f ORDER OF CONDITIONS DENIAL
Dear Mr. Giacalone:
The Salem Conservation Commission has completed its review of DEP file#64-323 (Almeda Street)and
has concluded that the project cannot be conditioned to assure protection of the interests of the Wetlands
Protection Act. Therefore,under the provisions of the regulations, 310 CMR 10.05 (6)(b),the
Commission hereby denies the proposed project. This denial is based on the Commission's conclusion
that the project, as presently designed,does not meet the Performance Standards for activity in Bordering
Vegetated Wetlands, specifically, ground water supply,prevention of pollution, and wildlife habitat.
Further,the Commission does not believe that the Performance Standard for Private Water Supply is met.
The work entails the construction of a drive extension with utilities to provide access to an
existing lot and the construction of a single-family dwelling. The project will impact about 40 square feet
of Bordering Vegetated Wetland(filling) and 147 square single-family house(Lot 49)that has a private
well. An adjacent lot to the east of Lot 49 (Lot 48) also has a private well on it. To the northeast a pond
with a bordering vegetated wetland(BVW)exists.
Several issues have led the Commission to deny this project based upon its belief that the
Performance Standards cannot be met and they are as follows:
1. The applicant proposed to fill 40 square feet of BVW and replace with 147 square feet of
BVW. However, a portion of the replacement area appears to be on Conservation property
that was deeded to the City of Salem in 1996 for"Conservation Purposes". The Commission
was very clear that it would not support any alteration of any resource area on Conservation
property. Unfortunately, the plans are difficult to read due to the amount of information
provided on the plan. It was suggested by the Commission Agent that a cleaner plan be
provided to the Commission. Further, it has not been made completely clear in the
Commission's mind if all the work involved would be on the applicant's property;
2. The resource area is very fragile, and the Commission believed that if any work occurred
within or near the BVW,the ecosystem would be compromised, specifically, wildlife habitat
and groundwater supply;
3. The installation of the box culvert and the maintenance of the roadway once the culvert was
installed was also a concern of the Commission as it is part of the BVW to be filled. The
Commission was concerned that the construction of the wall could not be built without

impacting the Conservation area or without working within this area. The construction
methodologies were not clear in knowing the amount of fill to be brought it,what might be
encountered with excavation, i.e. ledge, etc. and how that would be handled;
4. Concerns were raised about the use of deicing material and the proximity to the BVW. The
BVW will be directly abutting this driveway. The Commission did not believe that the
Performance Standard for Prevention of Pollution was met due to the need for deicing
material and/or sand to be used in winter on the driveway, and the probable use of chemicals
to the lawn and how that would be monitored to ensure that this would not occur. Further,
the Commission had a concern that vehicles could accidentally slide or drive off the road in
certain weather conditions. As you will note,the roadway is 13.5 feet in width and this does
not leave much room for error if a skid occurs. The Commission had asked for more of an
area for a buffer,however,there was none to give. The 13.5 feet is the area that the applicant
has to provide for the roadway;
5. The Commission was not convinced that private well supplies are protected. The
Commission was concerned that blasting or any other alteration of the ledge in the vicinity
may impact the private wells that are located directly to the east(Lot 49) and the next abutter
(Lot 48);
6. The Commission was also VERY concerned with the Performance Standard that applies to
groundwater. The Commission believed that any impact on this BVW would have an impact
on this very fragile resource area. The BVW borders on a very shallow pond and the
Commission again believed that any work,i.e. alteration of the BVW,blasting,rock splitting
or backhoe mounted hoe rams could affect the pond. The Commission believes that any
deviation in the bedrock could have a detrimental effect on the pond; and
7. Wildlife habitat was another Performance Standard that was not met in the Commission's
opinion. Again,if anything happened to the pond, the wildlife habitat could be severely
affected as it provides food, shelter, and migratory functions.
In summary,the Commission believed that any alteration to this area would affect the Bordering
Vegetated Wetland,the pond, the ground water supply,private well supplies,wildlife habitat and the
applicant would be unable to prevent pollution to the resource area. We believe that this is a very fragile
resource area that is in need of diligent and full protection.

