Our office received a complaint regarding your property located at 8 Almeda Street. The complaints were
investigated on Monday,March 19, 2012, said property was found to be in violation of the following
Massachusetts State Building Code requirements.
A carbon monoxide dectector must be installed on the second floor within ten feet of all bedroom doors,
refer to Massachusetts State Building Code and Fire Prevention for all requirements.
You are hereby ordered to begin to file for permit and rectify these conditions within 7 days of receipt of this notice.
Failure to do so may result in further actions being brought against you,up to and including the filing of
criminal complaints at District Court. You have the right to appeal this order to the State Board of
Building Regulations at One Ashburton Place,Boston,Ma.

Our office received a complaint regarding your property located at 8 Almeda Street. The complaints were
investigated on Monday, March 19, 2012, said property was found to be in violation of the following
Massachusetts State Building Code requirements.
Insufficient secondary means of egress stairway at the first floor or normal level of exit/entry to grade.
Presently both rear sliding doors off the fzrstfloor level are not equipped with a code compliant guard
rail or exit stairway. At minimum one of these sliding doors needs to have an egress stair to grade and the
remaining door to be secured shut or a code required guard rail installed.
Under the provisions of Massachusetts State Building Code(780 CMR Section 5311.4-Door and
780CMR Section 5311.5-Stairways)
You are hereby ordered to begin to file for permit and rectify these conditions within 7 days of receipt of this notice.
Failure to do so may result in further actions being brought against you, up to and including the filing of
criminal complaints at District Court. You have the right to appeal this order to the State Board of

The Inspector of Buildings refused to issue a permit to install. a parkin,C
lot at this location as this is not a permitted use for this R-l. district ,
zoned for single family dwellings.
Petitioner appealed to the Board of Appeals, and a hearing was held on
this appeal on February 24 , 1970, pursuant to notices mailed postpaid to
the petitioner, abutters , board members, and others , and advertisements
published in the Salem Evening News .
All Board members were present at this hearing, -except ing Mr. Dovle who
was unable to attend .
Petitioner appeared to explain the plan the same as in the original plan
on file . Counselor ,Tames A. Farlev , representing Salem Hospital , lessee ,
also appeared and stated the area is now vacant and will mt he changed
in any way; there would he no new huildinr.s constructed except a tempor-
ary shack approximately 5 ' x 8 ' ; the Salem Hospital main building is
;ss than 1000 feet distant ; construction work has taken over parking
areas heretofore used by employees and visitors to the Hospital, and it
is absolutely necessary that these areas be replaced during construction;
not to permit this use by the Hospital would immeasurably harm the opera-
tion of the hospital , and the above area is the only feasible area for
this purpose .
Ward IV Councillor, John Butler appeared in opposition to ,*ranting this
appeal , also, Mr, and Mrs. D' Virgilio, 5-7 Almeda Street , voiced opposi-
tion. A letter from the Board of Health stating that "The Board wished
to go on record as heing opposed to the filling in, construction, and
use of parking lot over a natural waterway, the brook that flows from
Anderson ' s pond. to nnlhv Street” was read to the meeting, and becomes
part of the permanent file on this appeal , Councillor Butler stated he
would look into the matter of filling in a natural waterway,
After careful study of all facts presented in this case , the Board found
that a severe hardship exists in the matter of employees ' and visitors '
parking at the Salem Hospital because the new construction at the Hospit-
al is taking up nearly the entire parking area , and for this reason
voted unanimously to grant a Special. Permit restricted however by the fol-
lowing conditions:

it to its original condition., at once .

