This Notice of Activity and Use Limitation ("Notice") is made as of this 3 day
of c-t f , 2018, by Univar USA Inc., a corporation organized under the laws of the
State of Washington, having its principal office at 3075 Highland Parkway, Suite 200, Downers
Grove, Illinois 60615, together with his/her/its/their successors and assigns (collectively
"Owner").
WITNES SETH:
WHEREAS, Univar USA Inc. (as successor to Hamblet & Hayes Company and
Kirto Corp.), is the owner(s) in fee simple of those certain parcel(s) of land located in Salem,
Essex County, Massachusetts with the buildings and improvements thereon, pursuant to deeds
recorded with the Essex County (Southern District) Registry of Deeds in: Book 3810, Page 589
(25 Colonial Road— Lot 1), Book 4575, Page 396 (25 Colonial Road— Lot 2); Book 4644 Page
405 (30 Colonial Road),and Book 4961 Page 276 (40 Colonial Road);
WHEREAS, said parcel(s) of land, which is more particularly bounded and
described in Exhibit A, attached hereto and made a part hereof ("Property") is subject to this
Notice of Activity and Use Limitation. The Property is shown on plans recorded in the Essex
County(Southern District) Registry of Deeds in: Plan Book 1951, Plan 155 (25 Colonial Road—
Lot 1); Plan Book 1959, Plan 401 (25 Colonial Road — Lot 2); Plan Book 1960, Plan 87 (30
Colonial Road); and Plan Book 1962, Plan 501 (40 Colonial Road);
WHEREAS, the Property comprises part of a disposal site as the result of release(s)
of oil and/or hazardous material. Exhibit B is a sketch plan showing the relationship of the
Property subject to this Notice of Activity and Use Limitation to the boundaries of said disposal
site existing within the limits of the Property and to the extent such boundaries have been
established. Exhibit B is attached hereto and made a part hereof; and
WHEREAS, one or more response actions have been selected for the Disposal Site
in accordance with M.G.L. c. 21E("Chapter 21E") and the Massachusetts Contingency Plan, 310

CMR 40.0000 ("MCP"). Said response actions are based upon (a) the restriction of human
access to and contact with oil and/or hazardous material in soil and/or groundwater and/or(b)the
restriction of certain activities occurring in, on, through, over or under the Property. A
description of the basis for such restrictions, and the oil and/or hazardous material release
event(s) or site history that resulted in the contaminated media subject to the Notice of Activity
and Use Limitation is attached hereto as Exhibit C and made a part hereof;
NOW, THEREFORE, notice is hereby given that the activity and use limitations set
forth in this Notice of Activity and Use Limitation are as follows:
1. Activities and Uses Consistent with Maintaining No Significant Risk Conditions.
The following Activities and Uses are consistent with maintaining a Permanent
Solution and a condition of No Significant Risk and, as such, may occur on the
Property pursuant to 310 CMR 40.0000:
(i) Any commercial, manufacturing, industrial or other use which is not
prohibited by, or inconsistent with those allowed under this Iimitation;
(ii)Underground utility and emergency subsurface repairs;
(iii) landscaping and grounds keeping activities as long as such activities do not
involve excavation of subsurface soils;
(iii) Such other activities or uses which, in the Opinion of a Licensed Site
Professional, shall present no greater risk of harm to health, safety, public
welfare or the environment than the activities and uses set forth in this
Paragraph; and
(iv) Such other activities and uses not identified in Paragraph 2 as being
Activities and Uses Inconsistent with (select one) maintaining No Significant
Risk Conditions.
2. Activities and Uses Inconsistent with Maintaining No Significant Risk
Conditions. The following Activities and Uses are inconsistent with maintaining a
Permanent Solution and a condition of No Significant Risk pursuant to 310 CMR
40.0000,and,as such,may not occur on the Property:
(i) Construction Activities or planned utility repairs involving excavation of
contaminated soils without a Health and Safety Plan and Soil Management Plan
approved by an LSP;
(ii)Use as residence, daycare center or a school;
(iii)Use as a playground,playing field recreational area;
(iv) Use for cultivation of fruits and vegetables for human consumption;
(v) Removal of pavement, concrete or buildings specified in Exhibit B unless an
LSP Opinion as required in Paragraph 3 (ii) indicates that such activity is
consistent with maintaining a condition of No Significant Risk;
(vi) Other activity that results in direct exposure of site workers or visitors to
subsurface contaminated soil, unless such exposure is determined to constitute a
condition of No Significant Risk in the opinion of LSP.