B. Findings
Findings pursuant to the Massachusetts Wetlands Protection Act:
Following the review of the above-referenced Notice of Intent and based on the information provided in
this application and presented at the public hearing, this Commission finds that the areas in which work is
proposed is significant to the following interests of the Wetlands Protection Act. Check all that apply:

work shall be performed in accordance with the Notice of Intent referenced above, the following
General Conditions, and any other special conditions attached to this Order. To the extent that the
following conditions modify or differ from the plans, specifications, or other proposals submitted with
the Notice of Intent, these conditions shall control.
Denied because:
® the proposed work cannot be conditioned to meet the performance standards set forth in the wetland
regulations to protect those interests checked above. Therefore, work on this project may not go
forward unless and until a new Notice of Intent is submitted which provides measures which are
adequate to protect these interests, and a final Order of Conditions is issued.
❑ the information submitted by the applicant is not sufficient to describe the site, the work, or the effect
of the work on the interests identified in the Wetlands Protection Act. Therefore, work on this project
may not go forward unless and until a revised Notice of Intent is submitted which provides sufficient
information and includes measures which are adequate to protect the Act's interests, and a final
Order of Conditions is issued. A description of the specific information which is lacking and why it is
necessary is attached to this Order as per 310 CMR 10.05(6)(c).
General Conditions (only applicable to approved projects)
1. Failure to comply with all conditions stated herein, and with all related statutes and other regulatory
measures, shall be deemed cause to revoke or modify this Order.
2. The Order does not grant any property rights or any exclusive privileges; it does not authorize any
injury to private property or invasion of private rights.
3. This Order does not relieve the permittee or any other person of the necessity of complying with all
other applicable federal, state, or local statutes, ordinances, bylaws, or regulations.

4. The work authorized hereunder shall be completed within three years from the date of this Order
unless either of the following apply:
a. the work is a maintenance dredging project as provided for in the Act; or
b. the time for completion has been extended to a specified date more than three years, but less
than five years, from the date of issuance. If this Order is intended to be valid for more than three
years, the extension date and the special circumstances warranting the extended time period are
set forth as a special condition in this Order.
5. This Order may be extended by the issuing authority for one or more periods of up to three years each
upon application to the issuing authority at least 30 days prior to the expiration date of the Order.
6. Any fill used in connection with this project shall be clean fill. Any fill shall contain no trash, refuse,
rubbish, or debris, including but not limited to lumber, bricks, plaster, wire, lath, paper, cardboard,
pipe, tires, ashes, refrigerators, motor vehicles, or parts of any of the foregoing.
7. This Order is not final until all administrative appeal periods from this Order have elapsed, or if such
an appeal has been taken, until all proceedings before the Department have been completed.
8. No work shall be undertaken until the Order has become final and then has been recorded in the
Registry of Deeds or the Land Court for the district in which the land is located, within the chain of title
of the affected property. In the case of recorded land, the Final Order shall also be noted in the
Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to
be done. In the case of the registered land, the Final Order shall also be noted on the Land Court
Certificate of Title of the owner of the land upon which the proposed work is done. The recording
information shall be submitted to this Conservation Commission on the form at the end of this Order,
which form must be stamped by the Registry of Deeds, prior to the commencement of work.
9. A sign shall be displayed at the site not less then two square feet or more than three square feet in
size bearing the words,
"Massachusetts Department of Environmental Protection" [or, "MA DEP"]
"File Number "
10. Where the Department of Environmental Protection is requested to issue a Superseding Order, the
Conservation Commission shall be a party to all agency proceedings and hearings before DEP.
11. Upon completion of the work described herein, the applicant shall submit a Request for Certificate of
Compliance (WPA Form 8A) to the Conservation Commission.
12. The work shall conform to the plans and special conditions referenced in this order.
13. Any change to the plans identified in Condition #12 above shall require the applicant to inquire of the
Conservation Commission in writing whether the change is significant enough to require the filing of a
new Notice of Intent.
14. The Agent or members of the Conservation Commission and the Department of Environmental
Protection shall have the right to enter and inspect the area subject to this Order at reasonable hours
to evaluate compliance with the conditions stated in this Order, and may require the submittal of any
data deemed necessary by the Conservation Commission or Department for that evaluation.

