SECTION 1: PURPOSE. It is the intent of this section to protect and preserve public safety security and quiet enjoyment of occupants, abutters, and neighborhoods by (i) requiring all residential property owners including lenders trustees, and service companies, to properly maintain abandoned and/or foreclosing properties.(ii) regulating the maintenance of abandoned and/or foreclosing, residential properties to prevent blighted and unsecured residences. The Inspectional Services Director has enforcement authority pursuant to, inter alia, M.G.L. c. 143. s. 3, the State Building Code, and the City of Salem Zoning Ordinance. SECTION 2: DEFINITIONS. When used in this section, unless a contrary intention clearly appears, the following terms shall have the following meanings: Abandoned means any property, residential and commercial, that is vacant. City means City of Salem Days means consecutive calendar days. Directormeans Inspectional Services Director. "Evidence of vacancy"means any condition that would lead a reasonable person to believe that the property is vacant. Foreclosing means the process by which a property, placed as security for a real estate loan, is prepared for sale to satisfy the debt if the borrower defaults. You can prove that your dwelling unit or common areas contain code violations which are serious enough to endanger or materially impair your health or safety and that your landlord knew about the violations before you were behind in your rent. B. You did not cause the violations and they can be repaired while you continue to live in the building. C. You are prepared to pay any portion of the rent into court if a judge orders you to pay it. (For this it is best to put the rent money aside in a safe place.) 2. Repair and Deduct(General Laws Chapter 111 Section 127L) The law sometimes allow you to use your rent money to make the repairs yourself. Breach of Warranty of Habitability. You may be entitled to sue your landlord to have all or some of your rent returned if your dwelling unit does not meet minimum standards of habitability; 6 Unfair and Deceptive Practices (General Laws Chapter 93A).
