Dear Mr.Jacobson,
As the City has not received a response from your Attorney, Andrew J. Tine, after two different letters,July 23
and August 13,2018 , requesting proof of the above referenced property as a sober home eligible for an
exemption from certain zoning requirements, I have no choice but to cite you for a zoning violation.The
number of unrelated persons occupying the property( 13 or 14)exceeds the number allowed by rite(3 per unit
or 6 total ) in the R-2 Zoning District..
Further, the operation of a rooming , boarding or lodging house requires a Special Permit from the Board of
Appeals.
You are directed to cease using the property as a rooming house per Table# 3 of The Salem Zoning Ordinance
Allowed uses. .
Enclosed ,find a City Ordinance violation.
You have the right to Appeal my Zoning interpretation to the Salem Zoning Board of Appeals.

Dear Mayor Driscoll:
Golder Associates Inc. (Golder) has prepared this communication on behalf of BASF, who are hereby providing
notification of the recording of an Activity and Use Limitation (AUL), which was filed on October 31, 2018, in
accordance the Massachusetts Contingency Plan (MCP). As stated in 310 CMR 40.1403(7)(a)of the MCP, a copy
of the recorded AUL shall be provided to:
1. The Chief Municipal Officer;
2. The Board of Health;
3. The Zoning Official; and
4. The Building Code Enforcement Official in the community in which the property subject to such Activity and
Use Restriction is located.
As such, the attached AUL is being provided to you, as well as the entities noted above and in the CC list below.
The AUL affects the property located at 25, 30 and 40 Colonial Road Salem, Massachusetts 01971. The AUL limits
the activities and uses of the property, as specified in Section 2 of the attached AUL.
The AUL and the MCP documents on file with the MassDEP can be viewed at MassDEP website using Release