15. This Order of Conditions shall apply to any successor in interest or successor in control of the
property subject to this Order and to any contractor or other person performing work conditioned by
this Order.
16. Prior to the start of work, and if the project involves work adjacent to a Bordering Vegetated Wetland,
the boundary of the wetland in the vicinity of the proposed work area shall be marked by wooden
stakes or flagging. Once in place, the wetland boundary markers shall be maintained until a
Certificate of Compliance has been issued by the Conservation Commission.
17. All sedimentation barriers shall be maintained in good repair until all disturbed areas have been fully
stabilized with vegetation or other means. At no time shall sediments be deposited in a wetland or
water body. During construction, the applicant or his/her designee shall inspect the erosion controls
on a daily basis and shall remove accumulated sediments as needed. The applicant shall immediately
control any erosion problems that occur at the site and shall also immediately notify the Conservation
Commission, which reserves the right to require additional erosion and/or damage prevention controls
it may deem necessary. Sedimentation barriers shall serve as the limit of work unless another limit of
work line has been approved by this Order.

C. Appeals
The applicant, the owner, any person aggrieved by this Order, any owner of land abutting the land subject
to this Order, or any ten residents of the city or town in which such land is located, are hereby notified of
their right to request the appropriate DEP Regional Office to issue a Superseding Order of Conditions.
The request must be made by certified mail or hand delivery to the Department, with the appropriate filing
fee and a completed Appendix E: Request of Departmental Action Fee Transmittal Form, as provided in
310 CMR 10.03(7)within ten business days from the date of issuance of this Order. A copy of the request
shall at the same time be sent by certified mail or hand delivery to the Conservation Commission and to
the applicant, if he/she is not the appellant.
The request shall state clearly and concisely the objections to the Order which is being appealed and how
the Order does not contribute to the protection of the interests identified in the Massachusetts Wetlands
Protection Act, (M.G.L. c. 131, §40) and is inconsistent with the wetlands regulations (310 CMR 10.00).
To the extent that the Order is based on a municipal ordinance or bylaw, and not on the Massachusetts
Wetlands Protection Act or regulations, the Department has no appellate jurisdiction.
D. Recording Information
This Order of Conditions must be recorded in the Registry of Deeds or the Land Court for the district in
which the land is located, within the chain of title of the affected property. In the case of recorded land, the
Final Order shall also be noted in the Registry's Grantor Index under the name of the owner of the land
subject to the Order. In the case of registered land, this Order shall also be noted on the Land Court
Certificate of Title of the owner of the land subject to the Order of Conditions. The recording information

Enclosed please find copies of the City of Salem laying a portion of Atmeda Street as a
public way and Plan dated July 10, 1952 and recorded in the Essex South Registry of Deeds at
Book 3909,Page 441.The City of Salem took only 347 feet of Almeda Street from Highland
Avenue as a public way. Comparing the 1952 Almeda Street acceptance plan with Salem
Assessors Map 14,the public portion of Almeda Street terminates in front of Lot 14-0113.
I The rest of Almeda Street,both built and un-built,is a private way.
j As noted in my November 27,2001,letter to the Salem City Council pursuant to G.L. c.
183,§58 Giacalone Construction Co. has the right access his property,subject to the
Superccding Order of Conditions issued by the Massachusetts Department of Environment
Protection and the terms of the Agreement for Judgment with the Salem Conservation
Commission.
Unless you or City Solicitor Gilbert can paint me any law to the contrary I do not believe
that the City of Saletm can prohibit Giacalone Construction Co. from constructing the access to
his property or installing utilities in the way(See,G.L. c. 187,§5).

