This section presents supporting information. A copy of the unsigned, validated Bureau of'Waste Site Cleanup BWSC104 Transmittal Form used to submit this PSS with Conditions is included in Appendix A. General Disposal Site Information The Site information requirements for a PSS are provided in this suction. The information presented below in bold, itallc text corresponds to the requirements specified in 310 CMR 40.10560). a. Disposal SiteWame and MassDEP Release Tracking: 84 Congress Street, RTN 3-36420. b. Category of Solution: Response Actions have:eliminated or controlled the threat of release of OHM and achieved a Condition of No Significant.Risk to human health, safety or public welfare, and the environment for all current and potential future activities and uses at the Site. A Permanent Solution has been achieved,the levels of OHM in the environment has not been reduced to background and an AUL is not required:. However, historic fill.has been identified at the Site, and the presence of OHM in soil consistent with Anthropogenic Background was considered in the identification of COCs.As such;:a PSS With Conditions has been achieved for this release in accordance with 310 CMR 40.1013(1)(b)and 40.1041(2)(c)2. c. Risk Characterization Method The PSS with Conditions is based on the results;of a Method 3 Risk Characterization presented in Section 8 d. Other Permanent or Temporary Solution Statements,or further:Remedial Response Actions related to'a portion of or the entire disposal site. None. e. Indication'as to whether Permanent Solution is based upon implementation of an Activity and Use Limitation(AUL)at the Disposal Site: An AUL is not necessarV10 achieve or,maintain a Condition of No Significant Risk. f. Indication at; to whether Permanent Solution is based upon assumptions about Site activities, uses or conditions that:do not require an AUL,per 310 CMR 40.f0f3a This PSS with Conditions is based the presence of some OHM in soil consistent with Anthropogenic Background per 310 CMR 40.1013(1)(b). Historic fill that represents Anthropogenic Background is present across the entire Disposal Site. g. Indication as to whether Permanent Solution is based upon:operation of Active Exposure Pathway Mitigation.Measures per 310 CMR 401025. NoActive Exposure Pathway Mitigation Measures are needed or required for this PSS with Conditions. h. LS.P Opinion as to whether requirements of applicable category of Permanent Solution have been met: The LSP Opinion is provided in Section 12,and in the BWSC104 transmittal form submitted concurrently with this PSS with Conditions Staternentvia eDEP(See Appendix A). Information supporting the conclusion that a level of hto:Significant,Risk has been achieved or exists. A Method 3 Risk.Characterization is included as Section 8. f. Information documenting the extent to which levels of OHM in the environment have been reduced to Background,and/or the results of the feasibility evaluation demonstrating that the achievement of Background is not feasible: The feasibilityof achieving or approaching Background is presented in Section 9, g. A copy ofanyand all AULs which have been.implemented under 310 CMR 40,1070: Not Applicable. An AUL is not'necessary to achieve or maintain a Condition of No Significant Risk and will not be implemented for the Disposal Site; h. For Permanent Solutions with Conditions based upon assumptions about site activities uses, or conditions that do not require an AUL, documentation related to such assumptions and. conditions. Per 310:CMR 40.1013(1)(b), this PSS with Conditions was based on concentrations of some OHM present in fill soil that are consistent with Anthropogenic Background, as discussed in Section 8:1.1.. Historic fill was observed across the entire Disposal Site. It is not based on any other Site activities,uses or conditions that require<an AUL. I. A Data Usability Assessment documenting that the data relied'upon is scientifically valid and. defensible,and a:Data Representativeness Evaluation,documenting the adequacy of the datasets used to .support this Permanent Solution. A Data Usability Assessment and Representativeness Evaluation is presented in Section 7. j.
