We are proposing to add an addition at the third story to create larger units on that level.
The building resides in an R-2 zone and is currently a nonconforming use having more
than 2 units. The rear yard setback is 30 feet and the current depth of my rear yard is 1
foot, 10 feet to the north and 1 foot 6 inches to the south. We will not further encroach on
this setback. The Zoning Ordinance also has a maximum of 2.5 stories and the building is
currently 3 stories. We will not be exceeding the current height and number of stories. We
will not extend past the existing footprint and will align new walls vertically for the
addition.

Written Statement (Special Permit)
For all Special Permit requests a Statement of Grounds must be attached. An application for a
special permit for a nonconforming use or structure shall include a statement demonstrating
how the proposed change shall not be substantially more detrimental than the existing
nonconforming use or structure to the neighborhood in accordance with Section 9.4 Special
Permits. Such a statement should include reference the following criteria:
a) Social, economic, or community needs served by the proposal;
b) Traffic flow and safety, including parking and loading;
c) Adequacy of utilities and other public services;
d) Impacts on the natural environment, including drainage;
e) Neighborhood character; and
f) Potential fiscal impact, including impact on City Tax base and employment.

a) The current use houses low rent apartments and provides valuable housing in the
downtown area. The proposed will also include life safety improvements.
b)the proposed addition will enlarge two existing units. no increase in traffic flow, safety
or spaces will occur
c) Utilities currently exist on site and are in working order. No additional utilities or public

services are required to complete the project
d) There is no increase in footprint, change in topography or impact to the environment.
The addition roof will drain similar to the current system of drainage.
e)The proposed addition will match the current aesthetic of the existing building and will
blend architecturally. The Petitioner is proposing to restore the deteriorating exterior,
remove an existing fire escape and make upgrades/ improvements to the unit interiors
f)The proposed project will increase the value of the building and site and increase tax
revenue for the City. Local development company that will provide employment during
the project