Please see the attached January 13, 2006 letter from Thomas Carnevale, of R.C. Realty Construction&
Development,LLC. Bruce and I met with Mr. Carnevale,just before Christmas 2005 and discussed the project
briefly. Since that meeting,Mr. Carnevale has been supplied with the latest documents on file with Frank
regarding ConComm issues, namely a revised set of plans and the legal language drafted prior to this latest
ownership transition.
In order to start the project off in good stead with the City, Mr. Carnevale is asking for a letter of acceptance
regarding aspects of the project already constructed. I suggest that we all meet to go over the project with the
latest set of plans on-site, since it has been a while since the project was last active. This will allow us to
respond in a more certain manner and have a clear understanding of the work going forward.
I know there are still issues with ConCom compliance and the actual construction. A bond has to be supplied
in the amount stipulated by the legal agreement,the roadway width and alignment should be reviewed again
and the order of construction(blasting,wall construction&wetlands mitigation)needs to be discussed.
Frank, since you've had the most involvement with this project, I ask that you please take the lead on this
moving forward, at least in arranging a meeting on-site.

This is an appeal from a Form C—Definitive Decision(hereinafter"Decision") of the
City of Salem,Massachusetts Planning Board(hereinafter"Salem Planning Board"or"Planning
Board"), dated August 2, 2016, and filed with the Salem, Massachusetts City Clerk on August 2,
2016, concerning 14 and 16 Almeda Street(Assessor's Map 14,Lots 116 and 117), Salem,
Massachusetts, which lots and proposed Almeda Street road extension, are located in an R-1
(single family) zoning district, on the grounds that said Decision was arbitrary, capricious,
unreasonable, violated due process, exceeded the Planning Board's authority, was based on
legally and factually untenable grounds, and was wrong as a matter of law.
A certified copy of said August 2, 2016 Decision is attached hereto as Exhibit A.
PARTIES
Plaintiffs
1. Plaintiff Donald A. Harlow-Powell is the husband of Plaintiff Maria A. Amador de
Harlow-Powell. Together they own and reside at 12 Almeda Street, Salem,
Massachusetts (hereinafter"12 Almeda Street"), which property directly abuts the
unimproved lots at 14 Almeda Street, Salem, Massachusetts 01970 (hereinafter"14
Almeda Street") and 16 Almeda Street, Salem, Massachusetts 01970 (hereinafter"16
Almeda Street"), which lots are also known as Assessor's Map 14, Lots 116 and 117
respectively.
2. Plaintiff Maria A. Amador de Harlow-Powell is the wife of Plaintiff Donald A. Harlow-
Powell. Together they own and reside at 12 Almeda Street, which property directly abuts
the unimproved lots at 14 Almeda Street and 16 Almeda Street, and is located within the
300-foot notice requirement of the Salem Zoning Ordinance.
Defendants
3. Defendant, Town and Country Homes, Inc. (hereinafter"Town and Country") is a
corporation located at 532 Lowell Street, Peabody, Massachusetts 01960 which filed on
August 27, 2015 the "Form C Application For Tentative Approval Of Definitive Plan"
concerning 14 and 16 Almeda Street with the Salem Planning Board which ultimately
resulted in the August 2, 2016 Form C—Definitive Subdivision Decision of the Salem
Planning Board being appealed.
4. Defendant, George D. Belleau, whose residence is believed to be 21A Ye Olde County
Road, Gloucester, Massachusetts 01930, is the owner of the unimproved lot at 16 Almeda
Street, and is believed to be a principal of Town and Country.
5. Defendant, Veronica M. Belleau, whose residence is believed to be 2 1 A Ye Olde County
Road, Gloucester, Massachusetts 01930, is the owner of the unimproved lot at 14 Almeda
Street.
6. Defendant, Matt Veno (according to the August 2, 2016 Salem Planning Board
Decision), a/k/a Matthew Veno (according to the updated 8/16/2016 official roster of
Salem Planning Board members), who resides at 20 Forest Avenue #3, Salem,
Massachusetts 01970, is a regular member and the Vice Chair of the Salem Planning
Board who voted in favor of the August 2, 2016 Decision of the Salem Planning Board
being appealed.
7. Defendant, Helen Sides, who resides at 35 Broad Street, Salem, Massachusetts 01970, is
a regular member of the Salem Planning Board who voted in favor of the August 2,2016
Decision of the Salem Planning Board being appealed.
8. Defendant, Kirt Rieder, who resides at 15 Warren Street, Salem, Massachusetts 01970,is
a regular member of the Salem Planning Board who voted in favor of the August 2,2016
Decision of the Salem Planning Board being appealed.

