Dear Mr. Nguyen:
I have received a set of plans and an application to construct a 2-story dwelling at the rear
of 33 Beaver Street. The proposed dwelling would cover the same footprint occupied by
the garage unit destroyed by fire.
At this time, I am refusing to issue a building permit. As we discussed several times, it is
my opinion in the garage, was not a legal unit. I have seen no evidence of a building
permit or zoning relief to construct the garage unit.
Furthermore, even if you are able to prove the legality of the third unit, your proposed
dwelling would require Variance and Special Permits to alter a non-conforming structure.
If you wish to file an appeal, your appeal should be to the Salem Zoning Board of
Appeals The applications are available through this office.
