Dear Attorney Grover,
Per our discussion, it is my opinion that Salem Ordinance 14-194 and 195 will not prohibit
Sunday operation of the facility or truck traffic to and from the facility on a 24 hour basis. My
opinion is based on a reading of Mass General Law 136 section 6 sub paragraph31.
However , it is also my opinion that section 22 (4) of the Salem Ordinances does apply that
prohibits loading and unloading activities between 11;00 PM and 7:00 Am in such a manner to
cause a noise disturbance to any residential properties.
I understand that your client is aware of this ordinance and is working on procedures to minimize
outside noise.