13. Defendant, Ben Anderson, who resides at 10 Adams Street, Salem, Massachusetts 01970,
is a regular member and the Chair of the Salem Planning Board who did not participate in
the July 21, 2016 vote which ultimately resulted in the August 2, 2016 Decision of the
Salem Planning Board being appealed.
14. Defendant, Antonio Mataragas, who resides at 19 Pickman Road, Salem, Massachusetts
01970, is a regular member of the Salem Planning Board who did not participate in the
July 21, 2016 vote which ultimately resulted in the August 2, 2016 Decision of the Salem
Planning Board being appealed.
15. Plaintiffs Donald A. Harlow-Powell and Maria A. Amador de Harlow-Powell have
standing to bring this action, as they are substantially aggrieved by the August 2, 2016
Decision of the Salem Planning Board being appealed.
JURISDICTION
16. This Court has jurisdiction over this matter pursuant to Section 17 of Chapter 40A of the
Massachusetts General Laws.
17. This case is timely, as it has been filed within twenty (20) days from August 2, 2016,
which is when the August 2, 2016 Decision of the Salem Planning Board was filed with
the Salem City Clerk.
PROCEDURAL HISTORY AND FACTUAL ALLEGATIONS
18. By deed dated September 16, 2014, recorded at Book 33546, Page 134 at the
Essex South Registry of Deeds, Defendant George D. Belleau acquired sole title to
the unimproved lot at 16 Almeda Street "in full consideration of Twenty Thousand
Dollars ($20,000.00)."
19. By deed dated September 30, 2014, recorded at Book 33577, Page 10 at the
Essex South Registry of Deeds, Defendant Veronica M. Belleau acquired sole title
sole title to the unimproved lot at 14 Almeda Street "in full consideration of Fifty
Thousand Dollars ($50,000.00)."

20. Defendants George D. Belleau and Veronica M. Belleau are believed to be
husband and wife.
21. At 2:56 p.m. on August 27, 2015 Defendant George Belleau in behalf of
Defendant Town and Country filed the "Form C Application For Tentative Approval
Of Definitive Plan" concerning 14 and 16 Almeda Street with the Salem Planning Board
which ultimately resulted in the August 2, 2016 Form C—Definitive Subdivision
Decision of the Salem Planning Board being appealed.
22. According to the 8/27/15 "Existing Conditions Plan"prepared by Griffin Engineering
Group,LLC in support of said Form C Application, 14 Almeda Street is an unimproved
lot of land consisting of 5,819 square feet of land and 16 Almeda Street is an unimproved
lot of land consisting of 5,117 square feet of land.
23. Both lots are located in an R-1 (single family)Zoning District, which involves(in
relevant part)the following dimensional requirements:
a. The"minimum lot area"is fifteen thousand(15,000) square feet, as compared with
5,819 square feet for 14 Almeda Street (which is only 38.79% of said required
minimum), and 5,117 square feet for 16 Almeda Street(which is only 34.11%of said
required minimum);
b. The"minimum lot frontage" is one hundred(100) feet, as compared with 62.80 feet
for 14 Almeda Street(which is only 62.80% of said required minimum) and 52.26
feet for 16 Almeda Street(which is only 52.26% of said required minimum).
c. The"minimum lot width" is one hundred(100) feet. The maximum lot width of 14
Almeda Street is 87.63 feet, and that only exists at the extreme rear lot line. The
maximum width of 16 Almeda Street is 55.26 feet, and that likewise only exists at the
extreme rear lot line.
24. On information and belief, based on the proposed construction shown on Plan C-2 of the
8/27/15 "Site &Utilities Plan"prepared by Griffin Engineering Group, LLC in support of
Town and.Country's Form C Application, both 14 Almeda Street and 16 Almeda Street
will ultimtely require zoning relief from the Salem Zoning Board of Appeals from one
or more of the following dimensional requirements for any structures proposed to be built
in an R-I Zoning District:
a. The"maximum height restriction" is 3'/s stories;
b. The"minimum depth of front yard" is fifteen(15) feet;
c. The"minimum width of side yard" setbacks are ten (10) feet;
d. The "minimum depth of rear yard" is thirty (30)feet;

