Dear Mayer,
Arsenic and lead were identified at 31R Boston Street and has resulted in subsurface
investigations being undertaken. Based on the results of the investigations, a Permanent Solution
Statement With Conditions has been prepared to demonstrate Site closure of the above-
referenced location under the Massachusetts Contingency Plan (310 CMR 40.0000). The
conclusions are summarized below.
On September 1, 2021, a reportable condition for arsenic and lead was identified in soil
and groundwater at the property located at 31R Boston Street in Salem. The discovery
was made during site assessment activities relative to a potential real estate transaction.
The Site and Site area have a history of use as tanneries, and soils in the area contain
historic fill material associated with such use, including metals. Several nearby properties
exhibited similar conditions and were closed under the MCP with AULs. Subsequent
assessment confirmed the presence of arsenic and lead in soils, but groundwater was not
found to be significantly impacted by metals. A Method 1 risk characterization was
perfonned using EPCs developed by averaging Site soil data and using individual
groundwater concentrations. The arsenic soil EPCs were well below the most
conservative MCP Method 1 S-1 GW-2/3 soil standard for unlimited site use. The lead
EPC was above the S-1 GW-2/3 standard, but below the S-3 GW/2/3 standards.
Groundwater EPCs were below the applicable groundwater standards. Site closure is
achieved with a PSS With Conditions, precluding Site use for residential, school or child
daycare and the disturbance of pavement and soils in the area subject the Notice of AUL.
The AUL was recorded for the Site on February 11, 2022 to codify the Site use
restrictions.
