City Council Liaison in favor Updates *Dr. Jeremy Schiller has been nominated to the Board. His appointment will be considered at the next City Council meeting. *No further activity by the legislature on the bill that will reduce the Board from 7 to 5. The bill was positively reported out by the Joint Public Health Committee and is in the Joint Health Care Finance Committee. No hearing date has been scheduled *Councilor Gerard attended an inspection by the DEP. K& C i Auto Body was inspected because of numerous odor complaints from a neighbor on Franklin St Ct. DEP inspector asked the business to use their equipment during the inspection. No odors were noticed during the inspection. Minor violations not relate.* to odors were observed. 5. Tobacco Hearings A. Bunghole Liquors Bunghole Liquors 204 Derby Street Appeal of the 7 day Mr. Robert Carp owner of Bunghole Liquors has requested the suspension Board reconsider the 7 day suspension. He has paid the$200 violation at the meeting and is not disputing that the sale was made. He informed the Board that he is an attorney and a former law professor. Mr. Carp has questions about all the facts that lead to the violation and is asking for more transparency of the process. He has requested more information about the minor who purchased the cigarettes from his store. That request should be sent to Joyce Redford, Director of The North Shore/Cape Ann Alcohol and Tobacco Policy Program. D. Ledoux motioned that we rule on this today and we uphold the 7 day suspension and $200 violation for Bunghole Liquors tobacco permit on September 20, 2015 to September 26, 2015. 2°d M. He will be filing an appeal in superior court and will provide a notice of deposition. Copies will be supplied within a 10 day period in accordance with the Freedom of Information Act and Open Meeting Law. Deposition and scheduling will be handled with the City Solicitors office. Mr. Carp then asked for more time between now and the suspension so he can have time to prepare for the appeal. P. Kirby suggested we amend the motion to a later date. J. The Board would like to discuss this program with Joyce Redford to further understand the impact to local violations at the October meeting and to also understand the compliance program further. The Board discussed whether to empower the Health Agent to set the suspension dates for the 2❑d and 3rd tobacco violations that have not filed an appeal. J. Greene indicated that she would like to continue hearing from the business owners about the impact the suspensions will have on their business. The Board was in agreement that this discussion will be delayed to a future meeting when they are more prepared to make an informed decision. Training for businesses by the North Shore/Cape Ann Alcohol and Tobacco program has been scheduled for September 23, 2015 and businesses have been notified by mail. The Board requested to be notified of the training date. 6. Opiate Discussion Overdoses have increased over the past few months. The issue is predominant among the white non-Hispanic community. L. Ramdin will be ordering 2 copies of the "Anonymous People"DVD. Screenings will be set up for the schools and for the community. J. Green suggested we contact the YMCA Ames Hall to check on availability for the community viewings. Dr. Alam requested that the Board be notified of the screening dates once available. 7.Healthcare Round Table M. Danderson attended the meeting and summarized for the Update Board. The urgent care department will be closing at Union Hospital and expanded at Spaulding building as part of the NSMC. A mental health care and addiction center will be added. M. Danderson asked at the roundtable meeting about their emergency preparedness planning. There are impacts to their current plan and changes are being made. 8. Shared Kitchen M. N � • Health Agent report October 2015 Announcements- • Erica Rimpila, BSN, RN, has been selected as Salem's new Public Health Nurse her start date is December P. • Jeffrey Barosy, MPH, Sanitarian has completed his 6 month probationary period and is now a permanent employee Community Outreach • Letters of Support were provided to Salem Police Department who are applying for a naloxone support grant and to Northshore Community Health to support their opiate treatment program. • Letter of Support was provided to Northshore Community Health to support their HRSA grant application Public Health Highlights • We were contacted about licensing of food trucks. We will license Food trucks as long as they meet the requirements of the Food Establishment Regulations 105 CMR590.00, currently we do not have a fee structure for food trucks and current city zoning regulations do not allow for food trucks. • 85 food inspections were conducted at temporary food establishments for Haunted Happenings. Meetings and Trainings • Larry Ramdin, Andrea al-Turkmani, Representative of Girls Inc of Lynn met with Margarita Ruiz, School Superintendent and Paula Dobrow, School Nurse Leader to discuss general public health collaboration , Opiate overdose awareness and Underage drinking prevention grants. • Larry Ramdin and David Greenbaum met with Notch brewing, the new Hotel that is going in at the Joshua Ward House to discuss the food permitting processes and requirements for licensure. Health Promotion • Updated the Salem