e. The "maximum height of buildings" is thirty-five(35 feet) and 2.5 stories;
f. The"minimum lot coverage by all buildings"is 30%.
25. On September 17, 2015 the Salem Planning Board opened a Public Hearing on Town and
Country's August 27, 2015 Application to allow construction of a roadway and
associated utilities to service two existing undeveloped lots at 14 Almeda Street and 16
Almeda Street.
26. On July 21, 2016, by a vote of 7 to 0, the Salem Planning Board voted to close the Public
Hearing and to approve the subdivision plan, subject to certain conditions. Chair Ben
Anderson and Member Antonio Mataragus did not participate in said vote.
27. The resulting August 2, 2016 Decision of the Salem Planning Board was filed in the
office of the Salem Massachusetts City Clerk on the same day.
28. Almeda Street is currently a narrow dead end street consisting of seven(7) single-family
homes, i.e. six on the even-numbered southerly side of the street and one on the odd-
numbered northerly side of the street (due to the so-called"Andy's Pond" on the balance
of said northerly side).
29. By deed dated December 1, 2008,the Plaintiffs acquired title to their single-family home
and lot at 12 Almeda Street for$528,888.88.
30. The Plaintiffs' lot area at 12 Almeda Street consists of 10,331 square feet, or
approximately double the lot area of 14 Almeda Street and also approximately double the
lot area of 16 Almeda Street.
31. Currently Almeda Street only extends to 12 Almeda Street. Beyond 12 Almeda Street
the area is mainly ledge, scrub land, and forest.
32. Both the unimproved lots at 14 Almeda Street and 16 Almeda Street, and another
undersized lot at 18 Almeda Street, are currently inaccessible to vehicles.
33. Development of 14, 16, and 18 Almeda Streets are also further complicated by a 100 foot
"Buffer Zone," further reducing the portion of each lot that can be built upon.
34. In August and September of 1986 the last house on Almeda Street was the current 6
Almeda Street.
35. The Minutes of the August 14, 1986 Meeting of the Salem Planning Board concerning 8
Almeda Street recited the following in relevant part:
Chairman Walter Power suggested that a cul-de-sac might solve
the problem of adequate frontage and turn around, and would

also be within an adequate distance from the pond. He also added
that the Fire Department would have to make the final decision
on the dimensions of the cul-de-sac, but that it could be
approximately 90'. Emphasis added.
36. Said 90 foot-diameter was subsequently implemented and construction of single-family
homes at 8 and 10 Almeda Street (as approved)was built.
37. The Plaintiffs' current property at 12 Almeda Street is the result of combining two former
"paper lots" of approximately 5,000 square feet each, as required by the then Planning
Board in 2004 as a condition of permitting construction of the current 12 Almeda Street.
38. The same policy considerations that required the approximate 90-foot diameter turning
circle in 1986 exist now.
39. Indeed, those policy considerations are now even more compelling and urgent because if
14, 16, and 18 Almeda Street are developed there will be no turning radius for fire
apparatus (including hook and ladder trucks), other emergency vehicles, snow plows, or
other vehicles belonging to the the public at large to turn around in, including the
condition in the August 2,2016 Decision that the owner of 16 Almeda Street grant an
easement to the Salem Fire Department to permit its vehicles to tum around on its
property. What about delivery and other trucks, and vehicles coming up Almeda Street
not realizing the street is a dead end?
40. The August 2, 2016 Decision of the Salem Planning Board made no adequate provision
for such a turn-around at the end of either 16 or 18 Almeda Street.
41. Nor does said Decision make any provision for lighting the extended portion of Almeda
Street, as requested by the Plaintiffs.
42. Cars coming up Almeda Street whose drivers are unaware that Almeda Street is a dead-
end street are currently a constant nuisance and menace.
43. As shown on both the 8/27/15 "Existing Conditions Plan," Plan Sheet C-1, and the"Site
& Utilities Plan," Plan Sheet C-2,prepared by Griffin Engineering Group, LLC in
support of Town and Country's Form C Application, the distance said vehicles will have
to back up is 52.26 feet opposite 18 Almeda Street, 52.26 feet opposite 16 Almeda Street,
45.70 feet opposite 14 Almeda Street, and a further 190.20 feet to the turning circle
opposite 8 Almeda Street, or altogether approximately 340.42 feet, or more than a
football field in length.
44. The dangers of such vehicles backing up such a distance, especially to young children,
should have been apparent, but despite the attempts of the Plaintiffs, was not taken into
account by the Planning Board in its August 2, 2016 Decision.

