My husband and I bought the property in 14 Nichois Street Salem Ma 01970 on October
26,2020. As our first time buying a home we were extremely exited and not experience
in the process at all which is why we are going through this situation now. While buying
the home we never got to see the second unit because the tenants were never willing.
We managed then to work out a deal with the previous owner that he would be
responsible for the damages in the property and evicting the tenants since according to
to him they were having issues already and assured us everything would be fine. After
the closing I went and introduced my self to the tenants (Patricia and Javier Garcia) I let
them know I was the the new landlord gave them my contact information and gave the
48 hours to view the unit, but when the time came I knocked and no one answered.
went an hour later around 6 and again no one answered but I could here talking and
laughter. I went to my sisters house who is the first floor tenant and heard someone
come down stairs who was the tenant Javier's mother and asked if I could view the unit
she allowed me in but only allowed me to see the Kitchen nothing more. I immediately
did not like what I saw so I then proceeded to contact the Section eight (Housing) and
reported my concerns to them but nothing was done also to mention that the tenants
where already going through the eviction process. When I spoke to their Housing
Representative I asked when the last inspection was and was given nothing I told them
about how bad the place looked and if their were any reports I should have known about
and their section 8 rep said there where none, I also addressed many of the violations I
saw. People not on the lease, removal of alarms to spoke in unit, piling many things that
blocked emergency exits amongst the few. The tenants had never reported living
conditions to the previous owner since they were happy not paying their portion of the
rents they did not care no make a report to housing. Neither had the previous owner
which I am not sure why based on Covid I could not have an inspection done by
housing and the tenants will not allow me in because of Covid into their unit either.) was
also never contacted in any way or form regarding fixings in unit and I have never left
these tenants without electricity these are false accusations meant to hurt me because
they do not want to leave the property or pay rent or allow me to fix or enter the unit.
When I managed to then contact Javier and Patria to discuss the mater they still will not
allow me into the house we talk out side the property and they proposed that I not worry
about the unit as long as I did not charge them for their portion of the rent which was the
agreement they had with the previous owner. I decline and told them I would like to fix
the apartment which will get fully renovated due to our agreement with previous owner
since we intend to move into the unit once they leave the property. Based on our loan
type we are required to live there which was also part of the reason for their eviction
which is why they made the report to the city in the first place. I believe I this is not fair
to me being a new owner and having just bought this property 2 months ago that
because Patricia and Javier do not want to leave the property or pay rent and are
already in the process of eviction prior to me owning the house when I am attempting to
work with them that this all falls on me and my husband when are not responsible for
this outcome. I have made many good will attempts to fix their unit and have not been
allowed to I am currently working with Housing to see what can be done regarding this
matter. We will also continue to work on attempting to take care of all the issues
regarding property 14 Nichols Street unit 2 in Salem MA 01970 but request that we also
get taken into consideration and our situation as well.

Good Afternoon Cynthia,
I wanted to make sure you had the following documents for your records and that you were up to date on what is going
on with my 2nd floor tenants, Patricia and Javier Garcia, as well as with his mother and uncle that also live with them. My
first floor tenant just gave me her notice because of the constant harassment they put her through based on her
relationship to me. I filed a police report on 12/08 because on 12/06, they threatened my first floor tenant (as well as
myself) by harming her and my property if I continued with the eviction process and asking for rent. I will be forwarding
a copy of this report once it is available. I was worried about her well being and based on their threat to get back at me
some how, I felt that to be safe I should have something on record just in case. I am stepping into court tomorrow to see
if I can start a court order along with a restraining order because now that I have given them notice myself. I feel things
are getting out of hand and I am scared for my property. I know there is nothing you can do on your end but I thought
you should know the full situation.

State Sanitary Code, Chapter 1: General Administrative Procedures and 105 CMR 410.000:State Sanitary Code,
Chapter 11: Minimum Standards of Fitness for Human Habitation,an inspection was conducted of the property 14
Nichols Street Unit 2 permitted by occupant Patricia Garcia conducted by Jeffrey Barosy,Sanitarian on
December 21,2020 at 1:30pm.
Notice: if this rental unit is occupied by a child or children under the age of 6 years, it is the property owner's
responsibility to notify tenants of lead related reports and tests,and to ensure that this unit complies fully with 105
CMR 460:000: Regulations for Lead Poisoning Prevention and Control. For further information or to request an
inspection,contact the Salem Board of Health at 978-741-1800.
You are hereby ORDERED to make a good-faith effort to correct the violations listed on the enclosed inspection
report and to take all positive action to prevent these violations from occurring again in the future.
Failure on your part to comply within the time specified on the enclosed inspection report will result in a complaint
being sought against you in Trial Court. Time for compliance begins with receipt of this Order.
Should you be aggrieved by this Order,you have the right to request a hearing before the Board of Health. A request
