Unfortunately, our Client was unable to record the License due to errors on the DEP License number and the passage of time so the attached reapplication is being submitted for your review, The applicant is re-applying for the exact same license as directed by Mass DEP due to the absences of recording the original license and plans. Submit the fewest number of sheets necessary to adequately illustrate the project on 8-1/2 inch X 11 inch paper. ❑ A 1-inch margin should be left at the top edge of each drawing for purposes of reproduction and binding. A 1/2 inch margin is required in the three other edges. ❑ A complete title block on each drawing submitted should identify the project and contain: the name of the waterway; name of the applicant; number of the sheet and total number of sheets in the set; and the date the drawing was prepared. ❑ Use only dot shading, hatching, and dashed or dotted line to show or indicate particular features of the site on the drawings. ❑ if deemed appropriate by the Department, certification by the Registered Professional Engineer or Land Surveyor is included. If a question does not apply to your project write"not applicable" (nla) in that block. Please print or type all information provided on the form. Use black ink(blue ink or pencil are not easily reproducible, therefore, neither will be accepted). If additional space is needed, attach extra 8-112" x 11" sheets of paper. ❑ Proper Public Purpose: For nonwater-dependent projects, a statement must be included that explains how the project serves a proper public purpose that provides greater benefit than detriment to public rights in tidelands or great ponds and the manner in which the project meets the applicable standards. If the project is a nonwater-dependent project located in the coastal zone, the statement should explain how the project complies with the standard governing consistency of the policies of the Massachusetts Coastal Zone Management Program, according to 310 CMR 9.54. If the project is located in an area covered by a Municipal Harbor Plan, the statement should describe how the project conforms to any applicable provisions of such plan pursuant to 310 CMR 9.34(2). ® Plans: Prepared in accordance with the applicable instructions contained in Appendix A-B of this application. For initial filing, meet the requirements of 310 CMR 9.11(3)(b)(3). ® Applicant Certification:All applications must be signed by"the landowner if other than the applicant. In lieu of the landowner's signature, the applicant may provide other evidence of legal authority to submit an application for the project site." If the project is entirely on land owned by the Commonwealth (e.g. most areas below the current low water mark in tidelands and below the historic high water mark of Great Ponds),you may simply state this in lieu of the"landowners signature". ® Municipal Zoning Certification: If required, applicants must submit a completed and signed Section E of this application by the municipal clerk or appropriate municipal official or, for the initial filing, an explanation of why the form is not included with the initial application. If the project is a public service project subject to zoning but will not require any municipal approvals, submit a certification to that effect pursuant to 310 CMR 9.34(1). ® Municipal Planning Board Notification: Applicants must submit a copy of this application to the municipal planning board for the municipality where the project is located. Submittal of the complete application to DEP must include Section H signed by the municipal clerk, or appropriate municipal official for the town where the work is to be performed, except in the case of a proposed bridge, dam, or similar structure across a river, cove, or inlet, in which case it must be certified by every municipality into which the tidewater of said river, cove, or inlet extends. ® Final Order of Conditions: A copy of one of the following three documents is required with the filing of a General Waterways Application: (1)the Final Order of Conditions (with accompanying plan) under the Wetlands Protection Act; (2)a final Determination of Applicability under that Act stating that an Order of Conditions is not required for the project; or(3)the Notice of Intent for the initial filing (if the project does not trigger review under MEPA. ❑ Massachusetts Environmental Protection Act(MEPA): MGL 30, subsections 61-61A and 301 CMR 11.00, submit as appropriate: a copy of the Environmental Notification Form (ENF) and a Certificate of the Secretary of Environmental Affairs thereon, or a copy of the final Environmental Impact Report(EIR) and Certificate of the Secretary stating that it adequately and properly complies with MEPA; and any subsequent Notice of Project change and any determination issued thereon in accordance with MEPA. For the initial filing, only a copy of the ENF and the Certificate of the Secretary thereon must be submitted. Mote; If the project is subject to MEPA,the Chapter 91 Public Notice must also be submitted to MEPA for publication in the"Environmental Monitor". The Commofteaftb of Alazzatbuotto No. 14729 Iferea, BHCM Inc. of -- Salem -- in the County