Board of Health Facebook and Twitter pages with information on M • Household Hazardous Waste day. • Began holding Wellness Clinics weekly at the Council on Aging to provide blood pressure checks, glucose checks and teaching with personal glucometers, diet and exercise education and helpful pamphlets on the flu and hypertension. • Attended the Salem High School open house with Claire Wilson, coordinator for the MAOPC Salem working group, where we provided materials and spoke with parents regarding opiate abuse and prevention, overdose training and local resources. We gave out several Strengthening Families DVDs as well as pamphlets and a poster presentation. • Hosted two Influenza vaccine clinics, one at the Salem Council on Aging on September 291h and another at Salem City Hall Annex for the city employees, family members and retirees on October 8th. Upcoming clinics include an after school clinic at the High School on October 14`h and the Lifebridge Shelter clinic on October 151h. Clinics specifically for the Police and Fire departments are TBD. • Providing support at several other local clinics including clinics in Marblehead on October 8th, Beverly on October I"and 13th and Swampscott on October 14`h. • Assisted a neighboring town with their directly observed therapy in the absence of a nurse for 3 visits in the beginning of September. Meetings/Trainings • On September 8th, attended the MAOPC Salem Working Group meeting where we discussed numerous ideas for outreach on opiate addiction and overdose prevention. • • On September 10`h, attended the North Shore REACT meeting in Danvers where we collaborate with neighboring towns to discuss upcoming challenges and resources for seniors and discussed planningfor where a new ant called Confrontin Abuse in Later In g Life North Shore(CALL-NS). This grant will help provide services for people over 50 years old who are experiencing or are at risk for abuse. • Began precepting a student nurse who will be completing part of her clinical hours for public health with our department. We have been able to go over some of the key functions of the Public Health Nurses role and she has been assisting me at the Council on Aging Wellness Clinics. Summary of Current Communicable Diseases Active Tuberculosis: Case#1: In June, a Salem resident was diagnosed with an active Tuberculosis infection. I accompanied them and their significant other to their first appointment with the pulmonary clinic to complete an assessment, do medication teaching and to explain the process of Directly Observed Therapy and a contact investigation. I began DOT daily following that appointment. They have been very compliant with DOT and are taking their medications without any side effects at this time. They are feelings well and no longer have symptoms of Tuberculosis. I completed a contact investigation and planted PPDs on all household contacts per the TSA nurse and protocol; contacts with positive results were referred to the pulmonary clinic. Case#2: In August, another Salem resident was diagnosed with active Tuberculosis. They were hospitalized on proper precautions and started on medications. I began DOT with them after they were discharged from the hospital. Their symptoms have improved and they continue to tolerate treatment well. They have been very compliant with DOT and I accompanied them on their first visit to the pulmonary . clinic. I will follow up with a contact investigation 8 weeks post exposure per protocol. This case has continued to be compliant with DOT and their treatment regimen. However, at this time, they have required hospitalization due to an unforeseen issue. I have been consulting with the Tuberculosis nurse • assigned to this case from DPH as well as the pulmonary clinic and further follow up will be necessary. Household contact testing is scheduled for this week. Campylobacteriosis: Case#1: This case had recently traveled out of state. They have no knowledge of any contacts of theirs being ill as well and they were treated by their primary care. They do not work in a care setting or as a food worker. No further follow up is required at this time and this case is closed. Case#2: This case was lost to follow up after several attempts to reach them by phone and a certified letter that went unreturned. Group B Streptococcus: I was able to speak with the hospital regarding this case and was able to obtain the appropriate clinical information. This case was seen for a procedure and treated with antibiotics. There is no further follow up and this case is closed. Pertussis: This case was seen by their primary care physician and started on proper treatment, household contacts began prophylaxis medication. Symptom surveillance was put in place due to the fact that the duration of the incubation period has passed since this case had been in contact with some groups of people. We did not receive any reports of other cases of pertussis in Salem. This case does not require any further follow up and after consulting with an epidemiologist at DPH this is now closed. Salmonella: This case was treated at the hospital and symptoms have resolved. They have no history of • recent travel and do not work in a care setting or as a food worker. J. Wilson RE: Municipal Pilot Program Regarding FDA Compliance Checks DATE: November 3, 15 Under the Home Rule