45. As to each of the following Counts, the Plaintiffs reaffirm, re-allege, and incorporate all
of the prior allegations contained in paragraphs 1-44 inclusive above.
ARGUMENT
COUNTI
THE EXTENDED ALMEDA STREET ROADWAY AS APPROVED BY THE SALEM
PLANNING BOARD IN ITS AUGUST 2,2016 DECISION CREATES AN
INTOLERABLY UNSAFE,INADEQUATE,AND IMPRACTICAL SITUATION
46. Town and Country's August 27, 2015 Application was brought pursuant to the following
Sections of the Salem Subdivision Regulations: Section IV.A.4.a(relating to dead end
street longer than 500 feet), Section IV.A.Le (relating to minimum centerline radius of
less than 230-feet), and Section IV.A.2.a(relating to minimum roadway improvements
not met).
47. The proposed 35-foot by 20-foot so-called "hammerhead tum around area" approved by
the Salem Planning Board in its August 2, 2016 Decision is completely and intolerably
unsafe, inadequate, and impractical.
48. The Board should have approved a tum around area more or less equivalent to the one the
then Planning Board approved in 1986 opposite 8 Almeda Street.
49. All other issues aside, by establishing one required tum around area in 1986 opposite 8
Almeda Street, and a grossly smaller one in 2016 opposite 16 Ahneda Street
approximately 340.42 feet away, the Salem Planning Board acted arbitrarily,
capriciously, and unreasonably.
50. The same policy considerations that required the approximate 90-foot diameter turning
circle in 1986 exist now.
51. Indeed,those policy considerations are now even more compelling and urgent because if
14, 16, and 18 Almeda Street are developed there will be no adequate turning radius for
fire apparatus (including hook and ladder trucks), other emergency vehicles, snow plows,
or other vehicles belonging to the the public at large to turn around in.
52. Cars coming up Almeda Street whose drivers are unaware that Almeda Street is a dead-

should have been apparent, but despite the attempts of the Plaintiffs, was not taken into

54. For the foregoing reasons alone, the Salem Planning Board exceeded its authority in
approving said August 2, 2016 Decision and said Decision must be annulled in its
entirety.
COUNT II
THE PLANNING BOARD'S AUGUST 2, 2016 DECISION VIOLATES THE
LETTER AND SPIRIT OF SITE PLAN REVIEW
55. Although Site Plan Review is not technically required pursuant to Section 9.5.2 (entitled
"Applicability") of the Salem Zoning Ordinance, because the proposed residential
structure(s)involve fewer that"six (6)residential dwelling units,"the basic principles of
Site Plan Review nevertheless should offer relevant guidance.
56. Section 9.5.1 of the Salem Zoning Ordinance, entitled "Purpose," includes the following
explicit Purposes of said Ordinance: "to protect and promote the health, safety,
convenience, general welfare of the inhabitants of the City, promote acceptable site
planning practices and standards within the City, to protect the health and safety of its
inhabitants, to encourage the most appropriate use of land throughout the City, . . . to
increase the amenities of the City of Salem ensure compliance with the City of Salem
master plan and good zoning practices."
57. Section 9.5.5 of the Salem Zoning Ordinance, entitled "Review Criteria,"includes the
following explicit Purposes of said Ordinance: "(3) Adequacy of traffic circulation
system; (4) Adequacy of access points and routes to and from the land parcel to the
adjoining streets and ways;...(11) Adequacy of pedestrian circulation systems to and
from parking areas and structures..."
58. The August 2, 2016 Decision of the Salem Planning Board are contrary to the above
explicit Purposes of Site Plan Review in the Salem Zoning Ordinance.
59. For the foregoing reasons alone, the Salem Planning Board exceeded its authority in
approving said August 2, 2016 Decision and said Decision must be annulled in its
entirety.
COUNT III
THE PLANNING BOARD'S AUGUST 2, 2016 DECISION VIOLATES THE EXPLICIT
PURPOSES OF THE SALEM ZONING ORDINANCE AND CHAPTER 40A
60. Section 1.1 of the Salem Zoning Ordinance, entitled"Purpose"provides the following:
For the purpose of promoting the health, safety, convenience,
morals or welfare of the inhabitants of Salem, the zoning
regulations and restrictions of this ordinance, ordained in accord
with the provisions of Chapter 40A of the General Laws and, in

