A release of oil and/or hazardous materials has occurred at this
location, which is a disposal site as defined by M.G.L. c. 21 E, § 2 and
the Massachusetts Contingency Plan, 310 CMR 40.0000. To evaluate
the release, a Phase I Initial Site Investigation was performed
pursuant to 310 CMR 40.0480. The site has- been classified as Tier II
pursuant to 310 CMR 40.0500. On March 19, 2021 , Bay View Station,
LLC filed a Tier II Classification Submittal with the Department of
Environmental Protection (MassDEP). To obtain more information on

12.0 SUMMARY AND CONCLUSIONS
Data collected at the Property as part of the Phase I—Initial Site Investigation and Phase II
Comprehensive Site Assessment are summarized below.
• The Property consists of four parcels of land located in Salem, Massachusetts: 16
Franklin Street, 18 Franklin Street, 20R Franklin Street, and Parcel B of 20 Franklin
Street. Together, the four parcels total 2.03 acres of land. A 1,028 square-foot,
single-story building is located on the western side of the Property.
• In the late 1800s,the southern portion of the Property contained a building associated
with larger tannery complex to the south and southwest. The central and northern
portions of the Property at that time were part of the North River. Between the late
1800s until the early 1950s, municipal waste was reportedly burned at the Property
and the ash used to fill the central and northern portions of the Property. Demolition
debris and incinerator ash from the burning of municipal waste were reportedly also
used as fill at the Property.A gas station occupied the western portion of the Property
in the 1950s.An automobile salvage and repair business operated at the Property
from the early 1950s until 2020. The Property is currently vacant.
• A protected open space, athletic field and a public park, abuts the Property to the
north. The North River and associated tidal flats abut the Property to the east.
Residences are located to the west and northwest across Franklin Street. Other
receptors and priority resources areas are not located within 500 feet of the Property.
The Property is not within a current or potential drinking water source area.
• Assessment activities at the Property were conducted by SP Engineering in 2004,
2013, and 2020, and by GeoInsight in 2020 and 2021.Assessment activities included
excavation of test pits, advancement of soil borings, installation of monitoring wells,
and the analysis of soil and groundwater samples.
• Analytical data indicates the primary COCs at the Property are PAHs, arsenic, lead,
chromium, and zinc and secondary COCs are mercury and dioxin. COCs are
predominantly located within the fill material at the Property. Fill material is present
across the Property at thicknesses of six feet in the southern portion of the Property to
12 feet in the central and northern portions of the Property. Concentrations of VOCs
and metals in the underlying native soil are below Method 1 standards. Detected
concentrations of metals and VOCs in the January 2021 groundwater samples were
below applicable Method 1 standards.

• Groundwater is generally located between three feet and five feet bgs. Groundwater
gauging data collected on January 5, 2021 indicate that, on this date,the groundwater
table was relatively flat, with slightly higher elevations in the central and southern
portions of the Property.
• A Method 3 Risk Characterization concluded that a condition of NSR is present under
current and reasonably foreseeable Property uses for employees, construction
workers, and trespassers. A condition of NSR is not present under reasonably
foreseeable Property use as residential. The risk to future residents could be
mitigated by the placement of a cap over the impacted soil and the implementation of
an Activity and Use Limitation to ensure the maintenance of the cap. The risk
characterization concluded that a condition of NSR exists with respect to public
welfare, safety, and the environment.
• Imminent Hazards are other conditions which would require Immediate Response
Action activities were not identified at the disposal site.
• Information included in this report was used to Tier Classify the disposal site by
comparing conditions at the disposal site with the Tier I Criteria pursuant to 310
CMR 40.0520(2). Based upon that comparison, the disposal site is classified as Tier
II.
• Comprehensive Response Actions are necessary to evaluate the feasibility of capping
impacted soil, as well as other potential remedial alternatives.
