On behalf of Pan Am Railways, ERM Consulting & Engineering, Inc. (ERM) has filed an Immediate
Response Action (IRA) Completion Report and Permanent Solution Statement(PSS)for the
release associated with Massachusetts Department of Environmental Protection (MassDEP)
Release Tracking Number(RTN) 3-37274 at the above-referenced location. In accordance with
310 CMR 40.1403(3)(f), the Chief Municipal Officer and the Chair of the Board of Health of the
community in which the release is located must be notified of the IRA Completion Report and PSS
filing. In addition, per 310 CM 40.1013(1)(c),this Permanent Solution relies on the rail right-of-
way exemption from the requirements of filing an Activity and Use Limitation.