of -- Essex -- and Commonwealth aforesaid, has applied to the Department of Environmental Protection for license to -- construct and maintain a water- dependent-industrial building, stormwater management system and outfall structure, shoreline revetment repair, and publicly accessible waterfront walkway C'HarborwaW ), as further describedbelow------------------------------------------------------------------------------------------------ and has submitted plans of the same; and whereas due notice of said application, and of the ti . and plaee fixed for a hearing thereen, has been given, as required by law, to the -- Mayor and City Council -- of the -- City of Salem; -----------------------------------------------_------------------- NOW, said Department, having heard all parties desiring to be heard, and having fully considered said application, , authorizes and licensesthe said ------------------------------------------------------------------------------------------------ BHCM Inc. -- subject to the provisions of the ninety-first chapter of the General Laws, and of all laws which are or may be in force applicable thereto, to -- construct and maintain a 3-story, approximately, 7,500-square foot water-dependent-industrial building, stormwater management system and outfall structure, shoreline revetment repair, and Harborwalk----------------------------- on filled tidelands of -- Salem Harbor -- and partially located within -- the Salem Harbor Designated Port Area -- at 10 White Street (Brewer Hawthorne Cove Marina) -- in the -- City of Salem -- and in accordance with the locations shown and details indicated on the accompanying License Plan No. 14729, (11 Sheets), dated September 18, 2017 and last revised May 5, 2018 ---- Waterways License NQ: 14729 Page 2 of 6 Brewer Hawthorne Cove Marina, Salem Harbor, Salem, Essex County Specific Legislative Authorizations and/or Licenses issued previously at the project site include: Department of Public Works (DPW) License No. 1729 issued on October 29, 1935, DPW License No. 1792 issued on June 12, 1936, DPW License No. 2756 issued on April 24, 1945, DPW License No. 2774 issued on June 12, 1945, DPW License No. 2963 issued on June 10, 1947, DPW License No. 2963 issued on June 10, 1947, Department of Environmental Quality Engineering (DEQE) License No. 250 issued on January 12, 1977; DEQE License No. 1590 issued on January 27, 1987, and Department of Environmental Protection (DEP) License No. 13910 issued on June 11, 2015. These authorized structures and fill shall be maintained in accordance with the terms and conditions of said Licenses and Plans, or as modified herein. The structures authorized hereby shall be limited to the following uses: water-dependent- industrial and accessory uses thereto, shoreline stabilization, conveyance and discharge of stormwater, public access to and along waterfront open space for passive recreational purposes. This License is valid for a term of thirty (30) years from the date of issuance. By written request of the Licensee for an amendment, the Department may grant a renewal for the terra of years not to exceed that authorized in this license. This License is subject to the following Special Conditions and Standard Conditions. Special Condition 1: Any structural alteration, change in use, or any other modification from that explicitly authorized herein and contained on the final license plan, shall require the prior review of the Department to determine whether additional licensing is required pursuant to M.G.L. Chapter 91,the Public Waterfront Act, and the Waterways Regulations at 310 CMR 9.00. Special Condition 2: The Licensee shall construct and maintain a 575-foot long by 10-foot wide (10-foot clear) paved Harborwalk, which is permanently installed and clearly demarcated in the areas depicted on the license plans with the following exceptions, requirements, and conditions: a) The Harborwalk must be constructed to meet the City of Salem Municipal Harbor Plan (MHP) and City Harborwalk Specifications, where feasible, or as otherwise approved by the City of Salem. b) The section of the paved Harborwalk immediately between the water-dependent-industrial building authorized herein and Salem Harbor may be less than 10-feet wide, but not less than 5-feet wide along the waters edge. In this section, the area beneath said building's overhang shall be dedicated to pedestrian use to compensate for the areas where 10-foot clear cannot otherwise be achieved. c) Said Harborwalk shall directly connect to the existing offsite Harborwalk located on 10 Blaney Street (City of Salem Ferry Parking Area) and extended to the existing sidewalk on Turner Street. d) When water-dependent or water-dependent-industrial activity is occurring at or along Waterways License NQ: 14729 Page 3 of 6 Brewer Hawthorne Cove Marina, Salem Harbor, Salem, Essex County water's edge which requires the temporary closure of portion the immediately affected Harborwalk, the Licensee must install detour signs to assist and guide the transient public to the alternative public pedestrian route depicted on the final license plans for reasons of public safety. However, upon completion of