Dear Mr. Tremblay:
After a review of its records, the Board has determined that the two above parcels, totalling
11,311 square feet, have been held in common ownership since 1966. The current owner,
Thomas A. Sullivan acquired 12 Almeda Street in 1960, and acquired 10-1/2 Almeda Street
in 1966. Mr. Sullivan has not owned any of the abutting parcels to these two parcels at any
time since 1965.

Dear Mr. Sullivan:
You have requested a listing of the problems related to obtaining a building
permit for property located at 102-12 Almeda Street. Although the following
may not be all inclusive, the major problems appear to be as follows:
1. The lots do not satisfy the requirements for grand-fathering of lots
under Section 6 of Chapter 40A of the General Laws. Therefore, the
two lots are presently considered as one.
2. The lots appear by scale to be within one-hundred (100) feet of a
wetland. A hearing must be requested and permit granted from the
Conservation Commission prior to the issuance of a building permit.
3. This section of Almeda Street is not acceptable at this time. An
approved street acceptable to the City Engineer must be provided.
As I have stated above, there are other issues that I am sure would
have to be addressed such as changing of the grade if necessary, building
code requirements in a wetland, etc. However, the three listed are the
major initial issues.
You may want to consider requesting a relief from the Zoning Board of
Appeal regarding the Chapter 40A issue. I am sure your attorney could
assist you with this matter.

Since the early 1950s I have owned two ajoining lots of land on
Almeda Street. The lots are numbered 114 and 197 as shown on a
section of a City of Salem map of that area. (copy enclosed)
I was hopeful that some day I would be able to build a home for a
member of my family overlooking the pond which I owned for many years,
as I lived at 90 Highland Avenue, the corner of Colby Street, 40 years.
My daughter lives in Lynnfield (which is too expensive) with three
kids under 10 years old. She asked me of my intentions regarding
the land as she is interested in building a house on the property.
Recently I was informed a building permit cannot be issued due to
certain irregularaties that exist with these lots. I am aware of
some of these that I believe, can be resolved to meet with certain
building codes and requirements. Other problems are questionable.
In the interest of furthering my efforts to obtain a building permit
my attorney requested I obtain a letter from you (at your convenience)
listing the items in question for his study and decision if I should
continue my further efforts to build a home on these lots. With your
letter we will be able to meet with the other City of Salem Boards
that may be involved, if I wish to proceed.
