On October 19, 2021, Jeffrey Barosy, sanitarian for the City of Salem, appeared before
the Court seeking injunctive relief relative to his civil complaint, filed on behalf of the Salem
Board of Health alleging violations by the Defendant of the state's public health laws and
sanitary code. The Defendant did not appear for the hearing.
At the hearing, Mr. Barosy shared that since the Board of Health issued a repair order on
June 17,2021, and commenced this action on August 25,2021,the Defendant has begun taking
action to come into compliance. However, Mr. Barosy has reason to believe the Defendant is
selling the property before the end of October. Therefore based on the above, I ordered the
following:
ORDER
1. The Court shall continue the Plaintiff's request for injunctive relief to another date to
allow time and opportunity for the Board of Health to verify whether the Defendant does
sell the premises, after which the Plaintiff can move to dismiss this action.
2. The Plaintiff must appear with counsel at the next hearing as Mr. Barosy is not licensed
to practice law in the commonwealth and cannot represent the city in this civil action.