such temporary activity, the Harborwalk shall be immediately reopened to the transient public. e) Said Harborwalk shall be completed and opened to the transient public before or by the issuance of the Certificate of Occupancy issued by the City of Salem for the water- dependent-industrial building authorized herein. f) Said Harborwalk shall be open to the transient public year round, at a minimum from dawn to dusk. Hours of access must be posted at each entrance, in accordance with all local laws, the City of Salem MHP, and with the City's Sign Specifications. Said Harborwalk shall be maintained in good repair year round, including but not limited to, shoveling/plowing within 24-hours of a snow event. The Licensee may secure the Harborwalk at on-site entry points at Blaney and Turner Streets through the use of gates or other means as necessary to restrict public access for public safety during closed hours from Dusk to Dawn only. g) Nothing in this condition shall be construed as preventing the Licensee from excluding the public from portions of said property not intended for public lateral passage. Special Condition 3: The use by the public of the publicly accessible areas at the project site shall be considered a permitted use to which the limited liability provisions of M.G.L. Chapter 21, § 17c shall apply. Special Condition 4: The Licensee shall install and maintain in good repair two (2) double-sided signs of adequate size, clearly visible to pedestrians, one at each Harborwalk entrance. The first sign shall be installed adjacent to the high water shoreline directly abutting the offshe Harborwalk connection at 10 Blaney Street (City of Salem Ferry Parking Area) and the other double-sided sign shall be installed on the sidewalk at the corner of Turner Street and the driveway entrance to the project site with an arrow pointing toward the Harborwalk entrance. Said double-sided signs can also be used for wayfinding to direct the transient public from the project site to nearby points of interest as determined by the City of Salem Department of Planning and Community Development (DCPD). Said signs shall be designed in accordance with all local laws, the City of Salem MHP, and with the City's Sign Specifications. Prior to fabrication and installation of said signs, the Licensee shall submit a Draft Sign Plan with the proposed sign specifications and installation locations consistent with the above referenced requirements to the City of Salem DPCD within 90-days of license issuance for review and approval. All signs shall be installed before or by the time the Harborwalk is completed and open to the transient public. Special Condition 5: All work authorized herein shall be completed within five (5) years of the date of license issuance. Said construction period may be extended by the Department for one (1) or more one (1) year periods without public notice, provided that the Applicant submits to the Department thirty (30) days prior to the end of the construction period, a written request to extend Waterways License N 14729 Page 4 of 6 Brewer Hawthorne Cove Marina, Salem Harbor, Salem, Essex County the period and provides adequate justification for said extension. Special Condition 6: The Licensee shall allow agents of the Department to enter the project site to verify compliance with the conditions of the Chapter 91 License. Special Condition 7: The Licensee shall request, in writing, that the Department issue a Certificate of Compliance in accordance with 310 CMR 9.19 within sixty (60) days of completion of the licensed project. The request shall be accompanied by a certification by a registered professional engineer licensed in the Commonwealth that the project was completed in accordance with the License. Waterways License NQ: 14729 Page S of 6 Brewer Hawthorne Cove Marina, Salem Harbor, Salem, Essex County STANDARD WATERWAYS LICENSE CONDITIONS 1. Acceptance of this Waterways License shall constitute an agreement by the Licensee to conform with all terms and conditions stated herein. 2. This License is granted upon the express condition that any and all other applicable authorizations necessitated due to the provisions hereof shall be secured by the Licensee prior to the commencement of any activity or use authorized pursuant to this License. 3. Any change in use or any substantial structural alteration of any structure or fill authorized herein shall require the issuance by the Department of a new Waterways License in accordance with the provisions and procedures established in Chapter 91 of the Massachusetts General Laws. Any unauthorized substantial change in use or unauthorized substantial structural alteration of any structure or fill authorized herein shall render this Waterways License void. 4. This Waterways License shall be revocable by the Department for noncompliance with the terms and conditions set forth herein. This License may be revoked after the Department has given written notice of the alleged noncompliance to the Licensee and those persons who have filed a written request for such notice with the Department and afforded them a reasonable opportunity to correct said noncompliance. Failure to