2. The Special Permit to allow rise of this land as a parking lot for

An Agreement made in Salem, Massachusetts,
September 15, 1988 between JOHN DAVID and JULIE TREMBLAY
and RONALD and PATRICIA TREMBLAY (hereinafter the
"Tremblays") and STEVEN and CAROLINE SCHROEDER
(hereinafter the "Schroeders") and LEONARD F. O'LEARY
WHEREAS, John David Tremblay and Julie Tremblay are
the owners of property situated at 8 Almeda Street,
Salem, Massachusetts, and Ronald and Patricia Tremblay
are the owners of property situated at 10 Almeda Street,
Salem, Massachusetts
WHEREAS, Steven and Caroline Schroeder are the
owners of property situated at 6 Almeda Street, Salem,
Massachusetts, and
WHEREAS, since 1986 the Schroeders have entered upon a
certain adjoining portion of the aforementioned John David
Tremblay and Julie Tremblay' s property with the express
consent of the John David and Julie Tremblay, (no right or
easement expected or intended) , and
WHEREAS, Steven S. Schroeder and Leonard F. O' Leary
(as Ward Councilor of Ward Four of Salem, Massachusetts
in which the said Almeda Street is located) have
presented a Petition to the City of Salem Board of
Appeal dated August 9, 1988 requesting that said Board
make certain findings as to conditions upon Lots 48 and
49 Almeda Street (as are currently numbered 8 and 10
Almeda Street and owned by John David Tremblay, Julie
Tremblay and Ronald and Patricia Tremblay, respectively,
and
WHEREAS, the Tremblays, the Schroeders and
Councilor Leonard F . O' Leary desire to resolve by this
Agreement issues as currently exist regarding the
erection of buildings, driveways and improvements upon
the aforementioned Tremblays' property and upon property
located at 8 and 10 Almeda Street, Salem, Massachusetts

in hand paid by the others, the parties have covenanted
and agreed as follows :
1 . That certain improvements, fill, grading and paving
as currently exist upon property of the Tremblays
i
at 8 Almeda Street, Salem, shall be regraded to
conform to the levels and grades* as specified in a
plan attached hereto as "Appendix A, Enlargement" .
Said work shall be completed by October 13, 1988.
*The portions of land marked "level" shall be
graded to a gradient consistent with that land upon
which the house at 6 Almeda Street stands.
2 . That shrubbery, 4 ft . Pyrmidal Arborvitae be
planted by the Tremblays in the location of and to

the specifications set out in said Appendix A,
Enlargement .
3 . That the location of a bituminous driveway as
currently exists at 8 Almeda Street, Salem, be
changed by the Tremblays to conform to the
specified location of said driveway on the attached
Appendix A, Enlargement so long as the nearest edge
of the driveway is far enough away from the
proposed level portion to leave a sloping and not a

sheer drop.
4 . That the slope adjacent to the paved driveway as
shown on the attached Appendix A Enlargement shall
be grassed by the Tremblays .
5 . That the Schroeders and Leonard F. O' Leary shall
consent to the denial of the aforementioned
Petition of said parties dated August 9, 1988 by
the City of Salem Board of Appeals and agree that
no appeal of said denial nor any other action,

administrative or legal, regarding the aforesaid
property, erection of buildings, driveway or
improvements shall be sought or pursued by said
parties.
6 . This Agreement is intended to be an agreement
between the parties hereto which is not intended to
convey any right, title or interest in any land of
the parties thereto and shall not effect the title

to any property of any party hereto nor is this
Agreement intended to run with or otherwise
encumber the titles thereto and shall not be
recorded in any Registry of Deeds nor Land Court of
this Commonwealth of Massachusetts.
7 . The parties hereto hereby mutually release and

discharge all other parties hereto from all claims,
damages, or rights of action that any party may
have, whether known or unknown, against any other
party hereto which arose out of or by reason of the
aforementioned transactions and occurrences. -
IN WITNESS WHEREOF, the parties have hereunto set their

Mr. Tremblay has not yet filed a Drainage Alteration Permit with the City

driveways are not in compliance with the plan approved by the Planning Board on
September 16,1966.
I would like to request your assistance in stopping all work on the site until
these matters are addressed.
