Correnti, Esquire Correnti and darling LLP 63 Federal Street Salem Ma. 01970 Re: 12 Franklin Street Dear Attorney Correnti, I am in receipt of your letter dated October 8,2021 concerning 12 Franklin Street in which you seek clarification as to your client's proposed use of the property as a multi-family residential use as a primary use in a multi-story arrangement. In reviewing the Zoning Ordinance, I find that: First, 12 Franklin Street is in the NRCC zoning district and that section 8.4.5 controls what is permitted or allowed by Special Permit. Second, paragraph 4.4 of the Table of Uses sets out the criteria for a multi for a multi-family residential uses as primary uses in multi-story arrangements, and that use can be allowed by Special Permit. Third, Section 4.4 a.,b. and c. must be met in order for a Special Permit to be issued for such a use; and Lastly,it is understood that the Planning Board is the Special Permit granting authority in the NRCC District per section 8.4.5 of the Salem Zoning Ordinance. It is also my opinion that 12 Franklin Street is not"totally surrounded"by non-residential uses as there are residential uses, active or permitted, at 9 Franklin Street, 16 Franklin Street,18 and 20 rear Franklin Street, and Franklin Court, while the opposite side of 12 Franklin Street is residentially zoned. �1 # CITY OF SALEM, MASSACHUSETTS UW BUILDING DEPARTMENT 98 WASHINGTON STREET,2ND FLOOR TEL.
