Dear Trustees,
This office is well aware of the Civil Engineering issues at the alley between 149 and 155 Derby. At the time
this work started, I was called down to take a look at the excavation. I was immediately concerned, due to the
amount of excavation and the fact that both building's foundations were potentially compromised. I instructed
the representatives of 155 Derby to secure a Building permit and to retain an Engineer to address the civil
portion of the work.
To date,there is no Building permit and the potentially unsafe condition remains.
I am also aware that you have been before the Historic Commission for approvals to the drainage pipe. At this
point, work needs to commence immediately with a Building permit being secured by a licensed individual.
Any further delays will be considered a Building Code violation creating an unsafe structure. If you have any
questions, please contact me directly.
If you feel you are aggrieved by this directive, your Appeal is to the Board of Buildings, Regulations and
Standards in Boston.