the case of signs, ordained in addition in accord with the
provisions of Section 29 of Chapter 93 of the General Laws, are
designed among other purposes to lessen congestion in the
streets; to preserve health; to secure safety from tire, panic and
other dangers; to provide adequate light and air; to prevent
overcrowding of land; to avoid undue concentration of
population; to facilitate the adequate provision of transportation,
water, sewerage, schools, parks and other public requirements; to
conserve the value of land and buildings; to encourage the most
appropriate use of land throughout the City; and to preserve and
increase its amenities, to preserve and protect the water supply,
open space and conservation of natural resources, to prevent the
pollution of the enviromnent and community blight,to ensure
housing for all income levels and compliance with the master
plan of the City of Salem; all as authorized by, but not limited to,
the provisions of the Zoning Act, G.L. c. 40A, as amended,
Section 2A of 1975 Mass. Acts 808, and by Article 89 of the
Amendments to the Constitution of the Commonwealth of
Massachusetts.
61. The Planning Board's August 2, 2016 Decision does not lessen congestion in the street;
does not secure safety from fire; does not provide adequate light; does not prevent
overcrowding of land; does not avoid undue concentration of population; does not
facilitate adequate provision of transportation; does not conserve the value of land and
buildings; and does not encourage the most appropriate use of land.
62. For the foregoing reasons alone, the Salem Planning Board exceeded its authority in
approving said August 2, 2016 Decision and said Decision must be annulled in its
entirety.
COUNT IV
THE PLAINTIFFS ARE SUBSTANTIALLY AGGRIEVED BY THE AUGUST 2,2016
SALEM PLANNING BOARD DECISION
63. The Plaintiffs have relied on the protections of the Salem Zoning Ordinance and related
regulations to safeguard their investment in, and their enjoyment of, their property at 12
Almeda Street.
64. The August 2, 2016 Decision of the Salem Planning Board severely jeopardizes and
undermines their property value and enjoyment of 12 Almeda Street, and creates a
dangerous situation.
65. As a consequence,the Plaintiffs are substantially aggrieved by the August 2, 2016
Decision of the Salem Planning Board.

66. For the foregoing reasons alone, the Salem Planning Board exceeded its authority in
approving said August 2, 2016 Decision and said Decision must be annulled in its
entirety.
RELIEF SOUGHT
The Plaintiffs respectfully request that this Court:
a. Enter a Judgment in their favor annulling in full the August 2, 2016 Decision of the
Salem Planning Board; ,
b. Award the Plaintiffs cost and reasonable attorneys fees in connection with their
prosecution of this appeal; and
c. Grant such other relief as is just and expedient.

Due to the unusual circumstances regarding 12 Almeda Street we are looking
for a letter of acceptance from the City of Salem's Engineering department on the
existing conditions of the work in place. After our conversation on Thursday January 12u'
am not sure weather we need a Certificate of compliance or a letter from Salem's
Conservation Commission that they to are satisfied with the work already done.
My understanding is the City of Salem's Building Department may also need to give us a
letter of acceptance on the existing conditions. Thank you for your assistance and we
look forward to working with you to complete this project.
