Also that we amend Section 2 (C)as follows: a.The owner or other person in charge of a shop or other place used to sell nicotine delivery products at retail shall conspicuously post a sign stating that"The sale of nicotine delivery products to minors under 21 years of age is prohibited."The owner or other person in charge of a shop or other place used to sell e-cigarettes at retail shall conspicuously post a sign stating that"The use of e-cigarettes at indoor establishments may be prohibited by local law."The notices shall be no smaller than 8.5" by 11" and shall be posted conspicuously in the retail establishment or other place in such a manner so that they may be readily seen by a person standing at or approaching the cash register.These notices shall directly face the purchaser and shall not be obstructed from view or placed at a height of less than four(4)feet or greater than nine(9)feet from the floor. 3. Dr.Shama Alam 2nd • Board had an "in depth" discussion on motion for approximately 1 hour. Before vote was brought forward by the Chair, Dr. Ledoux asked if she had to vote. Gayle Sullivan replied that she thinks you have to vote when there is a motion. Chair called for a vote on the Motion Gayle Sullivan& Dr. Barbara Poremba voted in favor of motion Paul Kirby and Dr.Shama Alam voted against the motion Gayle Sullivan asked if Danielle was abstaining from the vote. Dr. Danielle Ledoux asked if she could. No one answered her question. Dr. Ledoux voted in favor of the motion Chair asked for the members to show their vote again for the record. Motion passed 3-2 Paul Kirby motioned that we amend Salem Board of Health Regulation 24,Section F as follows; F. Cigar Sales Regulated: 1. No person shall sell or distribute or cause to be sold or distributed a single cigar 2. No person shall sell or distribute or cause to be sold or distributed any original package of two or more cigars, unless such package is priced for retail sale at$5.00 or more. 3.This Section shall not apply to: • a.The sale or distribution of any single cigar having a retail price of two dollars and fifty cents ($2.50)or more. b.A person or entity engaged in the business of selling or distributing cigars for commercial purposes to another person or entity engaged in the business of selling or distributing cigars for commercial purposes with the intent to sell or distribute outside the boundaries of Salem. 4.The Salem Board of Health may adjust from time to time the amounts specified in this Section to reflect changes in the applicable Consumer Price Index by amendment of this regulation. 2nd Gayle Sullivan—No discussion, motion passed unanimously Dr.Shama Alam motioned that we amend Salem Board of Health Regulation 24, Section P as follows P.Violations: 1. In the case of initial violations observed at an inspection within a 36 month period, a fine of one hundred dollars ($100.00) per violation. b. In the case of violations observed at the second inspection within 36 months of the date of a current violation,a fine of two hundred dollars ($200.00) per violation and the Tobacco and Nicotine Delivery Product Sales Permit shall be suspended for seven(7) consecutive business days. c. Motion Made by: Seconded: Vote: Public Comments from BOH meeting 8/7/14 Sheldon Stone co-owner of The Vapor Outlet I opened store 3 months ago. Had he know this was going to arrive; I definitely wouldn't have come to Salem. In talking to several people, and that's why we don't have many attending, is because after getting your notice they felt that you've already made your determination of what you are going to do. And I think we can stand here all day and give you different reasons and it wouldn't change your feelings. However, I want to ask you two questions. By raising the age from 18 to 21 preventing those smokers from purchasing tobacco in Salem to you honestly believe they won't go a mile or two to Lynn or Peabody or some other town to obtain cigarettes.. You must know that is precisely what they will do. My second question is; have you done any research on how many smoking have been successful in getting off tobacco to using electronic cigarettes. I'll bet you haven't. But I can tell you that the short time we have been in business we've had customers do so. By banning electronic cigarettes you will not only fail in reducing nicotine consumption among that group between ages 18 to 21 but you will succeed in preventing electronic cigarettes from helping them to get free of tobacco and destructive nicotine. Before you ration and act the amendment, rather than a few people in the Health Department making this decision and by your admission there are only five that are involved, you ought to put this before the people of Salem in a referendum in order to have a full and open debate on this important question. I can tell you from my own experience that we have a lot of females coming in, 30%to 40%of our business. And they come in, they don't want to smoke cigarettes anymore but they do want to vapor. And by vaporing you have a degree of nicotine that goes from 24 to 0%. 