Re: 12 MT VERNON STREET, SALEM,MA
Dear Commissioner St.Pierre and Attorney Caldwell:
This letter responds to Mr. St.Pierre's letter dated September 27, 2018, copy enclosed. I have
emailed Attorney Caldwell and left her a voicemail that the MASH submission was made for
voluntary certification, but MASH is a process, that takes its own time. As such, my client is
waiting for approval and expects same shortly. Nonetheless, with our without MASH
certification, my client is operating a congregate living arrangement for disabled individuals
entitled to equal access to housing under G.L. c. 40A, Section 3 and the Fair Housing Act. My
client requests an accommodation and compliance by the City with said laws, as previously
requested(equal use of the house afforded single family occupancy). If the process is simply to
await MASH approval, it is forthcoming. My client should not be required to pursue a ZBA
appeal. Please let me know if your letter of September 27,2018 must be appealed at this time.
Sincerely,
/s/Andrew J. Tine
