An application is being submitted to the Board of Appeals for the following reason(s):
Applicant is proposing to replace existing restaurant structure with a larger 3-story structure containing four(4)dwelling units in
accordance with the plans submitted. The proposed multifamily use is allowed in this B-1 Zoning District. Several dimensional and
parking variances are requested,as specifiied hereinafter.
For this reason,I am requesting:
[true]Variance(s)from provisions of Section Section 4.1 Table of Dimensional Requirements in the B-1 Zone and Sections 5.5.1
(Design of Off-street Parking)and 5.1.8(Table of Required Parking Spaces)of the Zoning Ordinance,specifically from 1)required
minimum lot area per dwelling unit is 3,500 SF required, but 1,614 provided;2)replacement structure over existing foundation maintains
5.5'set back on northerly side,where 10'is required;3)if any yard deemed as rear yard,relief as to rear yard where 30'is required and
less than that is provided;4)lot coverage exceeds the 40%maximum;4)seeking to maintain and use the 6 existing on-site parking
spaces as shown on Plot Plan,rather than compliant to the design and landscaping requirement of the Ordinance. .

The Undersigned hereby petitions the Board of Appeals to vary the terms of the Salem Zoning Ordinance and allow the project to be
constructed as per the plans submitted,as the enforcement of said Zoning By-Laws would involve practical difficulty or unnecessary
hardship to the Undersigned and relief may be granted without substantially derogating from the intent and purpose of the Zoning
Ordinance.
Statement of Hardship(for Variances):
The triangular shape of the lot,the fact that it is sloped,with uneven topography,and is locate on a sloped ovepass area which is
topographically elevated above abutting properties,that the lot it is actually abutted on its front side by that overpass and on another side
by an easement for public utility wires and an active railway easement and tracks,are all conditions unique to this property and not
generally to other lands and structures in the same district. The literal enforcement of the Ordinance would involve substantial hardship,
literal and economic to the applicant. Because the City is in need of more safe and code compliant family housing,and the property is
located in a mxed use neighborhood including commercial,and 2-and mutifamily residential dwellings,this application may be granted
without substantial detriment to the publicc good,or substantially derrogating form the intent of the district or the purpose of the
ordinance.
