AFFIDAVIT OF T. ST. PIERRE RE HOUS. COURT OF 2/27/2018 COMMONWEALTH OF MASSACHUSETTS Essex, ss. NORTHEAST HOUSING COURT OUELLETTE REALTY CORPORATION, ) Plaintiff ) V. ) C.A. No.: 18H77SP114 JOYCE CURRIE a/k/a JOYCE CURRY, & ) BRUCE DUVELOW, ) Defendants ) AFFIDAVIT OF THOMAS ST. PIERRE 1. I,Thomas St. Pierre, am the Building Commissioner and Director of Inspectional Services for the City of Salem,Massachusetts. 2. In my capacity, I inspected a property located at One Harbor Street,Salem,Massachusetts ("Property") in November 2017. 3. The Property contains fifteen (15) residential apartments. 4. I was requested to inspect an area on the first floor of the Property that was an old office/storage area. 5. Upon my arrival, I found two individuals,later identified as Bruce Duvelow and Joyce Currie,occupying the office area. 6. Mr. Duvelow and Ms. Currie had placed an inflatable mattress on the ground inside of the office area. 7. There were numerous empty beer bottles and cans strewn throughout the office area. 8. The office area did not have any bathroom facilities or cooking area. 9. The office area did not have a smoke detector. 10. The office area did not meet any Building, Sanitary or Fire codes to enable it to be used for a sleeping or living area. 11. The office area occupied by Mr. Duvelow and Ms. Currie is not fit for habitation. 12. As a result of my inspection, I drafted and served the owner of the Property, Ouellette Realty Corporation with a Cease and Desist letter on November 16, 2017. 13. The Cease and Desist letter instructed Ouellette Realty Corp. to cease using the office space as a dwelling room immediately. 14. I presented testimony before the Northeast Housing Court on February 27, 2018 wherein I notified the Court that the area occupied by Mr. Duvelow and Ms. Currie was not fit for habitation. 15. Ouellette Realty Corp.'s failure to remove the occupants from the office area represents a violation of the building code and is subject to a local penalty of$300.00 per day, to be calculated from the date the offending party is first notified.
