The property at 70 Flint Street (Site) is a paved municipal parking lot located adjacent to the
North River Canal. A South Essex Sewer District interceptor sewer is located between the Site
and the Canal. The Site was developed as a parking lot in the early 2000s. Previously, buildings
were present along the north and east perimeters. The use of the buildings is not known. The
available information indicates that they were constructed after 1978.
During remedial excavations conducted by Riverview Place, LLC in 2016 for the former adjacent
Salem Suede facility at 72 Flint Street, a soil confirmation sample was collected from the
sidewall of an excavation along the east parking lot property line. The concentration of dioxins
in this sample was 176 nanograms per kilogram (ng/kg) versus a MassDEP Reportable
Concentration of 20 ng/kg. However, a subsequent instrument survey of the property line
showed that the sample inadvertently was collected approximately three feet inside the City of
Salem parking lot rather than on the Salem Suede property. The detection resulted in the
submitting of a Release Notification Form to MassDEP by the City of Salem.
Subsequently, additional soil samples were collected to assess the presence of the constituents
of concern identified on the adjacent Salem Suede property. An elevated concentration of
arsenic in one soil sample from one of the soil borings was detected at 97.6 mg/kg versus a
Reportable Concentration of 20 mg/kg. One elevated Low concentrations of arsenic were
observed in two of the 13 shallow soil samples that were excavated.
The City of Salem intends to record an Activity and Use Limitation (AUL) on the property to
restrict the use of the Site from residential use and maintain the current use as a parking to
achieve a condition of No Significant Risk.
Riverview Place has concluded that the following as to the identified release at the Site:
• Impacts to soil are due to localized historical dumping activities from activities at the
adjacent former Salem Suede property.
• Subsurface investigation and excavation have identified the extent of the affected area
on the Site.
• The release has not impacted other environmental media.
No Imminent Hazard or other condition requiring IRA activities is present.
Site conditions have been compared to the Tier I inclusionary criteria set forth at 310 CMR
40.0520(2), and concluded that the Site does not meet any of these criteria. Therefore, the
MassDEP classifies the Site as Tier II.