3. Obligations and Conditions. The following obligations and/or conditions are
necessary and shall be undertaken and/or maintained at the Property to maintain a
Permanent Solution and a condition of No Significant Risk:
(i)Excavation associated with short term utility repairs or longer term
construction work such as excavation of contaminated soils,significant
modification of buildings or construction of new buildings shall be conducted
in accordance with the applicable performance standards for post-RAO
Release Abatement Measure Plans(310 CMR 40.1067),Utility Related
Abatement Measures(310 CMR 40.1067),soil management protocols (310
CMR 40.0030),and applicable worker safety practices (310 CMR 40.0018). In
addition,a Soil Management Plan and a Health and Safety Plan shall be
prepared and approved of by an LSP before such construction activities are
initiated(as required by Paragraph 2(i)).;
(ii)If future construction activities are anticipated related to building
modification,demolition, soil excavation or new building construction, that
will alter or disturb the barrier(s) identified in Paragraph 3. (iii) below,
the provisions of Paragraph 3. (i) of this AUL will be followed and an
LSP will review the plans for such activities prior to their initiation and issue a
written LSP Opinion that activities specified in such plans will maintain a
condition of No Significant Risk prior to initiation of such activities.;and
(iii)The Security Fence, buildings, asphalt pavement, concrete,or other
impermeable barriers shall be maintained in the area shown on Exhibit B.
These barriers shall be maintained to prevent exposure to site workers,visitors
and trespassers.
4. Proposed Changes in Activities and Uses. Any proposed changes in activities
and uses at the Property which may result in higher levels of exposure to oil and/or
hazardous material than currently exist shall be evaluated by a Licensed Site
Professional who shall render an Opinion, in accordance with 310 CMR 40.1080, as
to whether the proposed changes are inconsistent with maintaining a Permanent
Solution and a condition of No Significant Risk. Any and all requirements set forth
in the Opinion to meet the objective of this Notice shall be satisfied before any such
activity or use is commenced.
5. Violation of a Permanent or Temporary Solution. The activities, uses and/or
exposures upon which this Notice is based shall not change at any time to cause a
significant risk of harm to health, safety, public welfare, or the environment or to
create substantial hazards due to exposure to oil and/or hazardous material without
the prior evaluation by a Licensed Site Professional in accordance with 310 CMR
40.1080, and without additional response actions, if necessary, to maintain a
condition of No Significant Risk.
If the activities, uses, and/or exposures upon which this Notice is based change
without the prior evaluation and additional response actions determined to be

necessary by a Licensed Site Professional in accordance with 310 CMR 40.1080, the
owner or operator of the Property subject to this Notice at the time that the activities,
uses and/or exposures change, shall comply with the requirements set forth in 310
CMR 40.0020.
6. Incorporation Into Deeds, Mortgages, Leases, and Instruments of Transfer. This
Notice shall be incorporated either in full or by reference into all future deeds,
easements, mortgages, leases, licenses, occupancy agreements or any other
instrument of transfer, whereby an interest in and/or a right to use the Property or a
portion thereof is conveyed in accordance with 310 CMR 40.1074(5).