1 vapor myself at 0% and the women do the same thing because they don't want to start up smoking cigarettes. And your notifications were very explicit on mentioning vapor cigarettes. Now if you wanted something very constructive and the state would mandate this then I'd say that would be fine. Although that is true for alcohol it is done universally so no community is at a disadvantage. How we rent a hotel room is done by a private company not be regulation or laws. I believe the proposed regulation does not have its intended outcome. Is only going to stop using tobacco because they are inconvenienced by having to go to a neighboring community. The proposed regulation will not affect the SSU nontobacco use policy, it will not affect senior housing, it will not affect places where people can and cannot smoke, and it will not affect people who hate tobacco. These people are not stake holders for this proposed regulation. The parole that was made between this smoking regulation and smoking ban years ago regarding restaurants in Salem is also not valid since restaurants do not sell tobacco. We bill Salem as a tourist destination. We will now be telling tourists those who can purchase tobacco legally elsewhere are now being sent out of Salem to shop. I have been in the business for over 40 years, almost 34 in Salem. My belief is that the only result of this proposed regulation will be to drive business away from Salem businesses to neighboring communities and would be considerably more than just tobacco sales. The economy is not so great to even have to give up a small part of our revenue that it will be more than a loss in tobacco sales. The unintended consequence is a loss in sales of magazines batteries candy gasoline and other merchandise. Shoppers will rather • shop in one location than go to many to purchase all that they need. Please don't make us an island. What is happening tonight is that the Salem Board of Health is contributing in making Salem an island. This will essentially make Salem a lesser city to do business in. And as a speaker said before we have new business and business that have been here a long time that will be hurt by this decision. People will go outside the city to buy According to the surgeon general 9 out of 10 have started before 18. The goal is to not have them start before then by informing them of the dangers and your efforts should be focused on that point of view. If I am correct you are still legal to smoke them at 18; then I don't understand why you are trying to make it illegal to purchase We want Salem to be a far place to do business. I read the ordinancne and some of the langauge might have unintended consequences. These picutures are to help guide me through my discussion here. Chadmore is ninetewen years old and he lives in CO.He uses a vap pen or an e-cigeratee to inhalemedical canibus. The 2nd page is of Charolette Fay she's 5 yrs old. the Fay family are medical canibus representative. They had to move to CO to get the prescription their daughter needs. She has a sezure disorder that would give her up to 100 a day. And she does not have them anymore because of cannibas. and on the last page in a kidney patient who's using a vapor to help with the nausea that comes with the treatment of cancer. Cancer is a very heard illness and canibus has been one way to combat the side effects of kemo therapy. Nausea I know is vert debilitating because I am a patient myself suffering from multiple car accidents, neck injuries. I have muscle spasms in my neck nausea. These pieces of equipment that they using are vaporization products. And other language you have here in this amendment, 21 and under will not be able to purchase vaporization devises at as medical dispensary or store. Please I am asking the department to look further into this and see if there will be any unintended consequences for patients. The dispensaries haven't opend yet. At 17 you will be able to purchase these with a parent but at 18 you will not. I think reducing smoking rates is laudable. I don't think, however,that raising the age for tobacco purchases to 21 is ultimately an effective way of doing that. Given that the legal age for the possession and use of tobacco remains 18, I believe all we are doing is applying an additional burden to Salem businesses that sell tobacco and tobacco products.Were there a state-wide initiative to make the age for tobacco use higher, I'd likely be more supportive towards this measure before you. I think there are better ways to reduce tobacco use and presence in the city that the Board would be better-served in considering. Requiring the use of cigarette disposal poles and making sure that their use is enforced (most businesses already do have them) at bars. Banning tobacco use in some or all of our city parks.These would have more value in my eyes than a measure that simply makes a minor change at best to buying habits. Salem was a public health leader when we banned tobacco use in restaurants and bars.That was a wonderful accomplishment that improved the city for virtually all and set a path that most communities now follow. I believe this measure before you, however,does not have a comparable impact since it does not really affect the smokers themselves - it simply makes it more difficult for the businesses that legally sell tobacco to remain good citizens.
