The area proposed for re-use was located in the southwest portion of the building adjacent to the parking lot. The remainder of the building was proposed to remain vacant and secure until a tenant was found. The cannabis retail use required 6 of the 19 existing parking spaces. The project also proposed removal of an existing shed and planting salt tolerant species under the shed (see Figure 3 ENF Site Plan). 2.Proposed Project Change The Proposed Project Change involves utilizing the entire building with additional uses and site improvements as discussed below and shown on Figure 4. These proposed uses increase traffic and sewer generation and water consumption as indicated in the Notice of Project Change Summary of Project Change Parameters and Impacts Table and also improve the public realm along this waterfront property. Building Use: The Project now proposes to utilize the entire building including the basement as follows: Main (ground) floor program •Cannabis retail (1,035 square feet) •Charter boat operation (850 square feet) •Restaurant (20 seat/2,020 square feet) Basement •Cannabis cultivation (2,400 square feet) Site Improvements: The following additional site improvements are proposed as part of the Notice of Project Change. Existing Shed: As noted in the ENF, an existing 160 square foot shed will be removed and the area under the shed planted with salt tolerant species. The area proposed to be planted with salt tolerant species has been expanded to include a hardpack grass area west of the shed. Waterfront Walkway: There is an existing 5 foot wide, 100+/- foot long ramp that extends from the building entrance on Bridge Street down along the southern and eastern ends of the building where it terminates at the lower portion of the site. A 5 foot wide by 9 foot long stone dust path is proposed to extend from the terminus of the ramp to a proposed 10 foot wide by 99+/- foot long stone dust waterfront walkway to provide accessible public access along the majority of the shoreline. The waterfront walkway will terminate at a set of proposed crushed stone steps that will allow non-accessible pedestrian passage to and from the upper level parking lot. See Figure 4 Notice of Project Change Site Plan. Notice of Project Change - 2 Bridge Street, Salem, MA EEA 16439 7 Parking Lot and Stairs: The existing parking lot will remain and be re-striped to accommodate handicap parking. An existing timber ramp that provides access to the lower level will be replaced with crushed stone steps and the adjacent slope along the Harbor will be planted with salt tolerant species. Rip Rap Embankment: The top of the existing rip rap embankment owned by the City of Salem will be improved with salt tolerant plantings and a portion of the 10 foot wide waterfront walkway will be located in this area as well. Patio and Floating Dock System: The project also proposes to utilize the existing patio located on the lower level of the site for seasonal outdoor dining and to reinstall the floating dock system in Beverly Harbor. The floating dock system consists of three 6 foot by 20 foot and one 6 foot by 30 foot floats and a 3 foot by 25 foot gangway which will be bottom held with existing concrete moorings. The floats will be equipped with legs to ensure that the bottom of the floats are elevated 30” off the mud at low tide. The gangway will be attached to an existing concrete landing. The floating docks will be open to the public and will also be used during higher tides by the Charter Boat operation (see Figures 4 Notice of Project Change Site Plan and 5 Floating Docks). 3.Significance of Proposed Changes The proposed new uses within the building will increase traffic by 108 trips per day; sewer generation by 775 gallons per day and water consumption by 1,236.5 gallons per day. The ENF proposed to utilize only 891 square feet (12%) of the 7,686 square foot building floor area. The document indicated that the remainder of the building would remain vacant until a suitable tenant was identified. Similar to the proposed project changes, any other future use of the vacant portion of the building would increase traffic, sewer generation and water consumption. It should be noted that the previous restaurant use had a 99 seat capacity which had greater impacts than the proposed uses on water, sewer and traffic (former restaurant = 3,811 gpd water, 3,465 gpd sewer, and 434 trips/day; proposed uses = 1,067 gpd water, 825 gpd sewer, and 334 trips/day). The traffic generations for the proposed uses including the previously proposed cannabis retail are provided below. The majority of sales would be generated via telephone and online booking although walk ins may be possible. A maximum of 50 charter trips per year would originate from the project site generating one or two vehicles per trip. Based on such usage, the traffic engineer estimated a total of 10 daily trips (5 vehicles entering and 5 vehicles exiting). Notice of Project Change - 2 Bridge Street, Salem, MA EEA 16439 8 4.Measures to Mitigate and Minimize Damage to the Environment The proposed changes improve environmental conditions at the site by planting salt tolerant grasses along the shoreline embankment and additional plantings in the area around the shed that will be removed. The project will improve the public realm by creating a 10 foot wide, 99 foot long +/- stone dust waterfront walkway and reintroducing a floating dock system at the site. 5.Energy Efficiency and Water Usage As described in the Energy and Environment Compiled Guidance issued by the Cannabis Control Commission (“Commission”) in January 