Amendment for city ordinances and town by-laws, or under M.G.L. Ch. 111, Section 31 for health regulations, municipalities in Massachusetts may assess fines and/or permit suspensions to retailers that violate their local tobacco sales policies. In most cases, these municipalities also utilize the Non-Criminal Disposition method of ticketing which allows for a civil ticket after the municipal enforcement entity receives authority to do so through either town meeting or city/town council. Violators are most commonly caught during an adult-supervised compliance check when an under-aged youth, trained according to a statewide protocol, attempts to purchase a tobacco product. Concurrent to these locally-conducted compliance checks, the U.S. Food and Drug Administration(FDA) also conducts their own compliance checks, using a protocol that mostly mimics that used by Massachusetts cities and towns. The FDA does not divulge when they are doing compliance checks or which local retailers they will visit. Within three business days of a potential violation, the FDA will notify that retailer by mail. While the FDA does not notify the municipality of the potential violation, the compliance check results will be posted on the FDA website, generally within eight to ten weeks of the sale (currently the Mass. Health Officers Association does notify municipalities of violations). However, due to lack of local authority and the longer period of time it takes for that FDA website posting to occur, municipalities cannot also penalize on those FDA compliance checks. In place of a penalty, some cities and towns, upon receiving FDA notification, will ask the violating retailer to attend a board of health meeting to explain how the tobacco sale to a minor happened and what they intend to do to rectify the problem to avoid future illegal sales. A number of cities and towns have inquired as to how to utilize their local penalty scheme against a retailer caught in an FDA compliance check. �I A pilot project was established for this purpose. The participating cities and towns deputize the FDA compliance officer, often times someone they currently use, or have used in the past, for their own compliance checks. With proper deputization, that FDA compliance officer can immediately notify the board of health of FDA violations by completing an MTCP compliance check form and record a failed compliance check as both an FDA offense and a local offense. Prior to actively using this format, municipalities should inform their tobacco sales permittees that they will be subject to two sets of penalties if they sell tobacco products to minors. As to procedure,the FDA will continue to use their protocol and the participating municipality shall use their protocol. If a retailer wishes to appeal the penalty, appeal procedures for each are separate and can be found on the FDA website and within the local measure. Outside of Massachusetts, both Georgia and Connecticut have instituted a protocol to issue a state-level ticket on an FDA-conducted compliance check in addition to the penalties issued by the FDA. In both instances, rather than utilize one compliance officer as we do in Massachusetts, an FDA compliance officer and a state-level person attend to the compliance check resulting in the state-level person witnessing the sale and then issuing a state ticket to that retailer. In this scenario, the FDA compliance officer then follows the same penalty protocol used in Massachusetts FDA compliance checks. The FDA law does not preempt or otherwise block boards of health from enforcing their tobacco regulations. In authorizing the FDA to regulate tobacco under the Family Smoking Prevention and Tobacco Control Act of 2009, Congress stated '[n]othing in this chapter, shall ... limit the authority ... any state or political subdivision of a state to enact, adopt,promulgate, and enforce any law, rule, regulation...for the sale, distribution,possession ... of tobacco. (21 USC sec. 917(a)l). Therefore, if a board of health has evidence of a violation of its regulation, it is well within its scope of legal authority to act. In this pilot program, a deputized agent of the board of health provides such evidence. The fact that this person is also collecting evidence of FDA violations makes no difference. He or she has full authority to act in both capacities. Someone might argue that double jeopardy blocks this dual enforcement. That claim is wrong. Double jeopardy blocks multiple prosecutions against someone by one sovereign government. Since our constitutional system interprets our federal, state and local governments as different sovereign governments, each has a chance to pursue prosecutions. There are several examples of such multiple prosecutions when it comes to criminal matters. In the civil context, the tobacco industry itself was sued under the civil laws of both the state and federal governments for the exact same behavior, deceiving the public about the harm caused by tobacco use. New Business A. Tobacco Violation Hearings • Salem Grill Z Chicken 105 Lafayette St Owner Asim Mushtaq Hearing Violation- on 1/25/14. Two violations were cited per BOH tobacco regulations; sales to a minor and a cigarillo was sold under the$2.50 price point. 3 previous violations were: 1 1. 7/2/12 sale to a minor—$100 Fine paid 2. 