LSP Opinion
25,30 and 40 Colonial Road (the Property)
Salem,Massachusetts
Property and Disposal Site Description
In accordance with the 310 CMR 40.1074 of the Massachusetts Contingency Plan (MCP), this
Activity and Use Limitation (AUL) Opinion has been prepared by Frank W. Lilley, Licensed
Site Professional (LSP) #4183 of Golder Associates Inc. (Golder). The owner of the Property is
Univar, USA Inc. (Univar). The Property has been the site of industrial manufacturing operations
for more than 70 years. The Property is currently zoned and used for commercial and industrial
purposes. The Property consists of three Parcels described in attached Exhibit B. Exhibit B
shows a sketch of the Parcel features. There are two structures on the Property; one is a one-
story office building and one is an unoccupied storage building for materials and products. Other
features on Exhibit B are the existing railroad spur owned by Boston and Maine Rail Road as
well as the existing pavement, truck scales, security fence and the outlines of former
manufacturing buildings, which have been demolished. This AUL is placed on the entire
Property (Exhibit A of the AUL Notice). The Disposal Site comprises approximately 80% of the
Property. However, the AUL was placed on the entire Property to simplify filing requirements
and to facilitate AUL compliance by future owners and/or users of the Property.
Property History
The Property was initially developed in the 1900s as a cement manufacturing facility.
Historically, the facility was used for the manufacture of basic chromium sulfate and aluminum
sulfate (alum) for the tanning industry. Additional operations included transfer, storage and
repackaging of petroleum chemicals and solvents. In 1993, chromium sulfate formulation was
the last active production process to be discontinued at the Disposal Site. Following cessation of
chromium sulfate production, portions of the former Production Buildings were utilized by
Univar and tenants for miscellaneous materials storage until the building's demolition in the fall
of 2010 by Univar. Bulk chemical products and materials are currently delivered to the Property
via tanker truck and rail car (via the Boston and Maine Rail Road Spur). The Storage Building
on the Property is used for storage of some of these materials. Other operations are confined to
areas adjacent to and west of the Property and the Disposal Site include bulk storage, blending,
repackaging and distribution of various chemicals.
MCP Site History RTN 3-2565
The Disposal Site located on the Property was assigned Release Tracking Number(RTN) 3-2565
by the Massachusetts Department of Environmental Protection (MassDEP) on September 26,
1989 due to a release of oil and/or hazardous materials (OHM) to the environment. A Class C-2
Response Action Outcome (RAO) Statement was submitted to the MassDEP in March 2009. On
August 5, 2014,a LSP Opinion was filed with the MassDEP reclassifying the Disposal Site from
a Tier I to a Tier II disposal site. Following the cessation of production activities in 1993
remedial response actions were conducted to remove sources of OHM including; sediment
remediation, soil removal and off-site disposal, treatment of groundwater and removal of former
production processes and buildings. The last remedial activity was completed in June of 2017.
Residual trivalent and hexavalent chromium, chlorinated and non-chlorinated volatile organics
and other metals are present in subsurface soils and groundwater within the Disposal Site

(collectively known as Contaminants of Concern or COCs). The former sources of the COCs are
associated with historic operations including but limited to leaking underground storage tanks,
production processes and spills. All sources on the Disposal Site have been eliminated or
controlled.
Disposal Site Boundary
Exhibit B of this AUL presents the approximate location of the Disposal Site Boundary with
respect to the Property Boundaries. The Disposal Site Boundary was delineated based on MCP
regulations and guidelines, including whether or not chemicals of concerns in soil and/or
groundwater are approaching or below applicable MCP Cleanup Standards and Reportable
Concentrations for Soil (RCS-1) and Groundwater (RCGW-2) as well as the opinion of the
undersigned LSP.
Current and Proposed Future Use
The Property is currently an industrial facility utilized as a parking lot and a railroad spur and
storage building for delivery and storage of chemicals. The reasonably anticipated future use of
the Site is continued use for the same activities or other commercial/industrial activities. The
existing pavement and buildings in the AUL Area prevents contact with soil and groundwater
containing OHM by site workers,visitors and trespassers. The fence around the Property reduces
the potential for trespassers and visitors to access the Property.
Risk Assessment Conclusions
The results of a Risk Characterization indicate that a condition of"No Significant Risk"exists at
the Disposal Site for current conditions and that the condition of"No Significant Risk" will be
maintained provided an AUL is placed on the Property to restrict future use and activities and
prohibit residential types of uses. A level of"No Significant Risk"has been achieved and will be
maintained if the permitted and prohibited Activities and Uses and Obligations set forth in the
Notice of Activity and Use Limitation Form 1075 that precede this Opinion are complied with.