correct said noncompliance after the issuance of a written notice by the Department shall render this Waterways License void and the Commonwealth may proceed to remove or cause removal of any structure or fill authorized herein at the expense of the Licensee,its successors and assigns as an unauthorized and unlawful structure and/or fill. 5. The structures and/or fill authorized herein shall he maintained in good repair and in accordance with the terms and conditions stated herein and the details indicated on the accompanying license plans. b. Nothing in this Waterways License shall be construed as authorizing encroachment in, on or over property not owned or controlled by the Licensee, except with the written consent of the owner or owners thereof: The Licensee stated that BHCM Inc.was the property owner at the time the application was submitted. 7. This Waterways License is granted subject to all applicable Federal, State, County, and Municipal laws, ordinances and regulations including but not limited to a valid final Order of Conditions issued pursuant to the Wetlands Protection Act,M.G.L.Chapter 131,§40. 8. This Waterways License is granted upon the express condition that the use of the structures and/or fill authorized hereby shall be in strict conformance with all applicable requirements and authorizations of the MassDEP. 9. This License authorizes structure(s)and/or fill on: Private Tidelands- In accordance with the public easement that exists by law on private tidelands,the Licensee shall allow the public to use and to pass freely upon the area of the subject property lying between the high and low water marks,for the purposes of fishing,fowling,navigation,and the natural derivatives thereof. Commonwealth Tidelands - The Licensee shall not restrict the public's right to use and to pass freely, for any lawful purpose, upon lands lying seaward of the low water mark. Said lands are held in trust by the Commonwealth for the benefit of the public. Great Pond of the Commonwealth - The Licensee shall not restrict the public's right to use and to pass freely upon lands lying seaward of the high water mark for any lawful purpose. Navigable River or Stream-The Licensee shall not restrict the public's right to use and to pass freely,for any lawful purpose,in the waterway. No restriction on the exercise of these public rights shall be imposed unless otherwise expressly provided in this License. 10.Unless otherwise expressly provided by this License,the Licensee shall not limit the hours of availability of any areas of the subject property designated for public passage, nor place any gates, fences, or other structures on such areas in a manner that would impede or discourage the free flow of pedestrian movement thereon. The purpose of the application is to construct a new marine industrial building and provide stormwater quality with infrastructure improvements. The New facility will allow BHCM to conduct marine maintenance industrial storage, servicing and maintenance inside the new building. Background: In accordance with the Public Waterfront Act, 30 CMR 9.00 the Brewer Hawthorne Cove Marina (BHCM Inc.) is applying for a Chapter 91 Waterways Application for the Water- Dependent Use. The applicant is applying for a BRP WW01b Water-Dependent License with a licensing period of 30 years. The project is adjacent to Salem Harbor and contains historically filled tidelands and flowed tidelands below the mean high watermark. The property contains a DPA mapped area of 20,177 s.f. Approximately 3,250 s.f. of the industrial marine building is located within the DPA. The area is in NOT contained within an Area of Critical Environmental Concern (ACEC). Appendix B: Dredging Permit is not applicable, as no dredging is proposed. The proposed marine industrial building is located in historically filled tidelands and the Zone AE at elevation 10. A portion of the building is located in the Zone VE, elevation 13 and the DPA, The entire structure is located above the mean annual high water line. The proposed location of the new building requires the removal of the existing municipal-private drainage system which discharges into Salem Harbor via an existing 24" RCP drain in the revetment area. A new drainage system is proposed from the end of White Street thru the site via a new 30A RCP outfall pipe in a similar location as the existing outfall. The existing revetment in the vicinity of the stormwater outfall area will be reconstructed as shown on the attached plans. Stormwater Quality improvements are proposed such as: deep sump catch basins with gas traps, rooftop recharge system, a First Defender treatment unit, tidal gate and long terra stormwater pollution prevention plan (SWPPP). The proposed project complies with the DEP's Stormwater Management Regulations. Public access and use areas are proposed for the site. The proposed plan and application complies with 310 CIVIR 9.00 purpose as shown below: • The proposal protects and promotes the public interests in tidelands as codified in the Colonial Ordinance of 1641-47. • Preserves and protects the rights of tidelands of the inhabitants of Commonwealth are utilized for water-dependent