In accordance with Chapter 111, Sections 127A and 127B of the Massachusetts General Laws, 105 CMR 400.000;
State Sanitary Code, Chapter 1: General Administrative Procedures and 105 CMR 410.000: State Sanitary Code,
Chapter 11: Minimum Standards of Fitness for Human Habitation,an inspection was conducted of the property 14
Messervy Street Unit 2 permitted by occupant Ray Bernard conducted by Jeffrey Barosy,Sanitarian on August
23,2021 at 10:40am.
Notice: if this rental unit is occupied by a child or children under the age of 6 years, it is the property owner's
responsibility to notify tenants of lead related reports and tests,and to ensure that this unit complies fully with 105
CMR 460:000: Regulations for Lead Poisoning Prevention and Control. For further information or to request an
inspection, contact the Salem Board of Health at 978-741-1800.
You are hereby ORDERED to make a good-faith effort to correct the violations listed on the enclosed inspection
report and to take all positive action to prevent these violations from occurring again in the future.
Failure on your part to comply within the time specified on the enclosed inspection report will result in a complaint
being sought against you in Trial Court. Time for compliance begins with receipt of this Order.
Should you be aggrieved by this Order,you have the right to request a hearing before the Board of Health. A request
for said hearing must be received in writing in the office of the Board of Health within 7 days of receipt of this Order.
At said hearing,you will be given an opportunity to be heard and to present witness and documentary evidence as to
why this Order should be modified or withdrawn. You may be represented by an attorney. Please also be informed
that you have the right to inspect and obtain copies of all relevant inspection in investigation reports,orders and other
documentary information in the possession of this Board,and that any adverse party has the right to be present at the
hearing.
Please be advised that the conditions noted may enable the occupant(s)to use one or more of the statutory remedies
available to th as outlined in the enclosed inspection report form.

Based upon a tenant complaint a permitted inspection was conducted in
accordance with Article II of the State Sanitary Code, 105 CMR 410.000. Upon
Inspection the following were noted: _
24 Hours .500 1. Living room ceiling has peeling paint. Removed loose paint and
repaint effected areas. Owner has 24 HOURS to start making a good-
faith effort to correct violation.
7 Days .351 2. Living room ceiling light does not work properly having a cord that is
stuck in place and lacks spring-back, preventing the ability to
consistently turn ceiling light on and off. Repair ceiling light so that it
can turn on and off as designed. Owner has 7 DAYS to start making a
good-faith effort to correct violation.
7 Days .500 3. Hallway ceiling above door to porch overlooking street has peeling
paint. Remove loose paint and repaint effected areas. Owner has 7
DAYS to start making a,good-faith effort to correct violation.
24 Hours .500 4. Bedroom between living room and kitchen has evidence of water
damage with discoloration on ceiling. Find source of water leak and
repair. Scrape off paint and repaint in effected areas. Owner has 24
HOURS to start making a good-faith effort to correct violation.
.500 5. Bathroom ceiling above shower has evidence of water damage with
24 Hours discoloration on ceiling tiles above shower. Find source of water leak
and repair. Replace effected ceiling tiles with new ceiling tiles. Owner
has 24 HOURS to start making agood-faith effort to correct violation.
.150 6. Toilet's top cover is broken into two. Repair or replace toilet cover.
7 Days .351 Owner has 7 DAYS to start making a good-faith effort to correct
violation.
.150 7. Throughout shower, wall tiles above tub basin have areas that are
7 Days .500 worn through exposing the underside of the tiles. Repair or replace
these tiles. Owner has 7 DAYS to start making a good-faith effort to
correct violation.
.150 8. Caulking around areas where tub basin and shower walls meet is
7 Days .500 loose. Repair the caulking in these areas. Owner has 7 DAYS to start
makinga good-faith effort to correct violation.
.150 9. Wall tiles beneath shower doors outside of shower is loose and
7 Days .500 warped. Repair or replace these wall tiles so they are properly affixed
to the wall and sealed. Owner has 7 DAYS to start making a good-
faith effort to correct violation.
.351 10.When bathroom sink is turned on and water is allowed to drain, the
24 Hours drainage pipe in the shower fills with water. Have a licensed plumber
investigate this issue and make any repairs needed to prevent
backflow of drainage water. Owner has 24 HOURS to start making a
good-faith effort to correct violation.
.500 11. Kitchen ceiling and walls around double doors leading to porch
24 Hours overlooking the ocean have evidence of water damage with
discoloration, loose and warped paint, and chipping paint. Find
source of water leak and repair. Repair or replace effected ceiling
tiles. Scrape off and repaint effected areas of paint on walls. Owner
has 24 HOURS to start making a good-faith effort to correct violation.
.500 12. Cupboards above kitchen sink have walls with signs of water damage
24 Hours with peeling wallpaper. Find source of water leak and repair. Repair
or replace wallpaper. Owner has 24 HOURS to start making a good-
faith effort to correct violation.
.500 13. Bedroom next to bathroom has peeling paint in the corner of ceiling
7 Days immediately to the right as one walks into the room. Scrape off and
repaint effect area of paint on ceiling. Owner has 7 DAYS to start
making agood-faith effort to correct violation.
.351 14. Pantry's ceiling light switch does not work properly, needing to be
7 Days held in a specific place for the ceiling light to remain on. Have this
light switch repaired so that it turns the ceiling light on and off as
intended without needing for a person or object holding the switch in
a specific position. Owner has 7 DAYS to start making a good-faith
effort to correct violation.
N/A 15. Owner has 30 DAYS to correct all violations listed in this report.
