24 Loring Avenue - ZBA NEW STATEMENT OF GROUNDS FOR SPECIAL PERMIT FOR 24 LORING AVENUE, SALEM The Petitioner seeks a Special Permit under Ordinance Section 3.2.2 to conduct her home occupation as a tailor within the ground floor of her single-family dwelling at 24 Loring Avenue. Petitioner formerly conducted her business at a shop in downtown Salem, which she had to give up because of COVID-19 and related regulations. Originally, at the July 15, 2020 hearing, the petitioner sought permission to conduct this home occupation in her unattached garage, which is not allowed under Section3.2.2. Upon advice of counsel, the Petitioner now seeks permission to conduct her small tailoring business in a space within the ground floor of her residence. Pursuant to the new plans submitted, including as Sheet A-1 a Zoning Board of Appeals Plan by North Shore Survey Corporation dated Sept. 15, 2020, and Sheets A-2 (Existing Floor Plan) and Sheet A-2 (Proposed Floor Plan) dated Sept. 23, 2020 prepared by Seger Architects, Inc. of Salem, there will be no change in the exterior footprint of the dwelling building. The construction will consist of renovation of an interior area of the basement as a tailor shop, with an entrance, dressing area, counter and work space. The existing paved driveway and two-car garage on the property provide ample (2 or more) off- street parking spaces for the residents. Section 5.1.8 of the Ordinance (“Table of Required Parking Spaces”) requires one additional space for the home occupation, which will be provided by grounds renovation work that will provide one more legally compliant parking space, as shown on the North Shore Survey Plan. Petitioners therefore seek approval of a Special Permit under Section 3.2.2 (“Home Occupations”), which provides that a Special Permit may allow such home occupation provided that: 1. It shall be operated entirely within the dwelling, with no display visible from the street. 2. shall be operated only by the residents of the dwelling, with not more than one (1) regular employee not residing in the dwelling unit. 3. shall utilize less than twenty-five (25) percent of the gross floor area of the dwelling, and 4. shall display not more than one (1) non-electric announcement sign of an area of one and one-half (1.5) square feet and attached to the building and not protruding therefrom. Additionally, the Board must find that applicant meets the criteria for any Special Permit under Section 9.4.2, that the his proposed modification will not be substantially more detrimental than the existing structure and use to the neighborhood, based upon the following criteria: (a) The social, economic and community need of the community is to have tailoring services available to the public. (b) Traffic flow and safety are unaffected because all required on-site parking is provided; the effect of having one car occasionally enter the property or exit onto Loring Avenue near the existing traffic control light should be minimal. (c) Adequate utilities and public services already service the property. (d) There will be no detrimental affect upon the neighborhood character because all construction will be inside the structure, and the existing colonial-style designed of the structure, which is being maintained, is consistent with and complementary to the design of neighboring structures on this portion of Loring Avenue. (e) the proposed project will have a positive economic and fiscal impact on the City’s employment and tax base because it will save one small business operating in the City, and the assessed value of the property will increase, thus having a positive fiscal impact on the City by generating increased real estate tax revenue.
