My client is looking to develop a multi-family residential use as a primary use in a multi-story arrangement (single mid-rise building). Pursuant to section 4.4 of the Ordinance, this use is allowed by special permit provided that the three criteria of 4.4 (a,b,c) are met. Criteria A and C apply to this situation while criteria B does not apply since Franklin Street is not defined as a "main corridor". Criteria 4.4a requires that the multi-family use abuts a residential use, and not be "totally surrounded" by nonresidential uses. It is clear that residential use was contemplated on this street as 11 Franklin Street is zoned R-2. Would you please confirm your agreement that our property abuts a residential use and is not "totally surrounded" by nonresidential uses (i.e. residential uses at 9 Franklin Street; 16, 18, 20R Franklin Street; Franklin Court; etc.).