uses. • Protects public health, safety and general welfare in the tidelands. The proposed stormwater management system will improve the quality of stormwater discharging into Salem Harbor. The new facility will provide a modern facility for completing marina operations inside a new building. The public access area provides designated safe areas for public use while protecting their welfare. • Supports public and private efforts to revitalize an urban waterfront area. The new facility, site and infrastructure improvements will provide a new, modern and clean looking revitalized marine industrial facility. Public access areas are provided away from the new building. • Fosters the rights of the people to clean air and water, freedom from excessive noise and the natural scenic, historic and aesthetic qualities of their environment. The new facility and stormwater improvements will result in improved indoor maintenance operations inside of a new building designed in keeping with the area. The indoor maintenance activities will result in a quieter environment. Stormwater quality will be improved prior to discharging into Salem Harbor. A public hearing on the above Petition was opened on November 16, 2011 pursuant to Mass General Law Ch.40A, § 11. The hearing was continued to January 18, 2012 and closed on that date with the following Zoning Board of Appeals members present: Annie Harris(acting as chair), Richard Dionne, Jamie Metsch,Jimmy Tsitsinos and Bonnle Beiair. Petitioner seeks a Variance pursuant to Section 4.0 of the City of Salem Zoning Ordinances, Statements of fact: I 1. Attorney George W.Atkins III represented petitioner BHCM, Inc, (DBA Brewer Hawthorne Cove Marina)at the hearing. 2. In a petition date-stamped October 26, 2011, petitioner requested a Variance pursuant to Sec. 4.0 of the Salem Zoning Ordinance to construct a new building on 10 White Street and 57 Rear Turner Street related to the boat yard/marina use of the property. 3. Accompanying the application form was a statement attesting to the unusual shape of the parcel, waterfront soil conditions, mixed zoning of the site,and limited access.at the end of White Street,and stating that enforcement of the dimensional regulations of the Salem Zoning Ordinance would result in hardship because the petitioner would not be"reasonably able"to use the property for a rnarina and boat yard. 4. The Board received three letters from residents opposed to the project, and one in support. 5. At the hearing on January 19, 2011,numerous neighbors spoke about the petition,several in favor of it and several against it. View was a commonly cited reason for both support and 6. opposition,with some neighbors preferring the view offered by the proposed new building, and others preferring that of the previous marina structure. 7. Also at the January 18 hearing,Attorney Atkins stated that the proposed location forthe new building was operationally best for the marina, and would have the least impact on views in the neighborhood. A view corridor study and shadow study were submitted at the hearing. The Board of Appeal, after careful consideration of the evidence presented at the public hearing, and after thorough review of the plans and petition submitted, makes the following findings: 1. Literal enforcement of the provisions of the Zoning Ordinance would require the applicant to }dace the building in such a location the Board finds to be less appropriate than the one proposed. The view analysis presented showed that impact of views from the neighborhood would be lessened if the building were placed where proposed. 2. Desirable relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the zoning ordinance, since impacts to the neighborhood were shown to be less substantial if sited as proposed rather than where it would be allowed by right. 3. In permitting such change, the Board of Appeals requires certain appropriate conditions and safeguards as noted below. On the basis of the above findings of fact and all evidence presented at the public hearing including, but not limited to,the Plans, Documents and testimony,the Zoning Board of Appeals voted four(4) in favor (Harris, Metsch, Dionne and Tsitsinos) and one (1) opposed (Belair), to grant the requested Variance under Section 4.0 of the Ordinance to allow construction of a marina building as shown on the plans submitted,subject to the following terms, conditions and safeguards: 1. Petitioner shall comply with all city and state statutes, ordinances, codes and regulations. 2. All construction shall be done as per the plans and dimensions submitted to and approved by the Building Commissioner. 3. All requirements of the Salem Fire Department relative to smoke and fire safety shall be strictly adhered to. 4, Petitioner shall obtain a building permit prior to beginning any construction. 5. A Certificate of Occupancy is to be obtained. 6. Petitioner shall obtain street numbering from the City of Salem Assessor's Office and shall display said number so as to be visible from the street. i i 7. Petitioner Is to obtain approval from any City Board or Commission having jurisdiction including, but not limited to,the Planning Board. 8.