2020, cannabis cultivation uses a significant amount of energy for horticultural lights, dehumidification, and Heating, Ventilation and Air Conditioning. Cultivation operations licensed by the Commission pursuant to 935 CMR 500.000 must adhere to energy efficiency standards that include limits on Lighting Power Density, energy usage, and building envelope improvements. During the licensing process, a summary of operating procedures addressing energy efficiency and conservation must be included in the Management and Operation Profile and information on building and equipment must be provided as part of the Architectural Review process. Additionally, written operating procedures on energy usage must be maintained for the duration of the operations and an ongoing annual analysis and report of energy usage and conservation opportunity must be provided annually at the time of license renewal. The project has been designed to meet the Cannabis Commission regulatory requirements and guidance regarding energy efficiency as follows. Horticultural Lighting Power Density - The proposed cultivation space includes 1,100 square feet of plant canopy and is defined as a Tier 1 facility under the Cannabis Commission regulations. The project will use the latest in high efficiency horticultural lighting and will practice active load management through lighting schedule programming to reduce energy demand. As required for Tier 1 facilities of this size, the facility will use no more than 50 watts per square foot for the cultivation operation. The City of Salem also has specific ordinances in place that limit the kind of lighting allowed in cannabis cultivation. Specifically, the ordinance only allows LED lighting for any horticultural vegetative growing which further helps limit the energy consumption used in cultivation. A Special Permit from the Salem Zoning Board of Appeals is required for the cultivation use. As part of that process, the ZBA will review energy and equipment specifics to ensure project compliance with the Salem zoning ordinance. •Building Envelope - The facility will be located in an existing building and the building envelope will comply with the Massachusetts State Building Code 780 CMR minimum requirements and all Massachusetts amendments. •HVAC and Dehumidification systems – High efficiency air source heat pump HVAC systems have been installed in the building. The HVAC systems meet the Massachusetts Building Code requirements and all Massachusetts amendments (780 CMR: State Building Code), IECC Section C.403 or ASHRAE Chapter 6 as applied or incorporated by reference in (780 CMR: State Building Code). Notice of Project Change - 2 Bridge Street, Salem, MA EEA 16439 9 In addition to the above energy efficiency measures, all non-cultivation lighting and HVAC environmental controls for the buildings will be high efficiency and equipped with LED lighting. The Proponent is seeking incentives from Mass Save for the HVAC heat pump system and will continue to explore other possible energy savings rebates/incentives and the potential use of solar panels. Water Usage - In addition to the energy efficiency regulations, the Cannabis Control Commission has adopted Guidance on Best Management Practices for Water Use for marijuana cultivation. The report notes that the average water usage for typical cannabis cultivation facilities is approximately 40 gallons/room-day (one room = 250 square foot). In an effort to promote water conservation at the facility, the following procedures will be implemented: •Appropriate soil will be used for proper plant cultivation. •The plants will be hand watered. which will minimize water usage.2 •Runoff from cultivation trays will be collected and reused for watering plants on a daily basis. •A water meter will be installed to allow usage to be monitored on a monthly basis. 6.Additional Permits The Cannabis Cultivation use will require a Special Permit from the City of Salem Zoning Board of Appeals and an Adult Use Cannabis Cultivation License from the Massachusetts Cannabis Control Commission. 7.Environmental Justice Outreach The project ENF was filed while the interim Environmental Justice (EJ) Policy was in effect. The relevant EJ census tracts were identified and a list of EJ organizations was compiled in consultation with the City of Salem. The EJ organization were emailed/sent information about the project with instructions on how to get copies of the ENF and/or submit comments to MEPA on the project. This outreach was summarized in the original ENF document. At the NPC pre-filing consultation session, MEPA asked that in addition to contacting the original list of EJ organizations contacted as part of the ENF process, that we contact MEPA EJ and obtain an additional list of EJ organization to notify in advance of filing of the upcoming NPC filing. Both the original EJ list and the MEPA EJ list were sent notices via email (and two via U.S. mail) along with a summary memo of the proposed project changes on April 6, 2022 (see Exhibit EJ Outreach). 2 While for the purpose of this NPC, water usage was estimated at 40 gallons per day/250 square feet, the water usage is expected to be much lower at around 50 to 55 gallons per day for the entire cultivation operation. The facility will include about 180 mature plants at any time in cultivation which will receive around a quart of water per plant per day for a total of 45 gallons per day of water for the main flowering rooms. There will be an additional nursery/propagation room for cuttings and baby plants/seedlings. This room will consume 5 -10 gallons per day.
