Puleo, Trustee Puleo Realty Trust 376 Highland Ave. Salem, MA 01970 RE: 370 Highland Avenue Drive Through Special Permit On Thursday, December 7, 2006, the Planning Board of the City of Salem opened a Public Hearing under Section 7-22 of the City of Salem Zoning Ordinance, Drive Through Facilities, at the request of Puleo Realty Trust, for the property located at 370 Highland Ave. The proposed plan shows the construction of three (3) drive through lanes for an approved bank building on the site. The Public Hearing was closed on December 7, 2006. At a regularly scheduled meeting of the Planning Board held on December 7, 2006, the Planning Board voted by a vote of eight (8) in favor (Power, Moustakis, Collins, Kavanagh, Hanscom, Lombardini, Sullivan, Ready), and none (0) opposed to approve the Drive Through Facilities Special Permit, subject to the following conditions: 1. Conformance with the Plan Work shall conform to the plans entitled, "Proposed Commercial Development, 376 Highland Avenue — Route 107 (Tax Map 3 Lot 62), Salem Massachusetts", prepared by McKenzie Engineering Group, Inc., 325 Central Street, Saugus, MA 01906, dated May 25, 2006. 2. Site Plan Decision All conditions of the Site Plan Review Special Permit decision dated July 25, 2006 shall remain in full force and effect 3. Amendments Any amendments to the site plan shall be brought to the Planning Board for review and approval. Any waiver of conditions contained within shall require the approval of the Planning Board. 5. Violations Violations of any condition contained herein shall result in revocation of this permit by the Planning Board, unless the violation of such condition is waived by a majority vote of the Planning Board. I herebycertify-that-a-copy of -this -decision and -plans -has -been -filed with_the_City_Clerk_and copies are on file with the Planning Board. The Special Permit shall not take effect until a copy of this decision bearing the certification of the City Clerk that twenty (20) days have elapsed and no appeal has been filed or that if such appeal has been filed, and it has been dismissed or denied, is recorded in the Essex South Registry of Deeds and is indexed under the name of the owner of record is recorded on the owner's Certificate of Title.
