Hi Tom and Lev:
We agreed together to hold back the scheduling of this petition for a Special Permit because
Tom questioned whether the separate 1-family residence at the rear of the property is a legal
grandfathered use, or is illegal, pertaining to whether we currently have a legal 3-family use
that we can seek to change to a 4-family by Special Permit.
So, at Tom's suggestion, we have been examining the history of the rear dwelling, and I
believe that we are producing very good evidence that it has existed as such on the property as
early as 1932, and definitely existed and was used as a 1-family dwelling throughout the 1960s
and since, so is a legal grandfathered use that existed in 1965 when modern zoning was
adopted in Salem.
Please see the attached documents that we have generated so far:
1. a letter that I am awaiting form former owner Sheryla St. Pierre-Loboa0 who was born in
1952 and lived on the property from then until adulthood in the front 2-family building on the
lot, stating that the rear residence has been on the property throughout her lifetime to the
present, and identifying specifically the Hudson family who lived there in the early 1960s and
actually painted their name and date 1963 of the cellar wall, which, per the attached
photograph, still is visible there today. I speke to Sheryl personally and prepared her
statement based on that, and am waiting for her to return it with her signature.
2. a list of residents at 11 Orchard and 11 1/2 Orchard Street in the 1960s, showing Mrs.
Elizabeth Hudson residing in "11 1/2" Orchard Street, which I presume is the rear building, in
1961, 1962 and 1963, and showing other named residents in 11 1/2 Orchard in 1964, 1965 and
for the rest of the 60s. This was prepared for my client by a Researcher at the Salem Public
Library Research Desk on March 2, 2021.
3. my client Eri Cani located on the Essex Registry web site "New Sheet 70" of the Sept.
1932 Salem City Atlas map of the location, which appears to show the front and rear
structures on the property at that time. I am trying to obtain a full-sized color copy from the
Registry that should be easier to read and interpret.
3. Eri has so far not been able to obtain City of Salem Assessor Maps showing 11 Orchard St
in the 1960s, but we will keep trying.
Copies are all referenced attached., and we will update you as we proceed.
