting with John Carrigan of DEP-NERD and he suggested that we contact you to further
discuss the permitting time line and compliance pathway for the new transfer station.

Ave. We have a copy of this in the Planning Board Files. It was done by GPI and is called "Traffic Impact
and Access Study Proposed Mixed-Use Development Salem, Massachusetts, March 2004".
Its spiral bound and about 30 or 40 pages. Please let know if we should copy this for you for pick up or

Dear Board Members:
The City has asked for proposals from those interested in purchasing the Transfer Station land,
with provisions for municipal trash collection, etc. North Side Carting, the existing trash hauler for
Salem and who currently operates the facility. The Board did this many years ago for this
location and in the minutes of the meeting refers to the property shown on an engineers map as
"Section 8." No one has any knowledge of what Section 8 is! Therefore, our current Board needs
to make that determination.
Below, you will see an e-mail from a consultant for North Side Carting who is working through the
permitting process. I suggested that in order to make the most informed decision about this
siting, I would need to have a site visit and probably Board members may want to go also.
Please see the times for next week and the following Monday listed below by Alan Hanscom.

My Chairperson is available on Monday morning so let's schedule at time to meet there.
Can we get an Arial map showing the area and delineating where we think the property
boundaries are. Also, who owns the bordering properties? Maybe the best way to see what is
included is to see what is left when we account for those other properties. Plus, it would be
difficult to site an are to find later that it is owned by someone else!