2/25/13 1 —sa a to minor $100 Fine paid 3. 10/2/13 blunt wraps behind counter—$200 fine paid & 7 ' day suspension. J. Redford also recommended mandatory ; education at his last suspension hearing. Joyce Redford will look at the attendance sheet and get back to the Board to make sure Mr. Mushtaq attended. Mr. Mushtaq did not dispute the violation only the date of the violation. He claimed that the visit was on Friday night before closing; Joyce Redford indicated it was on Saturday January 251h when Mr. Mushtaq signed the violation. This was supported by Peter, King Tobacco Control Agent and the signed document. The Board discussed concerns with the timing of the hearings being prior to 21 days appeal period. The owner does not dispute violation but is asking for us not to suspend his tobacco permit due to the amount of people in the store at the time of the violation and that the store clerk, 18 years of age, was alone and overwhelmed at the time. He believes there should be a more fair way of giving out offenses that do not harm the business owner's license if an employee of the business is the one that committed the offense. Joyce replied that during the trainings that her office conducts, there is an exchange allowed and business owners are encouraged to share their methods of how they keep their employees from committing these violations; in the end, it is the responsibility of the business owner to set their own policies for dealing with their employees. s 7. Violation of Tobacco 7-1 1 of 28 Norman Street and Salem Grill Z Chicken of 105 Regulation Lafayette Street were invited to be heard by the Board prior to any • 7-11- 28 Norman St suspension of permit action for second and third violations of the Sale of Tobacco and nicotine delivery devices regulation. Joyce Redford of the Tobacco Control Project advised the Board of the violations and noted that both establishments committed third /second violations, in June and October. 7- 11 had previously sold tobacco products to a minor and cigars below the minimum pricing set out in the regulations. During the last round of compliance checks they were still selling cigars below the minimum pricing. If, the regulation is strictly read then the 7-1 1 has committed a third violation. Larry Ramdin advised that despite 2 violations being committed at the first visit to 7-11,he felt that this was a second visit, and then the violations should be treated as such. Joyce Redford Director North Shorc/Cape Ann Tobacco Alcohol Policy Program pointed out that the regulations are specific in that it is violation based not visit based. Mr. Romany Yousscf,owner of the 7-11 store told the board that the cigars come already coded with the prices from 7-11, he contacted 7-11 at the last violation and that did not change the pricing. After this violation, he contacted them again and they • adjusted the pricing. Mr. Yousscf, was advised another option if the pricing did not meet Salem Board of Health requirements, was to not sell the products. After discussion, Dr. Lcdoux motioned to suspend the permit for 7 days in keeping,with a second violation, and that the suspension takes effect from November 18-24 inclusive. 2nd Dr. Alam. Medical Marijuana Dispensary Chris Edwards of the Alternative Therapies Group presented to the Board on the company's desire to open a Medical Marijuana Dispensary in Salem, if granted a license by the Department of Public Health. The application process, requires either a letter of 6. Medical Marijuana Dispensary support or non-objection. (Cont) Mr. Edwards requested a letter from the board. He submitted a draft letter to the Board Chair and the Health Agent. Larry Ramdin advised that the draft letter appears to endorse the application and the Alternative Therapies Group and suggested that it may be better to issue a simple letter of non-objection. Further, there may be other applicants, who arc seeking similar letters. Thus, it may be prudent for the Board to authorize the Health Agent to issue simple letters of non-objection upon request, by applicants. After discussion. Dr. Shama Alam motioned that the Health Agent be authorized to issue letters of non-objection, to the siting of medical marijuana dispensary in Salem, to license applicants upon request, 2"d Dr. Ledoux. We have been in business for over 15 years and have complied with all city, state and federal regulations. I have personally looked into this matter and have taken the following necessary steps to prevent such incident in the future: 1. New POS installation which reminds the cashier to asks for ID upon purchase of any tobacco products. 2. Training seminar for all current and new employees. This will include information to the employees on checking Valid ID which includes a DOB for any person under the age of 27 who attempts to purchase any tobacco products. 3. Placing more signs and postage to remind employees and customers that Cigarettes and tobacco products are not to be sold to minors. I am confident that these new changes will prevent any future sale of cigarettes to minors at our place of business. We will continue to have a good track record of complying with all city, state and federal regulations. I humbly request you to reconsider this as an offense as it is our first violation in 15 years in business, and grant us a warning instead of a recorded offense.
