No dwelling or portion thereof, which has been condemned and placarded as unfit for human habitation, shall again be used for human habitation until written approval is secured from, and the Board of Health removes such placard.. No person shall deface or remove the placard, except the Board of Health shall remove it whenever the defect or defects upon which the condemnation and placard action was based have been eliminated. Such information/data was collected subsequent to a determination that a release of cable oil had occurred at this site. This incident was investigated by personnel from the Emergency Response Branch of this Office on August 16, 1989. At that time, you were issued a Notice of Responsibility pursuant to M.G.L. c21E and 310 CMR 40.160. This letter is intended to notify you in writing that: (1) contaminant conditions at this location render the site an "LTBI" (Location To Be Investigated) pursuant to the Massachusetts Contingency Plan (MCP), 310 CMR 40.520(1); (2) a decision on the final disposition of the site will be made by the Site Management Branch of this Office after all the pertinent data and response actions have been evaluated. Pending final determination of the site disposition groundwater and subsurface soils cannot be considered "clean" as concluded in the report. Therefore, no excavation and removal of soils or pumping of groundwater from the site should occur without prior DEP notification and approval. Site Disposition The Emergency Response Branch of the Department has concluded that at this time there is no need for any further''emergency response actions at the site. In this communication, we indicated that every approved tank shall have securely affixed thereto some permanent tag or device certifying that said tank had been approved by the Fire Marshal. Recently, the Salem, Massachusetts, Fire Department advised us that Owens- Corning Fiberglas tanks to be installed at a gasoline service station in that city did not have the required tag or device certifying that said tanks had been approved by the Marshal. It is also our understanding that Owens-Corning Fiberglas Corporation is delivering for installation in Massachusetts Model D Series tanks for which no approval has been requested from Owens-Corning nor granted by the State Fire Marshal.
